SAN DIEGO (KGTV) - The coronavirus pandemic, combined with a recently enacted state law, has created a new problem along San Diego's streets and boardwalks.Business owners say they're being overrun by vendors who set up makeshift stores and crowd sidewalks and walkways, while also luring customers out of long-established businesses."It's pretty much a free-for-all," says David McDaniel, the owner of Paradise Cove near Crystal Pier. "Anybody can sell anything, anywhere."He's partially correct. A new state law, Senate Bill 946, went into effect in 2018. Passed by the legislature and signed by Gov. Jerry Brown, it decriminalizes street vending, telling cities that they can create their own guidelines and can only enforce them with tickets for vendors who violate the rules, instead of criminal charges.Several cities in San Diego County, including Carlsbad and Vista, were quick to establish their regulations. San Diego still hasn't.As more vendors set up shop, the Pacific Beach Town Council is asking city leaders to move the process along."We're calling on city leaders to end the swap meet on our boardwalks now," says Brian White, the President of the Pacific Beach Town Council. "We have lots of pedestrian traffic, bicycles, skateboards. There really is no room for this type of vending activity."Earlier this month, the Town Council sent a letter to Mayor Kevin Faulconer and the City Council asking for specific rules.The San Diego City Council started to establish new rules for vendors in 2019. Faulconer sent a draft ordinance to the Economic Development Committee.It would have prohibited vendors on the boardwalk and other high traffic areas. It also would require business permits, set hours for vending, establish distances from public facilities, require vendors to follow health and safety rules, and several other rules.That ordinance passed the committee unanimously on July 25, 2019.The city then held three public forums about it in October. But it never went to the full council for approval."It is an issue that's becoming a real problem. We definitely need to get some regulations going with this," says City Councilmember Jennifer Campbell, who represents Pacific Beach and Mission Beach."It's really up to the mayor's office to bring us these recommendations to City Council," says Campbell.ABC 10News reached out to Faulconer to see why there has been a delay in moving the draft ordinance forward. SAN DIEGO (KGTV) - The Climate Prediction Center released the final El Ni?o advisory for 2019, which means El Ni?o is over and now we are in a neutral phase with a 55 percent chance of continuing into winter.So what does that mean for the rest of summer and, most importantly, San Diego's winter? In order to put this in perspective, let’s review what this seasonal change means.San Diegans typically associate El Ni?o with a wet winter, or more rain and a better water supply. However, El Ni?o is more than that.The National Weather Service defines El Ni?o as a recurring climate pattern involving changes in the central and eastern tropical Pacific Ocean. Warm and cool changes are associated with the ENSO cycle. El Ni?o and La Ni?a are extreme phases of the ENSO cycle, but there is a third phase, less well known, called the ENSO neutral. That third phase is where San Diego is headed for the rest of the year and possibly through the winter months. El Ni?o and La Ni?a have a greater impact during the winter months. La Ni?a doesn’t do much for winters in California; it typically keeps San Diego dry and warm. The opposite happens during El Ni?o, which explains why it’s so much more popular. El Ni?o brings an active Jet and more frequent storms, reducing our drought and helping our water supply, with cold driven storms and snow for the Sierra Nevada mountains. The neutral phase is where San Diego is headed this fall with a 55 percent chance of it sticking around through the winter. The ENSO neutral phase is neither cold like La Ni?a nor warm like El Ni?o. The ENSO neutral phase is associated with sea surface temperatures closer to average, and stronger winds near the equator. It typically keeps the coldest air over the Northeast, warmer temperatures through the southern portion of the country, and wetter through the Midwest and Northeast.The ENSO Neutral typically keeps San Diego warm and dry. The extended forecast calls for above-normal temperatures for the remainder of the summer and near normal rain, which means dry since we are usually dry during those months.The winter outlook also brings near to slightly above normal temperatures. Rainfall will average near normal. San Diego's rainy season begins in November and lasts through March, sometimes lasting through April. SAN DIEGO (KGTV) - The final panel of a 14-mile stretch of the Primary Border Wall project was installed Friday, marking a turning point for U.S. Border Patrol, according to Border Patrol officials.Now there is more updated fencing in place compared to aging infrastructure. The stretch of new fencing replaced stamped steel, that's easy to climb, originally installed in the 1990's.The 18-30-foot steel bollard stretches a quarter of a mile from the ocean, to Otay Mountain. The old wall was breached more than 1,700 times, according to Border Patrol officials.RELATED: Funds earmarked for defense can be used for border wall, Supreme Court rules"Any upgrade we can get we'll take, this wall's been around for 30 years," Border Patrol Public Affairs Officer Theron Francisco said.The transparent feature of the new wall, vital for Border Patrol agents. Fiscal year to date, 149 incidents were reported, compared to 72 last year.Last April migrants hurled rocks at San Diego Border Patrol officers, shattering their Jeep's window. With that, it means less agents have to field a certain area," Francisco said. He said that means an area with seven agents could go down to two or three.As for who paid for the wall, each Border Patrol agent said the Trump administration. "So this would be Trump's wall, it was financed in fiscal year 2017, so it's starting under his administration and will wrap up under his administration," Francisco said.Border patrol is working on two other projects, one in Tecate that's a four mile primary fence and another that's stretches from the ocean to Otay Mountain as a secondary wall. SAN DIEGO (KGTV) -- The Del Mar Thoroughbred Club has canceled its racing program this weekend, July 17-19. The cancellation follows 15 jockeys recently testing positive for COVID-19. Racing is slated to resume July 24."Assuming these individuals continue to show no symptoms, they will be isolated for a total of 10 days and should be able to resume their usual activities, including riding after that time,” said Dr. Eric McDonald, Medical Director, Epidemiology & Immunizations Services, County of San Diego.Racing at the track is set to return on July 24.The 15 jockeys who tested positive are believed to be asymptomatic, officials said. “Contact tracing procedures are underway in conjunction with the San Diego Health & Human Services Agency. However, a common factor among all but one of the riders that tested positive is that they rode at the recently concluded Los Alamitos meet.”The track ordered testing of all jockeys after two riders, Flavien Prat and Victor Espinoza, tested positive for COVID-19.Espinoza, who rode American Pharaoh to horse racing’s Triple Crown in 2015, spoke about his coronavirus diagnosis earlier this week on “The Winner’s Circle” podcast.Espinoza told podcast host Bram Weinstein that he took a COVID-19 test on July 7 and did not go to Del Mar’s opening weekend because he did not receive his results until July 10.The famed jockey described his symptoms as body aches and join pain, but he did not have a cough, fever or shortness of breath."It's different from a cold. Tuesday at 5 o'clock, it hit me hard for two hours. The next day I wake up normal like nothing happened. I feel fine ... The following day, my body starts hurting, every joint in my body, especially my legs, every joint from my hip to my ankles. I've been so careful to take care of myself, and it was one of those little things; you let your guard down, I went to Los Alamitos and that was it.”"Honestly, I can speak from my experience, I don't wish nobody to have this disease.
