NEW YORK -- A suspended NYPD officer is now facing criminal charges after using an apparent chokehold during a now-viral arrest in Queens last Sunday.Officer David Afanador has been charged with attempted aggravated strangulation and strangulation in the second degree, Queens District Attorney Melinda Katz said Thursday. The 39-year-old cop, who has a history of complaints against him, was arrested and booked at his own Queens precinct just after 9 a.m. Thursday, according to police. If convicted, Afanador faces up to seven years in prison, the DA's office said.DA Katz acknowledged that body-camera footage shows the officers being cursed at and badgered before the incident. "Everyday, however, police officers find themselves in circumstances that require them to exercise restraint and are charged with de-escalating potentially volatile conflicts," the district attorney said."Even under the most difficult of circumstances...this kind of action is exactly the kind of police conduct that the NYPD has banned and our State Legislature criminalized," Katz added.Afanador was suspended without pay Monday, just a day after being caught on video pinning 35-year-old Ricky Bellevue to the ground and apparently putting him in a banned chokehold in the confrontation on the Rockaway Beach boardwalk.Mayor Bill de Blasio said at the time it was the fastest he'd ever seen the NYPD discipline an officer. The NYPD released the body-cam video of the arrest almost immediately after bystander video of the incident went viral.Prosecutors opened the investigation into Afanador’s actions Monday, saying at the time "there must be zero tolerance for police misconduct."Afanador was acquitted in a prior case stemming from allegations he pistol-whipped a Bronx teenage suspect and broke two teeth in 2014.The officer has had eight Civilian Complaint Review Board complaints filed against him, including use of excessive force and denying medical attention, since he joined the force in 2005.The use of excessive force by police has sparked weeks of protests and rallies in New York City and nationwide. The outcries for police reform prompted Commissioner Shea to shake up leadership at the NYPD. On Wednesday, Brooklyn North Chief Jeffrey Maddrey was announced as the new head of the NYPD's Community Affairs Bureau, and a mandate to wipe the slate clean, Shea said. This story was originally published by Mark Sundstrom and Katie Corrado at WPIX. 2450

NEW YORK CITY — Two men have been indicted in the 2002 murder of Run-DMC DJ Jam Master Jay, officials announced on Monday. The hip-hop star, whose real name is Jason Mizell, was shot and killed in his recording studio in Queens on Oct. 30, 2002. He was 37.Federal prosecutors and members of the NYPD identified the suspects as Ronald Washington and Karl Jordan Jr. Watch the news conference below:Washington has long been a person of interest in the case. He is currently serving a federal prison sentence for robbery and is expected to be arraigned in connection with Jam Master Jay's death later this week.Jordan Jr. was expected to be arraigned on murder and other charges Monday afternoon.Jam Master Jay was one-third of the celebrated rap group, Run-DMC — one of the most popular trios in hip-hop history. As a DJ, he had hands of gold. The NYPD said Jam Master Jay was part of a cocaine trafficking conspiracy that led to his murder, and said the DJ had threatened to cut one of his alleged killers out of a deal with a Maryland distributor.Jay was playing video games on a couch in the studio shortly before two men were buzzed in by his assistant, Lydia High. One of them hugged Jam Master Jay before the first bullet was fired.Jay's friend, Tony Rincon, was hit by one bullet in the leg and the next bullet hit Jay in the head, killing him.He is survived by his wife and three children. This story was originally published by Mary Murphy and Lauren Cook on WPIX in New York. 1765

Newly released police body cam shows Waffle House shooting suspect Travis Reinking in East Tennessee two months before the Antioch attack. It's video from a motel in Alcoa, where Reinking was staying in February while working on a construction project. Full Coverage: Antioch Waffle House ShootingOne clip showed one of his several run-ins with the law. One of those run-ins happened just two months ago.Reinking told the officer someone kept knocking on his window and yelling. However, it was a woman who called police on him for allegedly threatening her in a violent manner. "They'll be talking loud at night, knock on the windows and walk off, and I don't know who it is,” Reinking said in the clip. Samantha Veals said she was trying to put her kids to sleep when she heard Reinking yelling. She told him to be quiet, at which point he allegedly charged inside her motel room, balled up his fist and laughed at her when she screamed.  Reinking admitted to police that he yelled at Veals but denied charging at her. He checked out of the motel that night and Veals opted to not press charges. Reinking?was arrested Monday and charged with four counts of criminal homicide, four counts of attempted murder and one count of unlawful gun possession in the commission of a violent felony.  The Waffle House reopened Wednesday and for the next month, is donating 100 percent of its proceeds to the victims of the attack.  More:  1514

NEW YORK (AP) — The credit card companies Visa and Mastercard say they will no longer allow their customers to use the cards to charge for services on the pornographic website Pornhub. The website, which claimed 42 billion visits last year, has been accused of showing videos that depict rape, underage and nonconsensual sex — most prominently in an investigation published last weekend in The New York Times. Mastercard says it has terminated its relationship with Pornhub after its own investigation confirmed violations of standards. Visa says it is still investigating, but suspended use of the card on the site. In a statement to The Associated Press on December 6, Pornhub said it is "irresponsible and flagrantly untrue," but after Visa and Mastercard announced their decision to terminate its relationship with the website, Pornhub called the decisions 'exceptionally disappointing.' 899
