SAN DIEGO (KGTV) — New details are emerging about the death of a man in San Diego Sheriff’s deputies’ custody. A recently released Medical Examiner’s report says an arrestee’s death last year was a "homicide." The District Attorney's office said last year that none of the deputies involved in the in custody death will face any criminal charges. Oscar Leal died last February 28 after deputies responded to his apartment in Vista and detained him. The Medical Examiner’s homicide classification is not a legal term, but a medical assessment. The DA's office wrote in part of a nine-page summary and statement in December last year: "... His level of methamphetamine intoxication combined with his active resistance combativeness in the duration of the struggle, all contributed to his death ... The deputies involved in his detention acted reasonably under the circumstances in bear no state criminal liability for their actions."The Sheriff Bill Gore wrote in a statement:"I am aware of the Medical Examiner's conclusion regarding the manner of death of Mr. Leal. I respectfully disagree with the classification of the manner of death in this case as a homicide.The pathologist wrote that his death was due to acute methamphetamine toxicity in the setting of agitation, physical altercation, and prone restraint. It was purely due to Mr. Leal's agitation that he was restrained. Peace officers have a duty to restrain those who are agitated and under arrest, as Mr. Leal was. Were it not for Mr. Leal's abuse of methamphetamine he would be alive today. The deputies and nurses on scene rendered immediate aid to Mr. Leal.Mr. Leal brought upon his own death with his choice to use methamphetamine. His manner of death is more accurately classified as an accident."It has not been made clear yet why the medical examiners report took 13 months to be released. 2135
SAN DIEGO (KGTV) - Police arrested two people following a pursuit through San Carlos Friday night.Officers say they responded to reports of gunshots near the San Carlos Recreation Center around 9:53 p.m. They said they tried to pull over a suspicious vehicle, but it took off. A five-minute pursuit took place before the suspect’s car crashed near the Jackson and Golfcrest Drives.The suspects rushed out of the vehicle, but one was caught after surrendering at a nearby taco shop. The other one ran into a nearby housing complex. That suspect surrendered after about a three-minute standoff.Police say they found guns in the car. SAN DIEGO (KGTV) -- Police are searching for additional victims after arresting a man they say tried to drag a 17-year-old girl to his car in North Park in late May. According to police, the attempted kidnapping happened around 7:15 a.m. on the corner of 30th Street and El Cajon Boulevard May 31. Police say Thomas Luis Salas, 38, approached the 17-year-old at a bus stop before making casual conversation. He then extended his hand for a handshake and, when the juvenile shook his hand, police say Salas tried to grab her arm and pull her toward his light blue 2011 Ford Escape. The 17-year-old fought back and was able to get away. Investigators were able to track down and identify Salas as the suspect in the case. He was arrested on attempted kidnapping charges. His bail is set at 0,000. Police are asking additional victims to come forward. Salas is a Hispanic man five feet, nine inches tall and weighs 220 pounds. He was unshaven with a goatee. Police say Salas’ eyes have a “sleepy” appearance. He also has a large tattoo on his right arm of a cartoon face inside a “sunburst” or “Flame” design. According to police, Salas may have approached other juvenile women with his phone out attempting to engage in conversation. SAN DIEGO (KGTV) - One man is dead and another injured after a shooting in City Heights Saturday night. 31-year old Dionte Floyd was killed and 38-year old Dashe Wallace was seriously injured, police said. Wallace's condition was unknown as of Sunday afternoon.According to police, the shooting happened around 6 p.m. on the corner of El Cajon Boulevard and 52nd Street. Police said two groups were involved in a fight when someone started shooting. Two of the men were shot several times before the suspects left the area. Police are reviewing surveillance footage to try to figure out what happened and find the suspects involved. 641
SAN DIEGO (KGTV) -- Police are investigating after a teenager was shot in San Diego’s Linda Vista neighborhood Thursday afternoon. According to police, a 17-year-old boy was walking with a 16-year-old girl near the 6900 block of Linda Vista Road around 12:30 p.m. Police say a silver sedan pulled up beside the pair and someone inside shot the 17-year-old in the stomach. The teen suffered minor injuries, according to police, who said he was uncooperative.Police say, during the shooting, the teens ducked behind a car in the area. The vehicle was heavily damaged. San Diego Police say officers searched a neighborhood near Tecolote Canyon for the suspect. Witnesses stated they saw five men driving away in a gray or light colored vehicle. 750
