While we’re happy with the victory and we’ll certainly take it, there’s a part of me that’s a little disappointed that the public isn’t going to see the evidence brought out at a trial to see that she was never guilty of it in the first place," Smith said.The ruling comes after Friedman also dismissed a "conspiracy to transport minor with intent to engage in criminal sexual activity" charge in January. That was the only count that could have lead to life in prison for both Nagarwala and Dr. Fakhruddin Attar.Friedman's ruling leaves two counts in place in the case. A man shot by a Cuyahoga County, Ohio Sheriff's deputy near Cleveland on I-90 on Thursday has died.The medical examiner identified the man as Brett Luengo, 33, of Westlake, Ohio. He was transported to MetroHealth Medical Center where he was treated, expired and pronounced dead last night. Luengo was a prominent businessman who was the CEO and Vice President of ConstructAbility Inc., a construction services firm in Westlake.The Hispanic Chamber of Commerce awarded ConstructAbility with an award in 2017.The shooting took place along Interstate 90 near West Boulevard Thursday evening.The scene led to a major police presence and traffic back-up in the eastbound lanes between West 44th Street and West Boulevard.The deputy involved was not injured.Witnesses say the incident started after a single-vehicle crash. The driver then got out of the SUV and was acting both erratically and violently to those trying to help him. Authorities say he was involved in an altercation when the deputy exited his own vehicle. A Florida man was allegedly attacked while trying to do the right thing during Hurricane Irma.The alleged victim was letting Tarvice Lamar Payne stay at his home in Port St. Lucie during the storm when his guest attacked him, according to Port St. Lucie police.Payne, 33, of Royal Palm Beach, accused the alleged victim of stealing his drugs, so he punched him and then threatened him with an ax, a police report states. The alleged victim managed to escape and call the police, but not before Payne took the ax and struck a car in the driveway, police said.Arriving officers managed to track Payne down as he was leaving the area.They charged him with aggravated assault, battery, and criminal mischief. 742
