Alondra Selena Marquez, 22, of San Diego, faces up to 13 years and four months in prison, with sentencing slated for Sept. 24 at the downtown San Diego courthouse. Prosecutors say Marquez had a .25 percent blood alcohol content -- more than three times the legal limit -- at the time of the March 23 crash that killed San Francisco resident Giao Pham. The other passenger -- Pham's friend, Andy Lynn -- was hospitalized with a traumatic brain injury, which still affects him to this day, the prosecutor said. SAN DIEGO (CNS) - A 27-year-old man is recovering Sunday after being shot in the back in the Mountain View area , police said.A verbal argument between two groups Saturday in the 200 block of Southlook Avenue, which started just before 9 p.m., escalated into a violent encounter, according to Officer Robert Heims of the San Diego Police Department."During the fight someone fired multiple shots into the crowd," he said. SAN DIEGO (AP) — Combat veterans from the Navy and Marines were among possible jurors Monday in the trial of a decorated Navy SEAL charged with killing an Islamic State prisoner in his care in Iraq.All but one of the potential jurors in the court-martial of Special Operations Chief Edward Gallagher had served in a combat zone and all but two were veterans of conflicts in Afghanistan and Iraq.The trial of Gallagher follows months of turmoil in one of the Navy's most prominent war crimes cases.The lead prosecutor was removed from the case earlier this month for tracking the defense team's emails and President Donald Trump has suggested he may pardon Gallagher.Gallagher has pleaded not guilty to premeditated murder in the killing of the prisoner in his care and attempted murder in the shootings of two civilians in Iraq in 2017. Gallagher says disgruntled platoon mates fabricated the allegations because they didn't like his tough leadership.The seven Marines and five sailors were seated in the jury box, given copies of the charges and asked a series of questions about the case.Each said they thought it possible that Navy SEALs could lie and that they could turn in a comrade on false allegations.They also said they could convict someone in the killing of a member of the Islamic State and in the case where no body was recovered. SAN DIEGO (AP) — The number of people expressing fear of returning to their home countries when stopped at the U.S. border with Mexico has spiked, according to figures released Monday by U.S. Customs and Border Protection.U.S. border authorities fielded 92,959 "credible fear" claims — the initial step toward asylum — in the fiscal year that ended Sept. 30, up 67 percent from 55,584 the previous year. The "credible fear" claims accounted for 18 percent of all people arrested or stopped at the Mexican border in the latest period, up from 13 percent a year earlier.CBP publicly released the numbers for the first time as more migrants, many of them families and children from Mexico and Central America, seek asylum or other forms of humanitarian protection to gain entry to the U.S. The trend was highlighted by a caravan of more than 6,000 migrants, largely from Honduras, that arrived in Tijuana, Mexico, last month, many hoping to seek asylum across the border in San Diego.Commissioner Kevin McAleenan noted that most asylum claims are ultimately unsuccessful in immigration court and he renewed the Trump administration's call for Congress to address "these vulnerabilities in our immigration system." Judges granted asylum in 21 percent of their cases in the 2018 fiscal year."These numbers reflect a dramatic increase in initial fear claims by those encountered on the border, which is straining border security, immigration enforcement and courts, and other federal resources," McAleenan said.CBP didn't say how many people it stopped passed the initial screening, or "credible fear" interview, but historically about three in four clear the hurdle.
