SAN DIEGO (KGTV) - A federal judge has ordered the San Diego Police Department to stop citing people for living in their vehicles.The decision comes after a lawsuit was filed against the city by a group of homeless people and their advocates.On Tuesday, United States District Judge Anthony Battaglia agreed with the plaintiff’s argument that the city’s municipal code was too vague in defining what constitutes habitation of a vehicle.Tristia Bauman, an attorney with the National Law Center on Homelessness & Poverty which helped work on the case told 10News, “we are very happy and pleased that the judge understood what we were arguing.”However, that was only one half of the lawsuit. The other half targeted the city’s municipal ordinance that outlaws RV parking from 2-6a.m. Known as the Nighttime RV Ordinance, or Oversized Vehicle Ordinance (OVO), the judge denied the request to enjoin it, saying the same argument did not apply.In the decision, Battaglia wrote “while the court sympathies that this Ordinance leaves Plaintiffs with nowhere to park between these hours and is decidedly unfair, the law is not ambiguous, unclear or vague in any way.”A spokesperson for city attorney Mara Elliot declined to comment beyond saying they “will review the ruling and advise our client.”An early neutral evaluation conference had been scheduled for Thursday with all the parties. SAN DIEGO (KGTV) -- A driver crashed his Mercedes-Benz through an underground parking garage gate, causing the gate to fall onto his car and leaving the vehicle -- and himself -- trapped at the entrance.The incident was reported at around 2:30 a.m. Tuesday at an apartment complex in the 4300 block of Menlo Avenue, according to San Diego police.With the large gate on top of the car, responding officers helped the driver out of his vehicle.ABC 10News learned the man was treated by medics at the scene but was also being evaluated for possible DUI. He did not appear to be seriously hurt.It's unclear why the driver was attempting to enter the parking garage since he reportedly told police he does not live in the apartment complex. 743

SAN DIEGO (KGTV) -- A brief pursuit involving a stolen BMW ended Wednesday morning near a nursing home parking lot.The incident began shortly after 10 p.m. Tuesday when a new model BMW was reported stolen in Santee.Two hours later, San Diego police spotted the BMW traveling westbound on state Route 94 near the Euclid Avenue exit.When officers attempted to stop the car, the driver refused to pull over and sped away. With police in pursuit, the BMW made its way onto northbound Interstate 805, then transitioned to Interstate 15.The driver exited on Adams Avenue, crashed into a wall, and then got back on northbound I-15.After exiting Camino Del Rio South, police said the driver parked the stolen BMW in a nursing home parking lot in Mission Valley and ran away. Police found him a few blocks away and arrested him.The driver's name and the charges he faces were not immediately confirmed. 901

SAN DIEGO (KGTV) -- San Diego leaders returned from their trip to Mexico City on Wednesday night. The three-day trip focused on building stronger border relations. The trip comes a week after President Trump threatened to close the border if congress didn't come up with an immigration deal or if Mexico didn't stop migrants heading north. The delegation included San Diego and Imperial Beach mayors, Kevin Faulconer and Serge Dedina and former mayor Jerry Sanders. Several city council members from various cities also attended meeting with top Mexican officials. A big topic of conversation was the ongoing Tijuana sewage issue. Impeiral Beach Mayor, Dedina, says the conversations were positive and promising. Dedina says plans to fix the issue include reapairing the water plant that's currently spilling the sewage, taking all of the water out of the Tijuana River Valley and putting an earth-fill dam on the Mexican side to stop the sewage from getting to the beaches. San Diego leaders say the trip was productive and explained that the end goal was to find solutions to enhance the region for the benefit of both countries. 1142

The Utes bowl week itinerary includes a joint visit with the Wildcats to U.S. Navy aircraft carrier USS Theodore Roosevelt on Friday and a trip to the San Diego Zoo on Saturday. The Northwestern team is staying at the Marriott Marquis San Diego Marina in downtown San Diego and practicing at Southwestern College in Chula Vista. The Wildcats will visit SeaWorld on Saturday.
