SAN DIEGO (KGTV) — Lime can still operate its dockless scooters and bikes in San Diego, after the city's petition to revoke the company's permit was denied.Tuesday, a hearing officer reportedly refused the city's petition to revoke Lime's Shared Mobility Device (SMD) permit. The city argued that Lime violated municipal code on several occasions.“Lime is pleased with today’s decision and we appreciate the hearing officer for recognizing our compliance in San Diego. As San Diego’s longest serving operator, we value our partnership with the City and look forward to continuing to serve the community," Lime said in a statement.RELATED: City Council committee OKs changes to dockless scooter, bike lawIn August, Lime was made aware of the city's intent to revoke their SMD permit after they said the company failed to address speeding violations within the city's geofenced areas. A letter to Lime from the city's Development Services Department claimed the company had violated San Diego Municipal Code on July 13, July 14, and Aug 1.Dockless scooters and bikes are required to have a 8 mph speed restriction in high-traffic areas areas like Spanish landing and near Petco park, and as low as 3 mph along the Embarcadero and the Martin Luther King Jr. Promenade."The Mayor has made it abundantly clear that operators who don’t follow rules meant to protect public safety could lose their permit and no longer do business in San Diego anymore. That’s exactly what is being done in this case," a statement from the city said.Lime argued that they were in fact in compliance, adding at the time "it is unfortunate they have chosen to move forward with this hearing" and offering to demonstrate their compliance to the city in a letter from Lime to Mayor Kevin Faulconer.After approving an initial package of rules in April, the city council is set to consider adding new regulations on dockless scooters and bicycles, including:A rider curfew from midnight to 5 a.m.;Usage of one device per government ID;A fine structure and punitive actions for companies that violate regulations;Eliminating the original ordinance's provision that allows for temporary fleet spikes during large events;Authorizing the city to reduce a company's fleet size if it poses a public safety hazard;Authorizing the city to suspend a company outright for multiple violations; andRequiring the eventual use of geofencing technology to keep riders from traversing the city's sidewalks. 2468

SAN DIEGO (KGTV) — Jalen McDaniels, San Diego State University basketball's sophomore forward, was accused of filming consensual sex acts with a classmate in 2016 without her knowledge and sharing it with friends, according to a civil lawsuit filed Wednesday in Washington.The civil suit alleges McDaniels recorded the intimate moments with an 18-year-old female student while they were both seniors at Federal Way High School near Tacoma, Wash.The lawsuit goes on to say while McDaniels later told the plaintiff about the unauthorized recordings and that he had shared it with his friends, she learned from other students that the video became widely circulated. When she confronted McDaniels, he explained he had gotten away with a similar incident involving another female student, according to the lawsuit.The plaintiff's attorney, Joan Mell, who filed the suit, wrote her client has suffered from several self-destructive behaviors as a result, including attempting suicide.SDSU is accused of wrongdoing in the lawsuit as well.Mell alleges in the lawsuit that SDSU was contacted by Washington police to provide them with McDaniels' phone number, but failed to do so. The suit says SDSU, instead, alerted former basketball coach Steve Fisher, who secured McDaniels a lawyer, and McDaniels refused to cooperate.The suit goes on to allege McDaniels' refusal to cooperate and, "that others concealed his wrongdoing prevented prompt criminal investigation and referral to the prosecutor's office for timely filing of criminal charges under Washington’s criminal offense of distribution of intimate images."In a statement, SDSU said there would be "no change in [McDaniels'] status at the university" at this time, after an investigation by Washington authorities resulted in no charges before McDaniels' enrollment at the school: 1837

Customers are flocking to buy ammunition before a new California gun law goes into effect. It’s called the “1 million round month.” Just a few hours after opening its doors, Poway Weapons and Gear Range sold half of their 1.2 million rounds of ammo. “Today is a direct reflection of the law,” says Danielle Rudolph, Director of Sales at Poway Weapons and Gear Range. “People are trying to stock up and save up now that way they don’t have to worry about it next year.” The new law starting in July says in addition to a gun permit, gun owners will have to pass another background check to buy ammunition. Retailers will then have to log the amount of ammo gun owners purchase in a database. The records will be sent to the Department of Justice. When asked about the store’s large sale, Ron Marcus with the Brady Campaign to Prevent Gun Violence said in part: “The bottom line is regardless of how people try to prepare themselves before the law goes into effect, majority of Californians voted on Prop. 63 that put these laws into effect."Store owners say they will order more ammunition for customers to purchase at a reduced price.
