LOS ANGELES (CNS) - Workers at Ralphs, Albertsons and Vons/Pavilions throughout Southern California and as far north as Santa Maria ``overwhelmingly'' ratified a new contract with the grocery chains, averting a potentially costly and disruptive strike, union officials announced Thursday. Officials with the United Food and Commercial Workers Local 770, the Los Angeles-area union representing grocery workers, issued a statement saying the deal ``represents the most significant increases in wages and benefits in over 30 years.'' ``This agreement is a first step towards security good, career jobs in the changing grocery industry,'' Kathy Finn, secretary-treasurer of UFCW 770, said in a statement. ``As important as the hundreds of millions of dollars in improvements to members is the way we got to this contract -- by standing together store by store and with our communities to demand recognition of the value we earn these corporations every day.'' Union members cast ballots on the contract proposal Monday and Tuesday. The tentative deal was announced Sunday. The previous contract between the union and the grocery companies expired in March. Grocery workers in June voted to authorize a strike if a contract deal could not be reached -- raising fears of a repeat of the 2003-04 Southland grocery strike that dragged on for 141 days. When the tentative deal was announced Sunday, Ralphs spokesman John Votava said, ``We are pleased to have worked with the union to secure increased wages, continued premium health care coverage, and pension. Our associates are the heart of our company and this agreement is a reflection of their contributions.'' According to the union, the three-year deal includes wage increases of .55 and .65 per hour depending on job classification, with pay retroactive to March. Union officials said the pact also includes more guaranteed work hours for veteran workers, improvements in health care coverage for employees and their families, full pension funding and the start of a movement to close ``the wage gap between job classifications.'' The employees work at 532 stores stretching from Central California to the Mexican border. Albertsons and Vons/Pavilions have 342 stores and 29,000 unionized employees in the region, while Ralphs has 190 stores and 18,000 employees. 2325

Alfonso Lopez told reporters at a news conference at the LAPD's Rampart Station. "One would think that would stop his action, but it did not."When the father and child got off the train at the 7th Street Metro station downtown, Lopez followed, and bystanders again intervened, Lopez said."His overbearingness while walking to the bus line was so obvious and disturbing to additional Angelenos, that they in turn stepped forward and told Lopez to leave the family alone," he said.No one contacted police, however, and Lopez followed the victims as they boarded a bus and continued to speak to them, prompting yet another group of fellow commuters to come to their aid, the captain said.When they got off the bus and began walking home, Lopez followed, he said. At the intersection of Sixth and Coronado streets, Lopez allegedly tried to grab the girl's hand and pull her away, but the father held on to his daughter and screamed for help.A woman and a homeless man intervened, and Lopez fled before police could arrive."When he tried to grab her, that's when I turned around and started yelling at him, stay the bad-word away from us, that's when the neighbors stepped in and he started walking away," Palma said at the news conference at the Rampart Station, his daughter at his side."In my mind, I wanted to turn around and fight with him," Palma said. "But I thought, if I let my daughter go ... and he snatches her and he can run with her, how am I going to run after them? It's unsafe out there -- there's a lot of crazy people. Just hold on to your kids, don't let them wander off, because anything could happen."Investigators used surveillance video from public transportation to identify Lopez as the suspect. Authorities said they believe Lopez rode public transportation to target victims in both Los Angeles and San Diego counties.Investigators believe Lopez may have targeted other young children on public transportation in both Los Angeles and San Diego counties."We believe that Elijah Lopez utilizes public transportation to not only traverse between the counties of Southern California, but to target victims," Lopez said. 3415

