CINCINNATI -- On Tuesday afternoon, 16-year-old Kyle Jacob Plush called 911 panicking.Over the course of a three-minute call in which he gasped, cried repeatedly for help and struggled to communicate with the operator, he relayed that he was trapped inside his car in the parking lot of Seven Hills School."I probably don't have much time left, so tell my mom I love her if I die," he said. The call ended; when the operator attempted to call back, only a voicemail responded.A deputy sent to the scene called in soon after to report that he couldn't find anyone trapped in a van. He questioned if the call had been a prank.Plush was there. He called again."This is not a joke," he said. "I am trapped inside a gold Honda Odyssey van in the parking lot of Seven Hills. ... Send officers immediately. I'm almost dead."At several points in the second three-minute call, during which the operator does not respond and loud banging or heavy breathing can be heard, he attempts to call on the Siri automated iPhone assistant without success.Around 9 p.m., according to police, a family member discovered him dead inside the van -- a death Hamilton County Coroner Lakshmi Sammarco would rule accidental "asphyxia caused by chest compression."Something -- neither Sammarco nor Lt. Steve Saunders indicated what -- had pressed so hard against Plush's chest that he suffocated.The information released by police Wednesday afternoon did not clarify the reason the first deputy to respond was not able to find Plush's van or where Plush had been inside of it. Plush's uncle, who declined to share his name or speak on camera, said Wednesday night the 911 system failed the "great kid" who had been his nephew.Plush was a student at Seven Hills, spokeswoman Christine Hedges said Wednesday morning. (KGTV) - There were heated moments Wednesday while a group was defending the Christopher Columbus statue at discovery park in Chula Vista.Chula Vista City Councilman John McCann, with members of the Knights of Columbus standing by his side, called for the statue to be left alone."You can't change history," he said. "We should be able to accept all groups, you can't lift one group by destroying another group.""We're here to oppose the removal of the statue," said Rene Trevino, a member of the Knights of Columbus.The statue, which has been in place for nearly three decades, has stirred up controversy in the past.Thursday the city's Human Relations Commission will vote on a resolution to not only remove the statue and change the name of discovery park, but to change Columbus Day to Indigenous People's Day in Chula Vista.Last Columbus Day someone splashed red paint all over the statue, and before that someone plaque set in front of the statue was stolen."It's been a community family park and we've had opponents of Christopher Columbus use violence to vandalize and destroy the park multiple times, costing tax payers," said McCann.Many people have called the meaning behind the statue and the name of the park both painful and offensive.A woman in a car driving by the park Wednesday began shouting, "This is indigenous land, take that statue down!"She went on to say Christopher Columbus was just the beginning of an attempted assassination of Indigenous peoples.The topic caused people to clash at the park."You have these people trying to advocate for an idea that we're sick and tired of living under," said Rafael Bautista, who wants the statue removed.He was then confronted by a man who opposes the removal."What are you living under?" the man asked him. "What are you living under?"At one point Chula Vista Police officers arrived at the park, but things had settled down."Instead of trying to argue over things that happened over 500 years ago, we should be tackling today's issues," said McCann.Raeanne Herrera, a resident of Eastlake and part of the Jicarilla Apache Nation stopped by the park to offer her take."We can right the wrongs that have been done," she said. "That statue is the constant reminder of a beginning of a genocide. They tried, but they didn't."She went on to say change needs to start with education."Native American issues were never taught in school, what was I taught? Oh, that the pilgrims and Indians got together and shared a meal. That's an absolute lie, it was a celebration for a massacre that occurred," she explained.Both groups say they will continue effort to get their way, no matter what City of Chula Vista officials ultimately decide.If Thursday's resolution passes, it will head to the full city council for the final decision. 2818

CHULA VISTA, Calif. (KGTV)- A Hilltop High School alumnus who graduated in 1972 is more grateful for one of her teachers on the anniversary of D-Day. Kathy Cappos Hardy had Mr. Tom Rice as a United States Government teacher her senior year of high school. She tells 10News, “the way he enlivened it and related it to our lives made it truly something important to me”. Cappos Hardy has vivid memories of Rice and even says she pursued her career in education because of his impact he had on her. It wasn’t until about 20 years ago when Cappos Hardy realized her US Government teacher was also one of the thousands of troops who stormed the beaches of Normandy, France during World War II. 97-year-old Tom Rice is from Coronado. He was a paratrooper with the 101st Airborne Division who landed in Normandy on June 6, 1944. On D-Day, Cappos Hardy wrote an editorial thanking her teacher for his service in and out of the classroom. Now, she’s not only hoping he sees it, but that she also gets a chance to tell him thank you when he returns from Normandy. “I hope he knows that there are a lot of us that admire him not only as a teacher but what he did prior to that.” Cappos Hardy tells 10News. 1203

CINCINNATI — Cross-country runner Justin Gallegos is making history. He’s the first athlete with cerebral palsy to sign an endorsement contract with Nike. The University of Oregon junior was given the news last weekend after a college race, and he was visibly touched by achieving his dream of becoming a professional runner. Justin’s parents, Brent and Tracy Gallegos, say they’re proud all Justin has worked to achieve, and were stunned to see him in that moment."I’ve never seen him that emotional ever…..ever," Brent Gallegos said.Justin’s condition affects muscle and motor function, but he didn’t let that stop him."He works very hard for it and when he sets his goals, he sets them very high," Tracy Gallegos said.His story of overcoming obstacles is inspiring others. He was a big topic of conversation among some medical professionals attending a three-day conference for the American Academy of Cerebral Palsy and Developmental Medicine hosted by Cincinnati Children’s Hospital. "To show the world that we really can be successful and contribute in some way to society and that we’re valuable," said Dr. Raffi Najarian, who has cerebral palsy.He hopes stories like Justin’s will inspire others."It’s great to see because it’s something that we have seen, you know, up to this point," Najarian said.As for Justin, he has a message for everyone: "You don’t have to let your disability or physical impairments stop you." 1440
