OCEANSIDE, Calif. (KGTV) — Defense attorneys for 15 Marines accused of human smuggling said they hope the judge dismisses the case.The attorneys argued that the Commander illegally used his power to discipline the Marines publicly, and therefore influenced the outcome of the case.It was a very public display of discipline.Fifteen Camp Pendleton Marines were cuffed and taken away by NCIS agents in front of an 800-person battalion formation in July. They were accused of human smuggling and conspiracy.But now, attorneys representing a few of the accused Marines said the public arrests violated their rights. Now, they are filing what's called an "undue command influence" motion against the Battalion Commander who led the formation."Anytime you have a Commander who is in a position of leadership who potentially affects a subordinate's rights to a fair trial, that can be viewed as potential 'undue command influence,'" military attorney Gary Barthel explained. "This motion for 'undue command influence' was made against the Battalion Commander for making comments and parading the 15 individuals out for what was supposed to be a recognition, and they were ultimately arrested." Barthel is a former legal advisor to Camp Pendleton's Commanding General. He said a Commanding Officer's job is to maintain good order and discipline their command. But in military law, they also wear the prosecutor and jury selector hats."Those two hats can clash," Barthel said. "That's why it's important for Commanding Officers to be careful what they say with regard to their views of the military justice system, or their views of a particular individual who has been accused of an offense."The defense team said the Commander used his power to influence the outcome of the case unfairly. But Barthel said in his experience with 'undue command influence' cases, he believes the military has likely already taken the Commander in question off the case."You can take the individual that allegedly made the statements involved out of the process, and that keeps the process fair and impartial," Barthel said. On Friday morning, a truck pulled up outside Heim Elementary School in Williamsville to collect boxes full of shoes for the Nicaragua Mission Project.The project has been collecting supplies for people in Nicaragua for more than a decade. Based in East Amherst, it works with volunteers from local schools and churches to fill boxes with donations and send them from New York to Nicaragua.Heim Elementary School has been working with the project for years, and one fourth grader has been a part of the project for most of his life. Luke Avery started collecting shoes in kindergarten. He even goes to other schools and daycares to pick up donations. Luke has collected more than 3,000 pairs of shoes over the years. OAKLAND, Calif. — Twitter says it will label or remove misleading claims that try to undermine public confidence in elections.This includes attempts at undermining people's faith in the process itself, such as false claims about election rigging or ballot tampering.It also includes misleading claims about the results of elections, like claiming victory before results have been certified, or inciting unlawful conduct to prevent a peaceful transfer of power or orderly succession.“The goal is to further protect against content that could suppress the vote and help stop the spread of harmful misinformation that could compromise the integrity of an election or other civic process,” wrote Twitter in a blog post.The policy goes into effect Sept. 17. It applies globally, not just to the U.S., which is holding presidential elections Nov. 3.Many people are expected to vote by mail, which is likely to delay election results.Twitter says its policy of labeling, rather than removing violating tweets from world leaders, will still apply.“We will not permit our service to be abused around civic processes, most importantly elections,” Twitter wrote. “Any attempt to do so — both foreign and domestic — will be met with strict enforcement of our rules, which are applied equally and judiciously for everyone.” 1318

  

One person has died and 16 others have become ill from a salmonella outbreak linked to kosher chicken, the US Centers for Disease Control and Prevention said Wednesday.Eight people have been hospitalized, including the person who died.Illnesses were reported in Maryland, New York, Pennsylvania and Virginia. The death was reported in New York.According to the CDC, the agency began an outbreak investigation in June after several cases were reported in New York among people who said they had consumed kosher chicken."In interviews, ill people reported eating kosher chicken, and when asked about the specific brand eaten, several people reported Empire Kosher brand. The outbreak strain was also identified in samples of raw chicken collected from two facilities, including one facility that processes Empire Kosher brand chicken," the CDC said in its announcement.However, the agency is not telling consumers to avoid eating kosher chicken or Empire brand chicken. Rather, they should follow safe food preparation practices including washing hands before and after touching raw chicken and washing utensils, cutting boards and counters where raw chicken was prepared.Consumers should also cook chicken thoroughly, making sure the inside temperature reaches 165 degrees Fahrenheit. This is the temperature recommended to kill germs that cause illness such as salmonella.Salmonella illness usually begins between 12 and 72 hours after consuming the bacteria. Symptoms can include diarrhea, fever and stomach cramps and can last four to seven days.The earliest illness linked to this outbreak began September 25, and the most recent case began June 4.Severe illness may require hospitalization and treatment with antibiotics. Those most at risk for severe illness and complications are children younger than 5 and adults over 65, as well as people with compromised immune systems.The youngest patient in this outbreak is younger than 1 year old, and the oldest is 76.The US Department of Agriculture's Food Safety and Inspection Service issued a public health alert "out of an abundance of caution," the agency said."FSIS is concerned that some product may be frozen and in consumers' freezers. Consumers who have purchased these products are urged to properly handle, prepare, and cook these raw chicken products."The CDC and the USDA are working with state health officials on the investigation.Kosher food is prepared under supervision to ensure that the dietary laws followed by observant Jews are adhered to. This includes how kosher animals are slaughtered and processed. 2585
