SAN DIEGO (KGTV) - Almost a dozen gyms retained a lawyer, preparing for a fight to stay open against San Diego County's health orders.Monday Governor Gavin Newsom announced a long list of businesses needed to close down again, due to a spike in coronavirus cases.That list includes:places of worship restaurants wineries movie theatersfamily entertainment centerszoos museums cardroomsfitness centerssalonsmalls.Metroflex Gym in Oceanside has been open since May despite the health orders. Owner Lou Uridel said this renewed push to close puts them in a corner and if they close, they won't reopen."We have only one plan, that's to stay open, we don't have the option to keep closing opening, closing opening." Uridel said they've been denied a dozen times for loans."I feel like it would be a betrayal of my faith and a betrayal of my dreams to give up on that and just close down," he said.Uridel said they're a place many find comfort, "we're continuing to get a lot of new gym members, we have stopped signing up people as of today." Uridel said they had to stop to ensure their members have access to the gym with the limited capacity imposed by the county's health orders.San Diego County announced this week they were putting together strike teams to ensure businesses in the list above shut down."It definitely doesn't scare us," he said.He said the laywer they hired found a loophole where the state health order was filed by the health department, and if they are not violating any health regulations they cannot be closed down.San Diego County Public Health Officer Wilma Wooten said they were just following the state's recommendations and those businesses need to shut down to protect the community and bring down coronavirus case numbers.Uridel said they are doing everything possible to create a healthy gym environment.He said they brought in a biologist to measure their air flow with their bay doors open and about a half dozen industrial fans in place.Uridel said their air flow rated 9.1/10.He said every gym member washes their hands on the way in and out, and wipe down their equipment. He said social distancing is in place and there is more cleaning each hour.He said if the county comes after them, "all we can really do is take it in the chin, whatever they're going to throw at us. If they're going to fine us, we'll fight it in court."When asked if he was worried about his staff or members getting sick, he said "it's always a concern, but it's a concern at any business, even the ones that remain open. If you check around, a lot of cases have come out of Home Depot, and grocery stores and there hasn't been one blink to close any of those down."He says his gym is a place of healing, helping military members fight PTSD and others work through the trauma of the coronavirus.Uridel said one man who lost his wife to suicide and faced other challenges is a regular at his gym. "When he told me this is what saved his life again," Uridel said emotionally, "it just made me realize that's exactly what we have to do."He wants to keep the doors open to provide that haven during this hard time. 3129

SAN DIEGO (KGTV) -- A San Diego Marine is setting out to accomplish something few have, climbing the continent's highest peaks and running a marathon on each one.Major Patrick Holcomb is calling it the 7&7 Challenge.“It’s not really official because up until this point only two people have done it," said Holcomb, who's been in the Marine Corps for 18 years.Holcomb will rely on his rigorous training and gear as he completes the mission.He's already run five marathons on five continents and has climbed three peaks.“Every country you go to you get to experience people and culture, there are a lot of differences around the world," said Holcomb. "What’s been shocking for me is realizing, how much at the end of the day, people are all the same."He plans to use his personal mission for good, teaming up with a nonprofit that helps veterans suffering from PTSD or traumatic brain injuries.Holcomb plans to start fundraising during the final leg of the challenge, Mount Everest in 2022.He's currently based at Marine Corps Air Station Miramar. 1057

SAN DIEGO (KGTV) — An orphaned puppy at a local animal rescue will receive a state-of-the-art heart surgery to repair a rare heart murmur.Helen Woodward Animal Center said Tuesday Cowboy, a terrier-blend brought to the center last October, has an irregular heart rhythm, so intense that veterinary staff could actually feel a distinct and loud rumble if their hands were placed on his chest.The puppy was brought into the center with his mother and five siblings, all of whom have found new homes.RELATED: Puppies found abandoned in Escondido park adopted out to new homesSince Cowboy arrived at Helen Woodward, he's been cared for by center staff and a foster owner and administered a medication called Atenolol to take pressure off his heart.“We care deeply about every single orphan pet that comes into our care and go to great lengths to make sure that each one of these wonderful animals has the chance to live a long, healthy and happy life with a loving forever family,” Jennifer Shorey, Helen Woodward Animal Center Director of Operations, said. “When we learned about Cowboy’s unique condition, we didn’t hesitate to find him the expert care he needs. SAN DIEGO (KGTV) - A Valencia Park dog owner is looking for the person that took his dog from his front yard Tuesday morning. Jayden Ryan’s five-month-old french bulldog, Greyson, was last seen playing in their driveway. His security camera shows Greyson walking over to the fence, but then the camera jumps to footage of a man wearing a hood walking away, and he appeared to be carrying the dog in his arms. Ryan says there were about three to four minutes of missing footage, that might have shown the man’s face, as well as how he ended up with his dog. He says the camera company told him there was an issue on the way the video uploaded. However, a neighbor saw the incident. He told Ryan, as well as 10News, that he saw the hooded man reach over the fence, pet the dog for about a minute, then grab him and walk away. The security footage picked up audio of the neighbor yelling at the hooded stranger and then chasing after him. “(My neighbor) says he tried to run after him, but he is 54 years old. He was no match for him, so he ended up getting away,” Ryan said. Neighbors said they recently saw the man in the neighborhood. Ryan says French bulldogs are expensive so they can be enticing to thieves. He would be surprised if he were casing the neighborhood. Ryan is putting up fliers, hoping someone will have information about Greyson, or the man in the video. “They didn’t just steal my dog, they stole the happiness from me,” Ryan said. San Diego Police say no suspects have been identified at this time and no arrests have been made. 1561

SAN DIEGO (KGTV) -- A suspect was arrested Tuesday on suspicion of rape and torture after a woman reported being kidnapped in Rancho Pe?asquitos Monday morning. According to police, Seyed Hassan Kaboli, 32, was arrested around 3:45 p.m. Tuesday and booked into jail for forcible rape, torture and false imprisonment. The incident unfolded Monday morning around 10:45 a.m. when police were called to the 9800 block of Caminito Bolsa to investigate a report of a kidnapping. According to police, the woman was interviewed by investigators when Kaboli was identified as the suspect. Kaboli is currently being held on ,000,000 bail.
