(KGTV) -- After Larry McNamer received a cease-and-desist letter from San Diego County officials, during the first week purple tier restrictions went into place, he said he will not back down."This is what courts are for. I'll fight it, I will fight it," the owner of Major’s Diner in Pine Valley said.In the letter, county officials noted he could face up to a ,000 fine for every violation under the state's guidelines, which includes not allowing guests inside."It could be ,000. I don't care because I can't afford to pay it, so I couldn't pay it if I had to,” McNamer told ABC 10News.McNamer said it all boils down to survival of this business and what he thinks is right in an uphill battle with the county and the state."They're going to have be a lot more fair about doling this out and understand that we zero cases up here [in Pine Valley],” he said.Even as he continues to serve up hot plates inside, McNamer said nothing changes when it comes to safety measures given by the state. He said guests are sat apart inside and have the option of dining outdoors if they choose.ABC 10News caught up with a couple from Alpine who grabbed a bite to eat Friday morning, not because Major's was the only diner open but they wanted to support him after seeing him on ABC 10News newscasts."We saw they were in trouble and in need of assistance, so we came to support them,” the supporter, Mark, said.ABC 10News asked Mark and his wife if they thought customers supporting restaurants who defy public health orders are contributing to the problem of COVID-19 cases rates surging, as restrictions continue to grow."Show me the data that these are sources of community spread because the data I see doesn't show that,” Mark said.McNamer said he's been receiving postcards and letters from people across the county supporting his choice of staying open to survive."It empowers you, it lets you know you're doing the right thing,” he said. 1967

PHOENIX — Arizona news station ABC15 has learned that an Arizona lawyer assisting the Trump campaign is looking at ballots filled out with Sharpies as one focus for what could become an attempt to flip Arizona to President Donald Trump.The attorney says many Trump supporters who used Sharpies are worried that their votes are being thrown out as the counting process continues around Arizona. There is no evidence at this point that Sharpie votes have been disqualified.The attorney, who has deep roots in the state’s election processing system, told ABC15’s Nicole Valdes that the Sharpie ballots are on the radar of those deciding what, if anything, they may do in court. The information was given on condition that the source would not be named. ABC15 has verified that the attorney has direct knowledge of the developing legal strategy for President Donald Trump in Arizona.The information comes as ABC News reported Wednesday that Governor Doug Ducey told the White House he “sees something” that could get Arizona and its 11 electoral votes in the win column for the President.At this point, there’s no sign of any movement toward actual litigation around the Sharpie ballots or any other vote casting or vote counting activity.Arizona Secretary of State Katie Hobbs is on the record defending the Sharpie ballots, though a ballpoint pen is the recommended method for filling out a ballot. ABC15 checked in with attorneys representing Democratic candidates, who say they have not heard of any potential litigation yet.Sharpie is the trademarked name of a permanent felt tip marker. Its use on Arizona ballots became a prominent conversation point on Twitter overnight.The Maricopa County Elections Department says even if marks made by Sharpies or any felt tip marker on a ballot bleed through the paper, it won't impact their tabulator's ability to read contests. Maricopa County's tabulators are designed only to read the ovals for each contest, according to county election officials. Even if ink bleeds through to the other side of the ballot, the ink won't mark another contest, since ballots are printed in an "off-set" pattern, meaning contests on the back side of the ballot don't align with those on the front.Republicans and the Trump campaign were shocked when Fox News declared Democrat Joe Biden the Arizona winner at about 9:30 p.m. on Election Day. Police have issued an Amber Alert after a 13-year-old girl was abducted outside her home in Lumberton, North Carolina, Monday morning.Hania Noelia Aguilar was at the Rosewood Mobile Home Park waiting for the rest of her family to come outside and drive to school when she was forced into a car just before 7 a.m. ET, the FBI and Lumberton Police Department say."A witness saw a male subject dressed in all black and wearing a yellow bandana force Hania into a relative's vehicle that was parked in the driveway," the FBI said in a statement."Hania is a Hispanic female, 5 feet tall, weighing approximately 126 pounds. She has black hair, and brown eyes. She was last seen wearing a blue shirt with flowers and blue jeans," it said."Hania's mother asks whoever took her daughter to please bring her back home," the Lumberton Police Department said in a release posted to Facebook.It said Hania was driven away in a green, 2002 Ford Expedition with South Carolina license plate NWS-984. The hood of the car is peeling and there is a Clemson sticker on the rear window.Police, the Robeson County Sheriff's Office, FBI agents and agents with the State Bureau of Investigation are following nearly 50 leads, the release said.CNN affiliate WRAL reported that Hania was an eighth grader at Lumberton Junior High School.It quoted her sister Heylin Perez as saying Hania had gone outside to start the family's car despite her aunt telling her not to."She just got the keys and started to turn it on," Perez said. Perhaps making up for lost time after going five years since her last starring role, Drew Barrymore pulls double duty in "The Stand-In." The comedy is a "The Prince and the Pauper" knockoff that isn't worthy of a single Barrymore performance, let alone two.While Barrymore shows off some range in exploring the two characters, the script doesn't provide enough material for either of them to stand out.She plays both fallen comedy star Candy Black and her meek stand-in, Paula. Once a judge sentences Candy to rehab, she and Paula work out a switcheroo deal that spares Candy the inconvenience of alcoholism recovery while giving Paula a break from her dreary life.You can usually tell whether or not a comedy has a shot at working in the first 15 minutes, when there are no concerns for setting up the story and the characters are free to romp without a care of advancing the tale. "The Stand-In" gets stuck in the mud early on, focusing on its bizarre setup. Candy comes off as an intolerable diva, while Paula is a helpless pushover. Neither is all that appealing.At least it's got Barrymore going for it. Bursting with personality while showing off the vulnerability that she's had full command of ever since she was a tyke in "E.T." she retains the star charisma that shot her up the ranks of the Hollywood elite. Since roles in the vein of "The Wedding Singer" and "Never Been Kissed" are no longer coming along, it's refreshing to see her reinvent herself as a Melissa McCarthy-style comedic force of nature.Director Jamie Babbit manages to squeeze a few laughs out of her capable ensemble cast, which includes Ellie Kemper and T.J. Miller, but the lazy story takes way too long to push forward, and any potential emotional impact falls by the wayside as the dull plot plods its way to its conclusion.The central message in most movies like this is that the grass isn't greener on the other side.
