SAN DIEGO (CNS) - A 28-year-old man was hospitalized Monday with non- life-threatening wounds to his leg and hand after he was shot by another man in a parking lot near Mission Bay, police said.The shooting happened around 7:10 p.m. Sunday in a parking lot in the 2600 block of Ingraham Street, north of West Mission Bay Drive, San Diego police Sgt. Kevin Gibson said.The 28-year-old man was standing alone in the parking lot when another man approached him and fired five shots, striking the victim in the leg and the hand, Gibson said.The victim was taken to UC San Diego Medical Center for treatment of his injuries, which were not believed to be life-threatening, the sergeant said.No detailed suspect description was immediately available.One person was detained at the scene and later arrested on unrelated charges, Gibson said. Earnest.Police say the 19-year-old nursing student opened fire at Chabad of Poway on April 27 during a Passover service. He has pleaded not guilty to murder and attempted murder charges.Prosecutors have said the gunman fired at least eight rounds before he fumbled with his semiautomatic rifle and fled with 50 unused bullets.The search warrants could help answer questions including whether the suspect got a hunting license to be able to legally purchase the weapon since he is under 21.Lawyers representing the media outlets, including The Associated Press, have argued the documents should have been unsealed 10 days after investigators filed them in court.Other media involved in the request are San Diego outlets NBC 7, KFMB News 8, Fox 5 San Diego, and the San Diego Union-Tribune.Attorney Elizabeth Baldridge, representing the media, said unsealing the documents is important to ensure oversight of the judicial proceedings, especially in high-profile cases such as the synagogue shooting.She wrote in court filings that mass shootings and attacks motivated by religion and race have become common in the U.S., and the "public has a substantial interest in understanding the motivations behind these crimes and obtaining transparency in the process of bringing alleged perpetrators to justice."She added that unsealing the documents will also be "therapeutic" for families and the community. 2088

  

SAN DIEGO — (KGTV) -- The Del Mar Fairgrounds is weighing its legal options after the KAABOO Music announced that it would move to Petco Park in 2020, the venue's CEO told 10News.Fairgrounds chief executive Tim Fennell declined a formal interview, but pointed to language in the Fairgrounds' contract with KAABOO that blocks the festival from holding a similar event within a 75-mile radius the year it cancels the contract. KAABOO announced Sunday it would end its contract with the Fairgrounds for the 2020 concert and move to Petco Park downtown.RELATED: KAABOO under new ownership days after revealing move from Del MarThen this week, KAABOO announced its assets were sold to a new company, an affiliate of Virgin Fest.In a statement, a spokeswoman for KAABOO said the prior contract's terms do not apply."As reported, we acquired only the assets of KAABOO. Accordingly, all liabilities remained with the previous owners, so we are not aware of their obligations," she said. SAN DIEGO (CNS) - A former La Jolla Country Day School teacher pleaded guilty Thursday to having sex with a 17-year-old female student and faces up to one year in local custody.An Oct. 21 sentencing date is scheduled for Jonathan Sammartino, 37, who also could face lifetime sex offender registration and be prohibited from teaching again at any school.San Diego County Superior Court Judge Charles G. Rogers, who took Sammartino's plea to a felony count of unlawful sexual intercourse with a minor, said he was "not inclined" to impose sex offender registration, but still might do so at the sentencing hearing.As part of the plea agreement, felony counts of oral copulation of a minor and digital penetration of a minor were dismissed.Sammartino, the son of U.S. District Judge Janis Sammartino, remains out of custody, pending the sentencing hearing.The victim, identified only as "Jane Doe" in court proceedings, testified earlier this year at Sammartino's preliminary hearing that the first sexual encounter happened in the early part of 2016, when he arrived at her home unannounced around midnight. She said she went outside to meet with him in his car, at which point he told her he didn't trust himself around her.Sexual encounters occurred that night in his car and on several other occasions in his vehicle and his house over the next few months, she testified.The victim, who went on to attend UC Berkeley, filed a report with campus police in the summer of 2018. Charges were filed later that year.In a recorded phone call played during the preliminary hearing, Sammartino admitted to the past encounters with the victim."Why did you do it? You knew I was 17," Doe says on the recording. "You knew I was your student. You knew it was my first time and I lost my virginity to you.""I don't have a good answer, because I wasn't thinking through what I was doing," he replied, apologizing to her several times throughout the call. "I can't believe that I did that."At the preliminary hearing, defense attorney Eugene Iredale unsuccessfully argued to have the charges reduced to misdemeanors, and introduced evidence regarding a 2015 bicycling accident in which Sammartino hit a pothole while riding in La Jolla and landed on his head. Sammartino was hospitalized and had to re-learn some functions before going back to the classroom, according to the defense attorney.Iredale argued that the brain injury affected his emotions and ability to make reasonable judgments, playing "a significant factor" in the commission of the charged acts.Rogers ruled against the defense request in January. Though he said he believed Sammartino had been affected by the injury and was unlikely to re- offend, he stated that the sexual nature of the defendant's relationship with the teen was entirely his idea."She wanted an emotional relationship with Dr. Sammartino. That is abundantly clear, and frankly, I think it's also clear that he wanted and needed an emotional relationship with her. But the sex was not her idea; the sex was his idea," Rogers said. "He was the grown-up and it was his responsibility not to do that." 3129
