SAN DIEGO (KGTV) -- A San Diego man convicted of murder will be a free man, decades before his scheduled release.Donnell Fulcher’s conviction for a Barrio Logan murder in 2006 was overturned due to changes in DNA standards, said Deputy District Attorney Hector Jimenez.On Tuesday, Fulcher pleaded guilty to voluntary manslaughter and assault with a firearm rather than go through a third trial. The judge sentenced Fulcher to 14 years, but he received credit for time he already served.Because of that, Fulcher will be released from custody tonight or tomorrow. This result comes after the San Diego County District Attorney’s Conviction Review Unit took a second look at cases involving DNA mixtures, meaning more than one DNA source is found in a sample. Fulcher’s case relied heavily on this type of evidence.The top forensic science group that analyzes DNA released guidelines that are now more conservative, which affected Fulcher’s case. Earlier this year, the District Attorney’s office agreed to give Fulcher a new trial.“We still believe that we have the right guy, but we lost confidence in the conviction so we wanted to give the defendant a chance to have a new trial if he wanted. He chose to plead guilty instead, so at the end of the day, I believe justice was done,” Jimenez said. Fulcher has always maintained his innocence.“I don’t think you can put any limit on the happiness that going free can have for someone who’s serving a life sentence. He is very, very happy. His family is very happy. This is really a joyous moment for all of them,” said Fulcher’s defense attorney Knut Johnson.This would have been Fulcher’s third trial. SAN DIEGO (KGTV) - A patient at a North Park dental office got upset after she got hit with surprise fee.Two Thursdays ago, Linda Morrow - donning a mask and gloves - went to Pristine Dental Group for a root canal and bone grafting. After the procedure, Morrow, who doesn't have dental insurance, paid cash for the bill. It was in line with the estimate."The total bill was 0. I didn't have change, so I gave them 0 because I only had bills," said Morrow.Morrow says when no one in the office could make change, the receptionist spoke up."She commented, 'Oh, PPE.'" said Morrow.Morrow says her new bill was for 0 dollars, including a charge for personal protective equipment used by the dental staff."That shut my mouth. I was stunned," said Morrow.Confused, Morrow paid the full amount and left."My concept was that it was definitely an afterthought. SAN DIEGO (KGTV) - A researcher at the San Diego Museum of Natural History helped identify a new species of dinosaur, which was just added to the Anatomical Record.Dr. Ashley Poust made the discovery 10 years ago while on a research trip to China."There were a couple of features that immediately stood out to me, made me thing maybe we have something new here," he says.Dr. Poust says the shape of the skull and the presence of two long, decorative tail feathers made him think this was a new species."There's not any other dinosaurs that aren't birds, that we know of, who have long feathers like that," he says.Dr. Poust named the dinosaur "Wulong Bohaiensis." The word Wulong means "Dancing Dragon" in Chinese. The other part of the name comes from the area where it was found.A find like this helps fill in the gaps in how dinosaurs and birds evolved differently. Dr. Poust says Wulong was only about 1 year old when it died. That means it grew those long feathers much earlier than birds typically do. He thinks they could be functional, or it shows a major difference between dinosaurs and birds."You can't really answer those questions in California, but you can answer those questions in a place like China," says Dr. Poust.According to a release, the dinosaur was an early relative of the Velociraptor. It lived 120 million years ago and would have been about the size of a crow or raven.Dr. Poust says he's excited to share the new species with the world. The skeleton is on display at the Dalian Museum in China. It likely will not come to San Diego, as the specimen is too delicate for such a long journey. 1628

SAN DIEGO (KGTV) — A Pacific Beach gym ordered to close for not adhering to the county's health orders and linked to one community outbreak has reopened.The Gym was forced to close on July 23 for violating public health orders after "the owners/operators of the Gym have acknowledged that they are aware of the Public Health Orders but will not voluntarily comply," according to a copy of the county order. A week after the county ordered the gym to close, a community outbreak was traced back to the fitness center, according to health officials.The county confirmed on Sunday that the gym has been allowed to reopen after altering their facility to be in compliance with health orders requiring that gyms move workouts outdoors. San Diego (KGTV) - A San Diego man claims San Diego County Sheriff deputies roughed him up in jail and the incident was caught on camera.He’s calling the deputies' actions an abuse of power.“I’m actually pissed,” said Joshua Strode. “I’m actually very angry.”San Diego State University police arrested Strode back in June for being drunk in public, something he denies.Strode was taken to San Diego Central Jail.