LOS ANGELES (CNS) - Los Angeles County public health officials announced Friday the county's first known death of a person stemming from the use of e-cigarettes, or vaping -- the fourth such death nationwide. Dr. Muntu Davis, the county's health officer, said the patient was an ``older adult who had chronic underlying health conditions,'' but vaping is considered the probable cause of death. He declined to give the patient's exact age, but said the person was over 55. Public health officials said there have been a total of 12 Los Angeles County cases of illnesses stemming from e-cigarettes, with the illness dubbed vaping-associated pulmonary injury, or VAPI. One of those 12 cases was the person who died. Authorities declined to say if the other 11 patients were still hospitalized. Health officials declined to specify exactly what type of vaping product the person used. Davis stressed that ``it is not clear at this time if there is a specific product or device'' leading to the illnesses. He said that in all but one of the 12 county cases, the patients had a ``history of using a cannabis or marijuana-type product,'' notably THC, the active chemical in marijuana. Echoing a warning issued Friday morning by the U.S. Centers for Disease Control and Prevention, Barbara Ferrer, director of the county Department of Public Health, urged residents ``to stop vaping now until further information about what is causing lung damage and deaths can be understood.'' ``The Los Angeles County Department of Public Health takes this threat seriously and today we're issuing a warning to all residents about the use of these devices as potentially harmful to proper lung function,'' Ferrer said. The Los Angeles County death is the fourth connected to vaping nationally. Authorities in Indiana on Friday morning announced a vaping-related death, and deaths were previously reported in Illinois and Oregon. CDC officials said an investigation into vaping-related cases nationwide found ``clinical similarities among those affected.'' ``We are committed to finding out what is making people sick,'' CDC director Dr. Robert R. Redfield said in a statement. ``All available information is being carefully analyzed, and these initial findings are helping us narrow the focus of our investigation and get us closer to the answers needed to save lives.'' According to the CDC, possible vaping-related illnesses have been reported in more than 25 states. ``While this investigation is ongoing, people should consider not using e-cigarette products,'' according to a CDC statement. ``People who do use e-cigarette products should monitor themselves for symptoms -- e.g., cough, shortness of breath, chest pain, nausea, vomiting, abdominal pain, fever -- and promptly seek medical attention for any health concerns. Regardless of the ongoing investigation, people who use e-cigarette products should not buy these products off the street and should not modify e-cigarette products or add any substances that are not intended by the manufacturer. E-cigarette products should never be used by youth, young adults, pregnant women, or adults who do not currently use tobacco products.'' Davis said the county has been receiving reports since Aug. 14 of ``people experiencing severe and sudden lung disease after having a history of vaping.'' He said the cases are spread across the county, with two-thirds of them in teens and young adults. ``We're not seeing this in just one age group,'' he said, nothing that the cases ``really cross the gamut'' of ages and health history. 3572

LOS ANGELES (AP) — A jury on Monday found that Katy Perry's 2013 hit "Dark Horse" improperly copied a 2009 Christian rap song, setting up arguments over how much the singer and other defendants will owe.Monday's decision returned by a nine-member federal jury in a Los Angeles courtroom came five years after Marcus Gray and two co-authors first sued alleging "Dark Horse" stole from "Joyful Noise," a song Gray released under the stage name Flame.The case now goes to a penalty phase, where the jury will decide how much the plaintiffs are owed for copyright infringement.Gray's attorneys argued that the beat and instrumental line featured through nearly half of "Dark Horse" are substantially similar to those of "Joyful Noise.""Dark Horse," a hybrid of pop, trap and hip-hop sounds that was the third single of Perry's 2013 album "Prism," spent four weeks atop the Billboard Hot 100 in early 2014, and earned Perry a Grammy nomination.Perry's attorneys argued that the song sections in question represent the kind of simple musical elements that if found to be subject to copyright would hurt music and all songwriters."They're trying to own basic building blocks of music, the alphabet of music that should be available to everyone," Perry's lawyer Christine Lepera said during closing arguments Thursday.Perry and the song's co-authors, including her producer Dr. Luke, testified during the seven-day trial that none of them had heard the song or heard of Gray before the lawsuit, nor did they listen to Christian music.Gray's attorneys had only to demonstrate, however, that "Joyful Noise" had wide dissemination and could have been heard by Perry and her co-authors, and provide as evidence that it had millions of plays on YouTube and Spotify, and that the album it's included on was nominated for a Grammy."They're trying to shove Mr. Gray into some gospel music alleyway that no one ever visits," said plaintiffs' attorney Michael A. Kahn during closing arguments, when he also pointed out that Perry had begun her career as a Christian artist.Kahn and Gray declined comment but smiled as they left the courtroom after the verdict.The 34-year-old pop superstar and "American Idol" judge brought laughs to the proceedings when she testified during its second day, and her lawyers were having technical troubles getting "Dark Horse" to play in the courtroom."I could perform it live," Perry said.No performance was necessary after the audio issues were fixed.
