SAN DIEGO (KGTV) - Restaurants are feeling backed into a corner after the pandemic forced them to add outdoor seating and Saturday brought cold rain and high winds. As the clouds rolled in, businesses across San Diego braced for impact."We were planning on covering everything up but we were kind of waiting and seeing just how big the storm was going to be," Whiskey Girl Manager Jake Southworth said.In the Gaslamp, he says they've been lucky this weekend, "We were ready to go with more of the tarps, to put out but waited till midnight when we were closed anyway, so definitely dodged a bullet there and today again it looks like it's going to hold off until later so I feel like we're still going to be doing good."Whiskey Girl is on a section of Fifth Avenue that shuts down to vehicle traffic Thursday through Saturday, allowing restaurants to spill into the street and seat more customers. The extra chairs help them stay afloat, but outside the rain and future winter weather are putting a damper on their options. Some businesses put up pop-up shades and umbrellas to provide some shelter against the weather."I mean it does open a lot more seating having outside but we'll see what the weather sends us," Southworth said.Every restaurant is also holding its breath, waiting to see if the county drops into the purple most restrictive tier next week, which would mean no indoor dining at all."How can I ask someone to spend, you know - on a drink if they're sitting outside shivering and the rain's coming through?" Tipsy Crow Director of Operations Nathan Colonero said they would have to close down and let go of their staff. The threat of the purple tier has been hanging over San Diegan's heads for a month and a half. Many businesses are frustrated with the roller coaster of changes, and hopeful a new president will mean changes that will help them through. 1885

Those counties represent nearly 95 percent of the state’s population.Prior to Monday, only 13 counties were in the purple tier.See the full list of orders below:Cease & Desist Danny's BarCease & Desist Meat Monsters GrillCease & Desist Fit Athletic Club Ash StCease & Desist Fit Athletic Club Ocean Front WalkCease & Desist Fit Athletic Club Solana BeachCease & Desist Fit Athletic Club Tenth AveCease & Desist Fit Athletic Club World Trade DrCease & Desist Reach YogaCease & Desist Self Made Training FacilityCease & Desist Shelter Bar EncinitasCease & Desist Shock FitnessCease & Desist The LandingCease & Desist Yoga Box HillcrestCease & Desist Yoga Box North ParkCease & Desist Yoga Box Ocean BeachCease & Desist Yoga Box Pacific BeachCease & Desist Awaken Church CarlsbadCity News Service contributed to this report. 1420

SAN DIEGO (KGTV) - Raw emotion filled a San Diego courtroom Tuesday as the friends and family members of those killed and injured in a crash faced the drunk driver responsible at her sentencing. Thirteen people flew in from San Francisco to speak during victim impact statements. The most powerful words came from Giao Pham's life partner, John Lawhead. Pham was killed in the March 23rd crash."We were together for eleven years, until your actions that night took my partner, my world, my everything. You still don't have any remorse in your heart, you're a very shallow, person aren't you!?" At one point, the defendant, Alondra Marquez, interrupted, saying "You don't know me," Lawhead shouted back, " I don't care to know you, the only reason I know you is because you murdered my partner!" Marquez, 22, rear-ended a Lyft car on Highway 163 in Balboa Park, killing Pham and leaving his friend, Andy Lynn with a traumatic brain injury. Prosecutors said Marquez had a blood alcohol level more than three times the legal limit and was driving more than 100 miles an hour. In a bizarre coincidence, Marquez and the two victims were at the same Hillcrest bar the night of the crash. While Pham and Lynn chose to hire a Lyft, Marquez chose to drive, even though several people offered to give her a ride. "You had five chances not to drive your car, you chose to drive, at your fastest speed of 109 miles an hour, but that wasn't fast enough or good enough for you," shouted Lawhead Pham and Lynn were visiting from San Francisco for a wedding. The impact sent the car flying into a ravine. The Lyft driver suffered minor injuries. " The last place that I seen him go in the ground is where I find comfort, this is what I see when I go to see him now, do you understand your actions now?!" Marquez showed no emotion and read from a prepared statement. She said she doesn't remember anything about the night. "Physically, it's my fault, but spiritually and emotionally, I don't know where I was, but I wasn't there," she said from behind the glass. Lawhead told her she is the first person he truly hates. " I never thought I could truly hate someone. I hate your heart. I hate your soul. I hate your being, your spirit, I hate all of you." Marquez said she isn't a bad person. " Just know that I am not a bad or evil girl, my brain is processing this. It's a hard pill to swallow." Marquez asked for forgiveness. "I'm real sorry. I can't do nothing about it, but I'm locked up if that makes you guys feel better."She pleaded guilty and faces a maximum sentence of 13 years, four months in prison when the judge announces her sentence next week. 2794

SAN DIEGO (KGTV) -- Residents wanting to take a hot shower at a La Jolla apartment complex could have to wait several days while crews work to repair a gas leak. The leak shut off hot water to three apartment buildings. Neighbors say they got a series of emails Saturday, one of them saying they wouldn’t have hot water for five to seven days. Residents say the issue is unacceptable. "I'm not getting in there, it's way too cold,” said Nick Imison. An email from his leasing company informed Imison he would be without hot water for about a week. Imison lives in the Regents La Jolla apartment complex. The email went on to say that their gas supply was shut off after crews found a gas leak. In the email, residents were told that if they need a shower during business hours, they need to stop by the office with an ID. “I was completely unacceptable for a complex that has about 600 units to just go hey yea you can come shower bring your id but it's only between the hours of nine and six,” Imison said. 10News reached out to the leasing company via email but have not heard back. In the email sent to residents, the company cites the need for several city and SDG&E required inspections before they can turn the gas back on. 1242
