SAN DIEGO (KGTV) — A San Diego-area man and his grandmother filed a federal lawsuit against two San Diego County Sheriff's Deputies.The lawsuit alleges deputies responded to the wrong address and pulled a then-17-year-old out of his apartment. "I've never experienced something like that," said Cesar Jaramillo.Jaramillo says last October he was watching TV on the couch when he heard a knock at the door. He says deputies asked if someone from the residence called 911.According to his lawsuit, "Cesar informed defendants the call was not from his residence. When defendants asked Cesar if there was a young black female in the apartment, Cesar said 'No,' and informed defendants that they were at the wrong apartment building. Cesar knew who defendants were referencing and knew they lived in the other building. Cesar informed the deputies over half-a-dozen times that defendants were at the wrong building."Jaramillo tells 10News he complied with everything the deputies asked but felt like they didn't believe him."That's when I started closing the wide door, that's when he just reached in and grabbed my hand," Jaramillo said.The lawsuit claims, "Without warrant or probable cause, both defendants unreasonably lured Cesar to unlock and open the door, then entered into Plaintiff's residence and forcibly pulled Cesar by the forearms into submission, leaving instant bruises on both arms."Jaramillo's grandmother was in the back of the house at the time and said she woke up to the commotion."I saw my grandson laying on the ground, in handcuffs and I went crazy, and I said, what is happening," said Teodora Villalobos.According to the lawsuit, "Due to unreasonable seizure and force used on her grandson Cesar, as well as defendants' indifferent attitude, Teodora began having heart complications on scene."Jaramillo's lawsuit alleges negligence, battery, and unreasonable search and seizure, among other things.10News reached out to the San Diego County Sheriff's Department for comment, but a spokesperson they can't comment on pending litigation. 2066

SAN DIEGO (KGTV) — A school district superintendent and a Native American reservation leader in North County are speaking out against the proposed placement of a sexually violent predator. On Thursday, there were strong reactions from those who are close to North County's Pauma Valley home where sexually violent predator Joshua Cooley could soon be placed. “When people like this are placed by our borders, it's very concerning,” Temet Aguilar, the Chairman of the Pauma Band of Mission Indians, said Thursday. Aguilar is encouraging the hundreds of families on and near the reservation to speak out against the placement of 40-year-old Cooley, whose victims were 12-years-old.“They think this is an area that's rural and there's nobody out here but actually it's more dangerous. Predators can hide out here. We have a tremendous amount of agriculture. We have rural lands,” he added.Valley Center-Pauma Unified School District Superintendent Ron McCowan told ABC10 News they'll write letters if they have to to make sure they're voices on the matter is heard. “We'll write the letters if we have to. We'll show up at the court hearing if we have to," McCowan said. “We'll make every effort we can. We'll work alongside our local officials and make sure that our voice for our community is heard and make sure they understand the risk that they're putting our young children in.”This Tuesday, DA Summer Stephan sent a letter to the Department of State Hospitals, urging the Department to find a different place for Cooley, who's from Northern California, not San Diego. He has no local connections.It's unclear why the Department is seeking his housing in San Diego.Next month, a Humboldt County judge will consider a request from the Department to place him in Pauma.If granted, it would mark the first time that such a predator from outside San Diego would be placed in our county.DA Stephan has called the move reckless and irresponsible. She said that in July, a San Diego judge struck down a request to place 75-year-old sexually violent predator Joseph Bocklett in the same Pauma home.According to an ABC station in Northern California, Cooley’s been denied placement in at least four different areas in and near Humboldt.The Department of State Hospitals will not confirm any information about Cooley, citing privacy concerns. A Humboldt County court official called ABC10 News on Thursday to say the Court would not comment.On Oct. 9, at 8:30 a.m., a hearing on Cooley's placement will be available for viewing at https://www.humboldt.courts.ca.gov/.Those interested in submitting a public comment for the hearing can do so between Sept. 15-23. SAN DIEGO (KGTV) — A San Diego tradition will return this holiday season, though not to the same stage we're used to seeing.The Old Globe's production of "Dr. Seuss’s How the Grinch Stole Christmas!" won't be taking the theater's stage this year, instead, coming to audiences on the radio and online. The free, audio-only production can be heard on 89.5 FM and can also be streamed on the KPBS website or mobile app, and on smart speakers on Nov. 26, Dec. 5, and Dec. 20 at 12 p.m.; and Dec. 24 at 6 p.m.Of course, fans of the show can expect their favorite songs, including "Santa for a Day," "You’re a Mean One, Mr. Grinch," and "Welcome, Christmas (Fah Who Doraze)."And though live showings at the Old Globe are canceled until further notice due to the pandemic, another piece of holiday cheer will return outside of the theater. SAN DIEGO (KGTV) - A woman suffered serious injuries from a hit-and-run crash Saturday while walking in the East Village, San Diego Police said.The 47-year-old woman was dragging her wheelchair across F St. at Park Blvd. at 3:55 a.m. when she was struck by a gray or silver Honda heading west.The car was last seen going north on 11th Ave., police said.The victim suffered two broken legs and a pelvic fracture.San Diego Police Traffic Division officers are investigating the case. 494

SAN DIEGO (KGTV) — A woman broke her thigh bone after she was riding on a motorized scooter and lost control in downtown San Diego Friday.The 65-year-old woman was riding a Bird scooter just before 2 p.m. in the Embarcadero area, according to San Diego Police. Her family members were also riding scooters with her.For some reason, police say the woman lost control of the scooter and overturned.
