SAN DIEGO (KGTV) -- A San Diego county father is speaking out about his family's close call caught on video during an off-road race down in Baja, but the driver behind the wheel says it's not what it looks like. Earlier in April, Matt Scarpuzzi of Alpine and hundreds of other drivers were participating in the "San Felipe 250" when he says another driver deliberately drove through a group of spectators, including his wife and two young children. In this type of racing drivers can deviate from the set course as long as they make it to the checkpoints, so technically it wasn't against the rules."I couldn't believe that was the best decision, in my opinion, it jeopardizes the fan safety and it jeopardizes a sport that I love," said Scarpuzzi.The man behind the wheel, B-J Baldwin, spoke to 10News and said it looks worse than it actually was.  "I had 100 percent visibility, I knew where everybody was at, knew everybody was safe. Again I was only going about 2 miles an hour when I drove through these tents," Baldwin said. He posted the video on his Facebook page and offered to replace anything he damaged. "I assured everybody that no one was in danger and I was very very careful when trying to re-enter the course and access the course," said Baldwin.  1317

SAN DIEGO (KGTV) - A pair of recent cyber-attacks on Southern California school districts has shown a new front in the war against computer criminals. Hackers have started to target schools and school districts for ransomware attacks."What they're looking for, ultimately, is money," says Kierk Sanderlin, the Head of Engineering for Check Point, a cyber-security firm.Sanderlin says the hackers will spend months using malware and fishing campaigns to gain access to computer systems. Then, when the time is right, they'll launch the ransomware attack, shutting down the system and demanding a ransom to restore access."They want to impact the environment in such a negative way, at such a critical time, that you will be willing to pay," says Sanderlin.Over the weekend, the San Bernardino School District had its servers shut down by a ransomware attack. And in August, San Dieguito Schools lost the ability for parents to register their students for classes because of an attack.Sanderlin says there have been 50 similar attacks on schools throughout the country in 2019.Sanderlin says the criminals typically want to make money from the ransom. But, he warns they can also use their access to the systems to steal the personal information of students, teachers and families.If they do that, Sanderlin says they can sell the information on the dark web, making people vulnerable to identity theft."All of that intellectual property, identification for student records, social security numbers, anything they can mine and sell on the dark web, they're going to do that," he says.School districts have become easy targets because many of them don't upgrade their cyber security frequently enough. Sanderlin compares it to fighting a modern war with antique weapons."We have to start treating cyber-security as something that's far more important than we have in the past," he says. "We can't be an ostrich sticking our head in the ground anymore. We have to realize this is important and do it the right way."He says parents need to become advocates for better cyber security, urging districts to invest in upgrades to protect their networks. He also advises people to use dark-web monitoring services. Those regularly scan the dark web to see if your personal information is for sale.Both San Bernardino and San Dieguito say their students' information was not stolen in the recent attacks. They're working with police to investigate the issue. 2455

SAN DIEGO (KGTV) — A popular North Park concert venue has agreed to pay ,000 worth of fines and reimburse the City of San Diego ,000 in police investigation costs.The operators of Observatory North Park agreed to pay the penalties after City Attorney Mara Elliott filed a complaint against the venue on July 3. The complaint alleged the venue's operators were maintaining a public nuisance and operating without required permits. The city attorney's office added that the Observatory has become a source of local complaints for, "noise, violence, teenage drinking, public intoxication, public vomiting, and the accumulation of trash, debris, and human waste."“The Observatory has long dragged its heels on correcting violations that would protect the safety of its patrons and North Park community residents,” Elliott said in a release. “Its managers have agreed to begin following the law, and if they don’t, our Office will be there to hold them accountable.”The building also includes West Coast Tavern next door, which shares restrooms and bar areas with the theater.Between January 2015 and May 2019, San Diego Police received 174 calls to the venue, leading to 500 hours of overtime, the office said.The operators of the North Park venue agreed to address criminal activity and nuisance complaints and obtain all required permits. The venue's mezzanine and balcony will also remain closed until building permits and code violations are addressed. If the Observatory fails to comply with the terms of the agreement with the city, another 0,000 in fines will be issued, the office said.The lawsuit is the latest issue in the city's battle with the venue. SAN DIEGO (KGTV) - A judge declared a mistrial Monday in the retrial of an undocumented immigrant accused of being the driver in a San Ysidro, California hit-and-run crash which seriously injured a young boy.Constantino Banda Acosta was charged with the crash  on May 6, 2017.Investigators said Banda ran a stop sign and crashed his pickup truck into the Lake family’s Honda Accord.6-year-old Lennox Lake was in a child safety seat at the back of the car. He suffered serious head injuries.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.During Banda's first trial, his passenger, Jorge Adame Ariza, also an undocumented immigrant from Mexico, testified under a grant of immunity during the defendant's two-day preliminary hearing in June that he and Banda had a number of beers that night before the accident.Adame said Banda got into a fight with another man outside a Chula Vista restaurant. Adame told them he picked up Banda but later moved into the passenger seat with Banda behind the wheel during the crash.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152 percent -- the legal limit is .08 -- during two breathalyzer tests.Federal immigration officials said Banda has been deported from the United States at least 15 times over the past 15 years, most recently on January 18.A judge will decide Friday whether a third trial will take place. 1544

  

SAN DIEGO (KGTV) – A man was taken into custody after he was seen damaging the lobby at the San Diego Police Department’s downtown headquarters.At around 5:30 a.m. Friday, an SDPD officer heard noise coming from inside of the building on 1401 Broadway and saw a man trashing the lobby.Other officers responded, and as they surrounded the lobby from the outside and inside, the man used a large stick or bat to smash glass doors.After some glass broke, officers converged and ordered him to drop the object.Officers deployed less-lethal rounds towards the man and struck him. Once he was on the ground, officers arrested him.Police are reviewing surveillance footage to determine where the man came from and how he ended up inside the building. 751
