A lawsuit has been filed against the County of San Diego and the former Assistant Sheriff for sexual harassment and retaliation.The employee began working for the Sheriff’s Department in 2010 at the Vista Detention Facility, according to the lawsuit.Team 10 is not naming her because she said she is a victim of sexual harassment. The female employee claimed that Miller made “inappropriate sexual innuendo” to her, including tickling her hand.She stated in her lawsuit that she confided in two Commanders about Miller’s behavior, but did not raise a formal complaint because she feared retaliation.She applied for a new job within the department with Law Enforcement Services Bureau Administrative Secretary II “in order to avoid Defendant Miller and his continued harassment.”She was not granted the transfer. She alleged “Miller demoted her in retaliation for her rejection of his sexual advances and efforts to avoid further harassment by him.”Team 10 contacted the Sheriff’s Department late Monday. A spokesperson said Miller is no longer with the department, since he retired.She added they cannot comment on pending lawsuits. Team 10 is still waiting to hear back from a county spokesperson.The woman suing the County of San Diego and Miller also believed that “the county had received and/or was aware of several complaints from other employees about inappropriate sexual behavior of the Assistant Sheriff.”The lawsuit stated the county took no appropriate action to protect from Miller’s harassment.Team 10 previously contacted Miller when these allegations first arose in February.He told Team 10 investigator Melissa Mecija he could not comment on an ongoing investigation. He also said he “absolutely” denied allegations of inappropriate conduct.In late February, before the lawsuit was filed, a sheriff's spokesperson told Team 10: "Despite the allegations in the claim, the claimant was not demoted. The claimant was assigned to another Sheriff's Department facility, prior to raising a formal complaint, and currently receives the same pay and benefits as she did in her prior assignment." 2664

A group of Las Vegas shooting survivors is coming together to send a very special gift to Jason Aldean. Their goal is to use the gift to ask Aldean to come back to Las Vegas to finish his concert that was tragically interrupted the night of the mass shooting.Tiffany Thomas created a Facebook group called “58 Survivors 1 Last Set." Survivors of the shooting quickly learned about the group and the online community chatted about their stories of that infamous night.“After it happened, all I could think about was Jason Aldean,” said Thomas. “I kept thinking like he was up there, he was on that stage, he was singing for us.”Through the Facebook group, Tiffany met another survivor named Gina McKin. The women came up with the idea to make a Shutterfly book to send to Aldean.McKin took charge of the book and asked everyone to send their favorite pictures of the night before the shooting rang out.The book ended up being 91 pages long to represent Route 91.In the book, McKin dedicated different pages to victims and survivors. Some people wrote messages to Aldean.The 0 book took months to finalize.The group of women are sending the book to Aldean along with a few other special items.They are using the gift to ask Jason Aldean to come back to Las Vegas and finish his set. Their idea is to open the concert up to survivors and victims and families of the victims.“It would just be so bonding and so amazing and so emotional and I think so healing.”Scripps station KTNV in Las Vegas was in touch with Jason Aldean’s communications team about the book.KTNV was told they are excited to see the book but cannot officially comment on if Aldean will be back to perform just yet.The women are putting the package in the mail this week. “I hope that when he opens it, he just sees that we love him and that we know what he’s going through,” McKin said. 1889

A glitch to the IRS' e-file portion of its website prompted the IRS to push back the deadline to file taxes from today (April 17) to tomorrow (April 18). The IRS said that both individuals and businesses can take advantage of the extra filing day without penalty. “This is the busiest tax day of the year, and the IRS apologizes for the inconvenience this system issue caused for taxpayers,” said Acting IRS Commissioner David Kautter. “The IRS appreciates everyone’s patience during this period. The extra time will help taxpayers affected by this situation.”The IRS said that during the system outage, taxpayers were able to file their tax returns electronically through their software providers and Free File.Taxpayers using paper to file and pay their taxes at the deadline were not affected by the system issue, the IRS said. The glitch shuttered part of the IRS' website, not allowing some who file taxes online to complete their taxes. A Brownsville, Texas man has been sentenced to 50 years in prison after stealing and reselling .2 million in fajitas from a juvenile detention center over the span of nine years.Gilberto Escamilla had previously pleaded guilty to felony theft charges.Escamilla was caught last summer after he took a day off work from the Darrel B. Hester Juvenile Detention Center for a doctor's appointment. A driver called the kitchen at the juvenile center saying they had 800 pounds of fajitas to drop off.The center did not serve fajitas, but the driver said he had been delivering the meat to the center for nine years.After the driver spilled the beans, investigators found packages of fajitas in Escamilla's fridge where he reportedly sold the meat to separate buyers.Escamilla was fired from his job in August.The-CNN-Wire 865

A Glendale, Arizona mother is speaking out after her daughter’s class was subject to an odd punishment. Brittany Trofy says her 7-year-old daughter and classmates were forced to walk in a circle on the Luke Elementary School playground last week as punishment. It was around noon that day and temperatures were likely in the high 90’s or even warmer.Trofy claims the march lasted anywhere from 20 to 30 minutes. She says her daughter told her about the punishment when she came home that day.According to Trofy’s daughter, several kids complained of headaches and cramps. "The school stripped me of my right to nurture my child when she didn't feel good by not letting me know she didn't feel good,” Trofy said. The Dysart Unified School District confirmed to KNXV that they are reviewing the teacher’s actions that day. We’re told that the practice is not “district approved.” However, a spokesperson says it only lasted around five minutes. Students were checked by a school nurse and none displayed any signs of heat exhaustion. The Dysart Unified School District would not elaborate if the teacher would be facing punishment or has a history of questionable decision making. A spokesperson told us they cannot discuss personnel matters. "My daughter is right now scared to go back to school for fear of seeing the teacher that got frustrated with them,” Trofy said. A police officer was informed of the incident.
