ENCINITAS, Calif. (KGTV) -- The San Diego Sheriff's Office is investigating an incident involving Phil Graham, a candidate to represent the 76th district in the California Assembly. Niki Burgan filed the battery case with the Sheriff's Office Sunday, May 20.  She accuses Graham of forcibly kissing her at an Encinitas Bar. Burgan told 10News that it happened at 1st Street Bar on S. Coast Hwy 101 on the evening of Sunday, May 13, into the early morning of Monday, May 14 as the bar was closing. She said that Graham had initially been flirting, even mentioning that he was running for office and asked whether she would vote for him. After finding out that he was a Republican candidate she said, no she was a Democrat. At some point, she says his talk turned into aggression and Graham grabbed her hair, pulled her in, and started to kiss her. She said she had to push him off. Burgan also said she remembers that Graham had so much to drink that night that she had to help him sign his tab. The next morning Burgan says she learned that he was related to former Governor Pete Wilson and she was worried about repercussions. That's why she didn't file right charges right away.  1259

(KGTV) - Neighbors in Encinitas are warning people about the dangers of the Sago Palm after two dogs on the same street passed away from sago poisoning.Ronnie Steinau says her dog, Luna, died within 24 hours of eating some seeds from a Sago Palm."She was the happiest, tail wagging, loved everyone and 'she's the kind of dog that everyone loved because she was so sweet," Steinau says. "We had her for about a year. We miss her."After posting about Luna on social media groups, Steinau learned a neighbor had a similar experience."We had no idea there was something so deadly all around us," says Alissa Dalaut.Dalaut says her dog Saber ate some sago palm seeds in December and died a few days afterward, despite aggressive treatment from her vet."We felt horrible, and we wished we would have known how toxic and how fatal and how dangerous these plants are," says Dalaut.According to PetMD.com, the sago palm contains a toxin called Cycasin. It can cause severe liver damage. Other symptoms of sago poisoning include:VomitingBlood in fecesBloody diarrheaIcterus (yellow coloration of skin and gums)Increased thirstIncreased urineBruisingBleeding easily (coagulopathy, DIC)Neurological signs such as depression, circling, paralysis, seizures, comaDeathThe toxin is found in the sago roots, seeds and leaves. Veterinarians say you should seek medical attention immediately if you suspect your pet has eaten it. Children can also get sick from eating it.Dalaut had 12 sago palms in her house. She has since had them all removed. Steinau also had a sago palm removed from her backyard and has plans to cut down another on her porch.Now the two women are warning others of the dangers in their neighborhood."If you have them in your yard and you have children or pets, you're asking for trouble," says Steinau.Steinau would also like nurseries to do a better job of telling people about the dangers associated with sago palms and other trees when they're sold. ESCONDIDO (CNS) - A Pauma Valley man accused of ambushing three San Diego County sheriff's deputies at his home in a rural area near Casino Pauma, sparking a nearly six-hour standoff in which he suffered a gunshot wound, was charged today with three counts of assault with a semiautomatic firearm on a peace officer.Arraignment for 28-year-old Jose Nieto at Palomar Medical Center was postponed until Jan. 11 because he was deemed medically unfit for the proceeding while being treated for the gunshot wound he sustained during last Thursday's standoff.The complaint against Nieto includes allegations of personal use and discharge of a firearm. He faces 33 years and eight months in prison if convicted, said Deputy District Attorney Michael Runyon.The standoff began around 4:15 p.m. on Dec. 20, when deputies Cory Crawford, Jared Muli, and John Avedesian went to a home in the 156-00 block of Adams Drive in response to a a 911 call from a man who said "he needed help and didn't feel safe in his home."As the three deputies approached the front door of the home, they were met with gunfire, said sheriff's Lt. Rich Williams.The deputies returned fire, established a perimeter around the home and called for backup, including a SWAT team. Nearby residents were evacuated from their homes and surrounding streets were shut down. The deputies were not injured.Authorities spend hours trying to establish communication with the gunman, but when that was unsuccessful, the SWAT team entered the home about 10 p.m. and found Nieto inside with a gunshot wound to his lower body, Williams said. 1598

ENCINITAS, Calif. (KGTV) -- Video from a witness shows a driver slamming into a crowd outside an Encinitas bar early Sunday morning. In the video, a U-Haul van can be seen accelerating onto a sidewalk. Video shows pedestrians leaping out of the way before the vehicle crashes into the crowd. In a Monday news release, the San Diego County Sheriff's Department said one person is in an intensive care unit while another is undergoing surgery with serious injuries following the crash. The department says a 24-year-old victim is in an intensive care unit while a 25-year-old is in surgery with serious injuries. RELATED: Man arrested after driving into crowd outside Encinitas barA 23-year-old victim was treated for minor injuries at the hospital. All three of the victims were struck when the suspect, Christian Davis, 28, reportedly drove the van onto a sidewalk outside The Saloon Bar around 1:30 a.m. Sunday. Two others received minor injuries when they detained Davis outside the bar. Deputies say Davis was asked to leave the bar because he was too intoxicated. After complying with the request, deputies say Davis got into the van, intentionally driving it onto the sidewalk. Davis was later arrested and is being charged with three counts of attempted murder and one count of attempted escape with force. Davis is scheduled to be arraigned in Vista on March 3.
