SAN DIEGO (CNS) - A judge took under submission today a motion by the federal government to dismiss a lawsuit filed by the cities of Imperial Beach and Chula Vista and the Port of San Diego, alleging that the International Boundary and Water Commission is violating the Clean Water Act by not doing more to prevent Tijuana sewage from flowing into San Diego area waters.The federal government maintains that the IBWC isn't legally responsible for the sewage flowing into U.S. waters from Mexico.But the plaintiffs claim that since the IBWC oversees a flood control channel that redirects the Tijuana River on its way to the Pacific Ocean, as well as water- capture basins in five canyons along the border, the agency is responsible for the sewage that gets through those systems.RELATED: Imperial Beach businesses hurt by sewage & runoff related closuresImperial Beach Mayor Serge Dedina, who has led the fight to against the IBWC since his city was hit with millions of gallons of raw sewage in February 2017, said it was heartening to hear U.S. District Judge Jeffrey Miller say he might go to the South Bay to see first-hand how the situation is being handled.Dedina said the plaintiffs got a fair hearing. "(It was) a very emotional morning for me," Dedina said outside court. "(I have) vivid memories of taking my kids to the emergency room. We have little kids here. Our kids are getting sick. Our lifeguards are getting sick. It's been a long road and a really tough fight, and it really meant a lot to me that members of our community were here to support that. And I'll tell you what, if our city council and our city ... have to crawl on broken glass through garbage to fight for this, we will do that. SAN DIEGO (CNS) - A woman robbed a San Diego vape and smoke shop at gunpoint and was later arrested, authorities said Saturday.It happened just before 10 p.m. Friday at the shop at 3094 National Avenue, according to San Diego police Officer Robert Heims.The woman walked in, pointed a gun at an employee and demanded money, Heims said. She took an unknown amount of money and fled eastbound on National Avenue.Officers located the suspect a few hours later near South 32nd Street and arrested her, he said.The suspect was identified as Jeanette Sarmiento, 37, Heims said. 579

SAN DIEGO (CNS) - A San Diego judge's ruling today clears the way for the proposed Plaza de Panama project in Balboa Park to proceed.San Diego Superior Court Judge Gregory W. Pollack ruled both the project's proposed bond funding mechanism and an agreement of cooperation with the Plaza de Panama Committee to be legal, allowing the city to proceed with the plan to reduce traffic congestion in the park, according to the city attorney's office.San Diegans for Open Government argued that the city should have allowed voters to decide whether the city should rely on million in bonds to help fund the project.The City Council approved the project by a 7-1 vote in 2012, but six years of challenges and litigation stalled its implementation.The project will limit vehicle access and improve parking in order to restore the Plaza de California and Plaza de Panama as dedicated pedestrian areas."Balboa Park truly is the jewel of San Diego, and I am excited that the city can finally move forward with its plans to revitalize the Park for the enjoyment of San Diegans and tourists alike," City Attorney Mara W. Elliott said after the ruling.The Plaza de Panama project will also include improvements to more than six acres of park space and improved park access. SAN DIEGO (CNS) - Health officials Wednesday reported seven more deaths in San Diego County due to influenza complications last week, bringing this flu season's death toll to 42.The seven residents were between the ages of 53 and 90 and all had additional medical issues. Only two of them had been vaccinated, according to the county Health and Human Services Agency. At this time last flu season, the county had received reports of 281 deaths due to flu complications.The county also saw a new weekly high for lab-confirmed flu cases at 545, according to the HHSA's weekly flu report. The county has recorded 5,486 confirmed flu cases so far this flu season, a far cry from the 17,397 reported at this time last flu season. County health officials touted the data in the weekly flu report as evidence that the current flu season may still be cresting."Influenza is still widespread in the region and continues to sicken San Diegans," said Dr. Wilma Wooten, the county's public health officer. "Anyone who has not yet had a flu vaccine this season should get it now."County health officials and the Centers for Disease Control and Prevention strongly advise the annual flu vaccination for everyone 6 months and older, especially demographics with a heightened risk of serious complications, such as pregnant women, people older than 65 and people with chronic conditions. SAN DIEGO (CNS) - Jurors reached a verdict Tuesday in the trial of a Navy SEAL accused of fatally stabbing a wounded teenage ISIS fighter in the neck, shooting at numerous Iraqi civilians and threatening fellow SEALs to keep them from reporting him.Jurors found Special Operations Chief Edward Gallagher not guilty on six out of seven charges, including not guilty verdicts for premeditated murder, two charges of attempted premeditated murder, obstruction of justice, retaliation, and willful discharge of a weapon. Jurors did find him guilty of wrongfully posing for a photo with the teen's body. That guilty charge carries a possible sentence up to four months. 673
