EL CAJON, Calif. (KGTV) - The El Cajon man who is accused of beating his roommate to death with a frying pan says he's not guilty. Brad Payton showed no expression as he was arraigned on Thursday afternoon in front of an El Cajon judge.An attorney spoke for Payton who entered the “not guilty” plea during the video-streamed initial court appearance since the attack, which happened exactly one week ago. Deputy DA Carlos Campbell told 10News that the crime comes with a sentencing of 26 years to life in prison.The attack happened before sunrise at an independent living facility on Naranca Avenue in El Cajon. Police say the two men were heard arguing before 25 year-old Payton allegedly grabbed a frying pan and beat the other man to death. 10News spoke to the victim's mother on the day he was attacked, before she knew he died. She said he suffered from a developmental disability and didn’t like to follow the rules, which was how he ended up at the living facility. His name has still not been released by the Medical Examiner’s Office. The county lists the property where the attack happened as a home to those with physical or mental disabilities. Doctors say a Massachusetts construction worker’s love of black licorice wound up costing him his life. Eating a bag and a half every day for a few weeks threw his nutrients out of whack and caused the 54-year-old man’s heart to stop, according to a report Wednesday in the New England Journal of Medicine. “Even a small amount of licorice you eat can increase your blood pressure a little bit,” said Dr. Neel Butala, a cardiologist at Massachusetts General Hospital who described the case. The problem is glycyrrhizic acid, found in black licorice and in many other foods and dietary supplements containing licorice root extract. It can cause dangerously low potassium and imbalances in other minerals called electrolytes.Eating as little as 2 ounces of black licorice a day for two weeks could cause a heart rhythm problem, the U.S. Food and Drug Administration warns.The death was clearly an extreme case. The man had switched from red, fruit-flavored twists to the black licorice version of the candy a few weeks before his death last year. DULZURA, Calif. (KGTV) - An East San Diego County man was arrested Thursday on suspicion of poisoning his wife with Thallium.The woman was taken to a hospital on March 15 with an unknown illness. Deputies said the woman had a level of Thallium in her system that was so high, medical staff believed her exposure was intentional.Thallium is a heavy metal which has been used in rat poison and ant pesticides.Sheriff’s detectives, along with the FBI, NCIS, and San Diego County HazMat, conducted an investigation and believed the woman’s husband was responsible for her poisoning.Race Remington Uto, 27, was booked into Vista Detention Facility. (KGTV) -- A rally was held Monday afternoon in El Cajon to not only celebrate the holiday season, but to also call on local leaders to fully reopen businesses and schools.The “All I Want for Christmas is Freedom” rally took place at the El Cajon Centennial Plaza, located on 200 Civic Center Way.The event was organized by the group Re-Open San Diego and was a “free and safe family event to save the spirit of Christmas, enjoy food, shopping, listening to the Mayor of El Cajon [Bill Wells] play live music, and to advocate for fully reopening San Diego businesses and schools.”State Sen. Brian Jones, Rep. Darrell Issa, and Peggy Hall with TheHealthyAmerican.org will be among those speaking at the rally. Charles Merritt is accused of killing his business partner, Joseph McStay, his wife Summer and their two young sons Giani and Joe Jr. The prosecution says Merritt was being sidelined from the business and owed thousands of dollars to McStay. The defense countered in their closing arguments that the prosecution focused on trying Merritt’s character and not the actual facts of the murder. The defense told jurors the circumstantial case produced no evidence tying their client to the family’s violent deaths. The prosecution told jurors they didn’t have to prove how, where or when the murders took place, only that Merritt committed them. The McStays disappeared from their Fallbrook home in early February 2010. Days after they were last seen, the family’s SUV was found abandoned at a strip mall parking lot in San Ysidro.In 2013, the bodies of the family members were found in the Mojave Desert, near Victorville. Prosecutors said the family died from blunt-force trauma to their heads. Authorities found a sledgehammer, believed to be the murder weapon, in one of the graves.Merritt was arrested in connection with the killings in November 2014 after sufficient evidence linking him to the case, including DNA, was discovered.Authorities alleged Merritt killed the family members inside their home and then buried them in the desert. Merritt also tried to paint over the crime scene, according to authorities.Merritt, 61, has pleaded not guilty to charges of murder and is being held without bail.Prosecutors are seeking the death penalty in the case. 1758
