SAN DIEGO (KGTV) — From the confrontation in a Los Angeles Trader Joe's to a showdown in a San Diego Starbucks, there have been a lot of customers claiming businesses can't legally require them to wear a mask.Some customers even carry a card threatening fines and citing the Americans with Disabilities Act, or ADA. But there are three things to consider before making an ADA claim, according to lawyers.First, to bring a successful ADA lawsuit, attorneys say the person without a mask must truly have a disability. "I would not advise businesses to ask for any type of documentation."If the person says they have a disability, the ADA requires businesses to make reasonable accommodation. There's a third component in the ADA: Subsection 36.208 allows businesses to turn disabled people away if they pose a direct threat to the health and safety of others."Someone not wearing a mask, they might think they're not infected, but they could be and pose a direct threat to spread the virus to many people," Elia said.The Equal Employment Opportunity Commission has said COVID-19 does constitute a direct threat, so our experts say the threat of a successful lawsuit in a case like this is low.That said, there's nothing stopping people from filing these lawsuits. SAN DIEGO (KGTV) -- Derek Swenningsen isn't the typical for trainer for puppies who go to become service animals but right now, volunteers like him are all Tender Loving Canines had. "We're making arrangements and trying to recruit new volunteers to take those puppies until volunteer programs inside prisons can pick back up again," said Victoria Cavaliere with TLC. TLC's 8-week-old puppies started out in prisons where inmates train them before they went to helping those in need. "We teach incarcerated individuals who are in the program how to train dogs to become service dogs using only positive reinforcement."But since COVID-19, they had to switch gears. "We’re looking for someone who is just passionate about the mission and has the time to open up their homes to having a puppy in their home," allowing those like Swenningsen to take their place as trainers."I feel obligated to do my best and make sure Fiji gets the best he can to make it through the program and help a fellow veteran out."Veterans and those who have disabilities or other medical conditions relied on service animals, putting TLC's dogs in demand, even amid a pandemic."To take a dog from a little puppy and mold it into what you want it to be which is this amazing superhero for someone with a disability and help give them independence and get them out of their homes and be part of the world."TLC partnered with Guide Dogs of America and has been in service for 20 years. The county may something a little extra for your wallet.The San Diego County Treasurer-Tax Collector's Office says they currently have 3,000 in unclaimed county refunds waiting to be reunited with their rightful owners.About 1,928 refunds sit on the countywide unclaimed money and unclaimed property tax refunds lists, according to the office. If the county thinks you're owed a refund, you may receive a postcard in the mail, according to San Diego County Treasurer-Tax Collector Dan McAllister.“Most of the time, we’re collecting money from San Diegans,” said McAllister. “We love summer when we can give it back and put a little extra vacation cash in people’s pockets. SAN DIEGO (KGTV) -- Dr. Scott Overcash and the staff at La Mesa-based laboratory eStudySite are preparing for what could be a history-making clinical study."I'm personally really excited about being in the effort to try to prevent people from getting the disease," said Overcash.In just days, Overcash will soon be overseeing a first-of-its-kind trial of a coronavirus vaccine created by the American biotech company Moderna.Starting as early as next week, the first of 350-500 local patients will begin receiving the vaccine.The same one has already been given to patients in phases one and two of the trial.
