The Kern County, California District Attorney's Office has decided not to file charges against a man who was on death row for more than two decades, setting him free.Lisa Green made the announcement on Tuesday, saying the case would be nearly impossible to retry in court. She said it would be very difficult to convince a jury beyond a reasonable doubt of Benavides' guilt.According to a decision released by the California Supreme Court last month, the convictions of Vicente Benavides in 1993 "were based on false evidence and that he received ineffective assistance of counsel."The decision also says that "false evidence was introduced at trial and that petitioner's convictions of substantive sexual offenses, special-circumstance findings, and judgment of death must be vacated."Benavides was convicted in 1993 of first-degree murder, rape and other charges. He was sentenced to life. He was serving his term on death row in San Quentin. It was asked that his murder conviction be reduced to second-degree murder. That was also thrown out. The judgment has been vacated entirely. The California Supreme Court cited multiple doctors who evaluated 21-month-old Consuelo Verdugo in November 1991 when she died. The baby was taken from the Delano Regional Medical Center to Kern Medical Center then eventually the UCLA Medical Center where she died November 25, 1991.Multiple reports were made by doctors who said based off the inability to insert a catheter, bruising found near Consuelo's genitalia and other factors, they believed she had been sexually assaulted.In the report put out by the California Supreme Court, many of those doctors then admitted later they were wrong in their initial assumptions and those issues "can instead be attributed to medical intervention," like multiple attempts at inserting a catheter.Speaking on behalf of Benavides’s post-conviction legal team after the conviction was lifted, the Habeas Corpus Resource Center’s Interim Executive Director, Michael J. The pandemic is coinciding with flu season, which is a potentially dangerous scenario doctors and nurses have given much thought to as the winter months approach.“How much is [the flu] going to play into things, and is it just going to make everything worse?” said Dr. Michelle Barron. “Is it going to comingle with COVID, and actually make people double sick or doubly ill?”Dr. Barron is the senior medical director of infection prevention and control at one of Colorado’s largest hospitals. She says staff has come up with contingency plans to deal with an influx of patients who might be battling serious flu symptoms.“We’ve been really encouraging our patients to get their flu shots and make sure they have that on their list,” she said. “We understand that there are some years that you’re debating whether or not it’s worth it, and we’re like this is the year you need to get it.”The CDC estimates around 196 million flu shots are available this year, a 13 percent increase from last year’s record-setting dosage of 175 million. It is an important number as last year 400,000 people were hospitalized for the flu, a potential burden hospitals have prepared for as bed space is now at a premium.“We’ve already surpassed the numbers of the first surge, so now, we’re like what’s next,” said Maddie Smith, a nurse at UCHealth in Colorado.Smith works in the hospital’s COVID ICU. She says while her unit has not reached a tipping point, it is expecting more flu patients to come in. Her unit has made plans to allocate more bed space to the seriously ill, regardless of cause, and treat them with whatever drugs are necessary. The major boom of online grocery ordering shows no signs of slowing down. More than six months into the COVID-19 pandemic, industry experts say the new convenience of ordering groceries through an app is here to stay. "In fact, it's been a huge acceleration. All of our clients that we serve, and we serve some of the biggest supermarkets in North America and the world, they picked up three times the volume that they were doing before this pandemic. And, in fact, more of them didn’t picked up more volume because they couldn't just fulfill enough orders at a time," said Max Pedro, the co-founder and president of Takeoff Technologies. Takeoff Technologies creates automated grocery fulfillment software for some of the biggest grocery chains in the country, including Albertsons, Safeway and Shoprite. The technology requires supermarkets to build a 10,000-square-foot warehouse directly behind their store. When a shopper places an online grocery order at one of these stores, the robots fulfill the order, automatically placing the items in bags, ready for the customer."What happens is those robots bring those individual items to a human being, but those items are coming to a person. They're suddenly making people 13 times more productive than if they have to roam a supermarket aisle to assemble that order," said Pedro.The company has already hit their five-year goal in just four months. "And it’s happened really fast and what’s also happening is we know that consumers are not going back to their previous behaviors. We forcefully trained many, many people to buy their supermarket carts online and they're sticking to it," said Pedro.Laurentia Romaniuk, an Instacart Trends Expert, agrees. "We've seen customers continue to use our site. It seems like online grocery is really here to stay. It's interesting because online grocery has existed in other countries for decades and people have built habits around it in other countries and I think, finally, now America is getting on board with the online grocery trend," said Romaniuk.Instacart, which offers grocery delivery service for a fee from a number of grocery stores across the country, says use of their site went up exponentially at the start of the pandemic. Now that we're in the fall, parents and children are still working and taking classes from home and the need to get groceries delivered or gathered for them, is still there.
