SAN DIEGO (KGTV) - A judge declared a mistrial Monday in the retrial of an undocumented immigrant accused of being the driver in a San Ysidro, California hit-and-run crash which seriously injured a young boy.Constantino Banda Acosta was charged with the crash  on May 6, 2017.Investigators said Banda ran a stop sign and crashed his pickup truck into the Lake family’s Honda Accord.6-year-old Lennox Lake was in a child safety seat at the back of the car. He suffered serious head injuries.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.During Banda's first trial, his passenger, Jorge Adame Ariza, also an undocumented immigrant from Mexico, testified under a grant of immunity during the defendant's two-day preliminary hearing in June that he and Banda had a number of beers that night before the accident.Adame said Banda got into a fight with another man outside a Chula Vista restaurant. Adame told them he picked up Banda but later moved into the passenger seat with Banda behind the wheel during the crash.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152 percent -- the legal limit is .08 -- during two breathalyzer tests.Federal immigration officials said Banda has been deported from the United States at least 15 times over the past 15 years, most recently on January 18.A judge will decide Friday whether a third trial will take place. 1544

SAN DIEGO (KGTV) - A patient at a North Park dental office got upset after she got hit with surprise fee.Two Thursdays ago, Linda Morrow - donning a mask and gloves - went to Pristine Dental Group for a root canal and bone grafting. After the procedure, Morrow, who doesn't have dental insurance, paid cash for the bill. It was in line with the estimate."The total bill was 0. I didn't have change, so I gave them 0 because I only had bills," said Morrow.Morrow says when no one in the office could make change, the receptionist spoke up."She commented, 'Oh, PPE.'" said Morrow.Morrow says her new bill was for 0 dollars, including a charge for personal protective equipment used by the dental staff."That shut my mouth. I was stunned," said Morrow.Confused, Morrow paid the full amount and left."My concept was that it was definitely an afterthought. If I had exactly 0 or my debit card, I would not have had to pay the charge," said Morrow.Morrow posted details of the charge of the Nextdoor app. Quickly, several neighbors responded that they also have paid similar charges at their dentist offices, ranging from to . The owner of Pristine Dental says all patients with an email on file are sent an explanation of the new fee before the appointment. SAN DIEGO (KGTV) -- A Kearny Mesa couple says a local hawk is preying on neighborhood cats, and hope their story prompts pet owners to be cautious. Over Memorial Day weekend Caralee and Joe Jaeckels took their cats outside to enjoy the garden. Not long after, they said a hawk swooped down. "At first we thought it was kind of cool," they said. "It's this bird flying around. But we discovered pretty quickly that it was not a cool thing."The bird began attacking the couple's cat Ludwick. Thankfully, the 16-pound cat was able to escape with only a scratch on his face. His owners say this probably meant he was too heavy for the hawk to carry him away. 677

SAN DIEGO (KGTV) — A Rancho Bernardo family's home has become a must-see experience for their neighbors. Inspired by Disneyland's Haunted Mansion, the Loveless family has created a walk-through Halloween event that has grown bigger and bigger each year. She has recreated many of the iconic characters from the popular ride, as well as adding other spooks and haunts.For creator Katherine Loveless, it brings her back to her childhood. "I grew up on a city street that had a lot of haunted houses like this, so I grew up with it," Loveless said.Loveless and her husband, Bernard, began work on this year's Loveless Manor in August. They have created panels, which serve as moveable walls to create a maze-like path that runs through their yard. The family put a lot of thought into how to adjust their plans for the pandemic.“Last year we did kind of a smaller, tight trail that went in and out the same gateway," Bernard said. "We knew that wasn’t an option and we needed to have the whole trail outside and have more space between groups.”Loveless Manor is only open Halloween night.
