SAN DIEGO (KGTV) - The local protester who appeared in a controversial video getting taken away in an unmarked San Diego Police van is now speaking out, as police conduct an internal investigation.“No one should feel fear from the people that are supposed to serve and protect us,” Shayla Piccini told 10News on Monday as she shared the story of her arrest from last Thursday on Park Boulevard.The video shows a protester being taken away in an unmarked van as one officer warns her family around her not to follow them or he will shoot.“You see both of her legs kind of go up in the air because she's going [into the van] head first. That’s way too much force needed for this 20-year-old lady here,” said attorney Dante Pride.“That whole ride, I was asking several questions like, ‘Who are you? Where are you taking me?’ I was getting stares and no answers,” said Piccini.Piccini said she spent the day at a protest in Downtown San Diego. After several hours, the group was walking back to their car when she saw several police motorcycles driving past them. At that moment, she held up her cardboard sign.San Diego police say detectives witnessed her step off the sidewalk and swing the sign at a passing motorcycle officer, which she denied.In the foreground of the video, you can see men in what look to be marked police vests. But the people who handcuffed and detained Piccini in an unmarked van, are in plain clothes.One man wearing military-style tactical gear can be heard in the video saying, "You follow us, you will get shot. You understand me?"Piccini's cousin Brandi Matthews said she thought he was talking to her. “When he said the words, ‘I'll shoot you,’ I automatically just dropped to my knees to demonstrate that I'm not trying to hurt anybody...I just want to know where they're taking my cousin,” she added.According to San Diego Police, the statement about shooting those attempting to follow was made by a SWAT officer who had a pepper ball device. SDPD also told 10News that his comment was a valid announcement of use of force.Police said due to the large crowd still in the area, and the detectives felt the need to leave immediately.Piccini spent the night in jail on suspicion of assault on an officer. SAN DIEGO (KGTV) -- The man accused in the death of three migrants found in the trunk of a car in August was arraigned on related charges in San Diego court Tuesday. According to court documents, Neil Edwin Valera, a U.S. citizen who lives in Mexico, was arraigned in federal court in connection with the deaths of three Chinese migrants, including a mother and her 15-year-old son. The third person in the trunk was a female. None of the victims have been identified. Authorities say Valera is a truck driver from El Paso, Texas. He was arrested at a downtown bus station Saturday. Police discovered the bodies of the three migrants in the trunk of a 1999 silver BMW on August 11 after being called to the 2100 block of Jamie Avenue by a person reporting a foul odor. “The wind would start to blow a little bit, you can smell like, a really, like, it’s hard to explain. I’ve never smelled that before but I thought, well, maybe it was like trash or, you know, like that kind of smell but a very more pungent odor than that," a neighbor told 10News.Video recordings reportedly showed the same car crossing into the U.S. from Mexico on August 9. “These tragic cases are grim reminders that attempting to cross into the United States illegally in the trunk of a car – and putting your faith, hope and future in the hands of smugglers – is extremely dangerous,” said U.S. Attorney Robert Brewer. 1595

SAN DIEGO (KGTV) -- The battle over the Crossroads of the West Gun Show continued Tuesday in Del Mar.The Board that oversees the fairgrounds is reviewing the show that has been hosted at the fairgrounds for the last 28 years.A pro-gun, second-amendment political action committee collected more than 3,100 letters in support of continuing the show in Del Mar.The letters were given to the board for review and consideration. Michael Schwartz, Executive Director of the San Diego County Gun Owners is pushing is pushing for the board to renew the shows contract with no restrictions or limitations."It took us less than a week to collect all these signatures, we could have gotten more. Some are written by entire families who come to the show every year. It is a family event with almost a 30 year history with Del Mar," said Schwartz. Protesters also made an appearance at the board meeting dressed in orange and asking the board to cancel the shows current contract.The Del Mar, Solanna Beach and Encinitas city councils have approved resolutions calling for a ban on the gun shows at the fairgrounds.Guns can be purchased at the show, but California law requires extensive background checks and a waiting period.The board will make a decision to cancel or continue the gun show at it's board meeting in September. 1329

  

SAN DIEGO (KGTV) -- The California Independent System Operator again Sunday reminded consumers throughout the state conserve energy, warning of more possible rotating outages.SDG&E said early in the day Sunday that customers should be prepared for possible outages to be called from 4 p.m. to 9 p.m.The news comes after a flex alert was issued statewide from 3 p.m. to 9 p.m. daily through Monday, September 7.“Energy conservation is essential in helping reduce the possibility of widespread rotating outages and the number of people impacted. Understandably, it may be difficult to reduce energy use during the high temperatures and the ongoing pandemic. However, everyone is urged to do their part to cut back on energy use, if health and safety permits, during this critical time,” SDG&E wrote.Just before 6:30 p.m., CAISO issued a Stage 2 emergency and warned that consumers should conserve power until 9 p.m. to avoid rolling outages. Stage 2 is the step before rolling outages are ordered.The energy provider said turning off air conditioners, avoiding the use of the dishwasher, clothes washers and dryers, and switching off unused lighting can all help conserve energy.SDG&E also said the Valley Fire, which has currently burned 1,500 acres near Alpine, has impacted electrical equipment and caused power outages.SDG&E said it’s working with Cal Fire in an effort to restore power quickly. 1421

  

SAN DIEGO (KGTV) — Surveillance footage captured a man attacking a gas station customer in Kearny Mesa before fleeing.A 54-year-old man was paying for his coffee at the Mobil station at 8380 Clairemont Mesa Blvd. on Saturday just after 3 p.m., when the suspect began speaking to the man. Police said the suspect was not making any sense when he was speaking to the victim.Then for no reason, the man pulled a small wooden bat from a tool bag and began to hit the victim on the back of his head. He fled from the business, running southbound on Kearny Mesa Road, police say.RELATED: Surveillance video captures deadly crash in Chula VistaThe victim was taken to a local hospital where he was treated for a concussion, cut to his head, and broken finger.Police said the suspect was wearing a yellow construction helmet, black hooded sweatshirt with a yellow reflective vest over it, work gloves, dark pants, and work boots.
