SAN DIEGO (KGTV) - On Wednesday, ABC10 News interviewed San Diego County Superior Court Presiding Judge Lorna Alksne about this week's first criminal jury trial since all jury trials were halted in March.“We summoned 800 jurors and about 250 or so postponed their service like we told them to do if they felt uncomfortable or had a conflict or co-morbidity or something like that and of the remaining jurors we called in, only 41 showed,” she told ABC10 News and added, “The system doesn't work without jurors.” She went on to say, “I can only anecdotally think that people are unsure of public transportation or coming back Downtown to serve.”Wednesday marked the second day of the trial which was for an elder abuse case.Judge Alksne said that the courts have sufficient safety measures in place for jurors. “When they went back into the courtroom, they had these plexiglass barriers in between them if they're more than six feet apart and everyone wore masks and there was hand sanitizer everywhere. It's as safe as going to Costco,” she told ABC10 News.The courts have maintained that the only way to address the backlog of cases is with cooperation from San Diegans who are called for duty. She added, “What I [asked] the jurors yesterday was if you had a loved one who was incarcerated [and] pending trial and nobody showed up to do jury trial, how would they ever get their chance for their day in court?”Judge Alksne said that another trial is scheduled for next week and two are scheduled for the following week. The numbers of summonses will continue to increase. She explained that there's no plan to penalize people who do not appear for jury duty but that could change if turnout continues to be low. 1721

SAN DIEGO (KGTV) — Philadelphia Eagles running back Darren Sproles has announced he will retire from football at the end of the 2019 season, the Eagles announced Saturday.Sproles spent 15 years in the NFL, racking up 3,552 career rushing yards, 4,840 receiving yards, and 55 total touchdowns. He was a three-time Pro Bowl running back and spend six seasons in San Diego with the Chargers before heading to the New Orleans Saints and lastly Philadelphia.The 36-year-old Sproles told reporters he's at peace with his decision to retire. I could feel it. You made my time here special," Sproles wrote on the team's website. "I remember when I was first traded to the Eagles. Playing at our stadium is like playing in front of your family."With the Eagles, Sproles put together his three Pro Bowl seasons in 2014, 2015, and 2016. During his six seasons with the team he would rush for 1,331 yards and find another 1,459 yards receiving.His five seasons with the Chargers saw just as much production, with 1,154 rushing yards and 1,400 receiving yards and a healthy 4.6 yards per carry average.Looking back at his time with the Chargers, Sproles thanked the team for giving him a chance to play in 2005."Looking back on my career, I think about the time I stood on the stage inside the RCA Dome getting measured for coaches and scouts at the 2005 NFL Scouting Combine. When my height and weight were announced, I could hear laughing from the audience," Sproles wrote. "I've always been short, it's not the first time I've been made fun of for it, but I started worrying that I might not get picked because of my size. I just needed one team to take a chance on me and I'm thankful for the Chargers." 2163

SAN DIEGO (KGTV) -- One person was shot in San Diego's Shelltown neighborhood Sunday afternoon, San Diego Police confirm.According to San Diego Police, the shooting happened just after noon at the La Michoacana grocery store located at 1702 Vesta Street. The suspect, a man in his 20s, pulled out a handgun and demanded money from the cash register.The owner, a 40-year-old man, opened the register and gave the man money, police said. The suspect went to a second cash register and demanded money. The employee opened the second register and gave the suspect money.As the suspect was turning to leave, the owner pulled out a handgun. The suspect turned to the owner and the owner shot the suspect twice, hitting him in the abdomen and in the wrist, police say.The suspect was taken to a nearby hospital, but police said his injuries do not appear to be life-threatening. 879

  

SAN DIEGO (KGTV) -- Police are searching for a suspect Tuesday they say threatened a woman with a gun in an hotel bathroom. According to police, the incident happened in a bathroom at the Hilton on the 4200 block of Taylor Street in Old Town.Police say the man threatened the woman with a semi-automatic gun.Initially a man who matched that description was detained after a short foot chase. Police say he ran for unknown reasons but was quickly released when they determined he was not the attacker.Authorities describe the suspect as a black man in his mid-20s who is five feet, eight inches tall, was wearing a gray shirt, tan pants, a light colored backpack and has short hair.The suspect is wanted for brandishing a weapon, battery and assault with the attempt to commit a sexual offense. 806

  

SAN DIEGO (KGTV) - Monday afternoon, the San Diego County Sheriff’s Department tweeted that convicted sex offender Cary Jay Smith has left San Diego County. The tweet added, “It is always our goal to keep our communities safe.”Smith had been staying at a motel around the 78 corridor which caused concern for North County community leaders. “I just don't feel good about this situation,” said Melanie Burkholder, candidate for CA State Assembly's 76th District. “This is a very sick individual. He does not need to be roaming the streets,” she said Monday morning.The Orange County District Attorney's Office says Smith claims to have killed three boys and molested 200 others.San Diego County Undersheriff Mike Barnett spoke to ABC10 News on Sunday night. “He liked to be referred to while he was in the state mental hospital as Mr. RTK, which is rape, torture, kill,” he said.It was last Tuesday when he said the CA Department of State Hospitals released Smith from Coalinga psychiatric facility without any restrictions under Megan's law, meaning he is not required to register as a sex offender.Deputies say he's served his time and is free to go where he wants.Before arriving in San Diego, the 59-year-old went to Orange, Corona and Lake Elsinore which sparked outrage in Los Angeles. In an effort to avoid any violence, San Diego deputies did not share his exact location but offered reassurance he was under 24-7 monitoring.The Orange County District Attorney's Office said Monday that its waiting for answers from the Governor’s Office as to why the state released him from the hospital and why the CA Attorney General's Office reportedly revoked his sex offender registration requirement in 2005.Monday, the Attorney General's Office referred ABC10 News to the Department of State Hospitals which said that it couldn't release information because of patient privacy laws. 1889
