CARLSBAD (KGTV) - In response to a four year construction project that recently kicked off, California Highway Patrol has lowered the speed limit on a stretch of interstate 5 by 10 miles per hour. The stretch is about eight miles long, through Encinitas and Carlsbad. The entire project will eventually go all the way to the 78. The project with add HOV lanes over the next four years. The new speed limit will help to protect workers in the area working closely to the passing vehicles. California Highway Patrol officer Mark Latulippe tells 10News, "the days of well we just put the signs up and we’re giving you a grace limit, are over". They've put up dozens of signs to warn people of the change, dropping the speed limit to 55 miles per hour. Despite the many signs drivers are ignoring the change and sticking to their normal speeds upwards of 70 miles per hour. The signs have been up for about a month but Latulippe says, "we are sending enforcement units out now to start that ticketing process of trying to slow this down". CARLSBAD, Calif. (KGTV) — Many business owners are paying big bucks to move outdoors and comply with state and county health orders. One business owner in Carlsbad said she had to fork up more than ,500 to provide outdoor dining."They said your option is to pay this or you don't get to go outside," said Annie Rammel, owner of Oak + Elixir in the Carlsbad Village.The City of Carlsbad charges 1 for businesses to move onto sidewalks, but it wasn't that simple for Rammel."We were told that the fee would be 1. She was hoping Carlsbad would follow suit.The Carlsbad City Council voted to approve moving into public spaces on July 28, and Rammel got a permit days later. That came after four weeks of being shut down and working with the city to find a solution."We didn’t want to just put tables on the concrete that are in parking spots next to cars driving by," she said. "We wanted to create a safe space for customers to feel like they could come in relax."Then, the unexpected happened."We got a phone call from the city saying that we actually needed to pay ,500," she said.The city is charging ,200 per parking space plus extra fees. Rammel requested to utilize four spaces."The fee for a curb café is 1 but also includes ,200 per parking space into a fund that is used to create new parking to compensate for the loss of the parking that is converted into a dining area," said David Graham, the Director of Economic Development and Innovation for the City of Carlsbad. "Allowing one business to remove parking means the loss of convenient parking that the nearby shops, restaurants, offices, and personal care services rely upon to draw customers."Despite the circumstances, Rammel got the permit to use four parking spots and built a deck."I begged and pleaded, 'please can we get a prorated amount, can we do month to month, is there any way you can work with us because you are depleting our cash flow at a time where we desperately need cash flow to survive this,'" she said.She paid the fees in full and spent an additional ,000 to have the temporary deck built."When Governor Newsom tells us we can go back inside, we have to tear it down," she said. "We don't get to keep it."The painful costs during an already difficult time were the only solution to keeping way Rammel's business running."We had to pull that ,500 from our savings," she said. "If we're not serving customers, we're not making profits, and we cannot pay our bills."She said leaders from other cities in the county that have waived permitting costs have personally reached out to her to show support.There may be some hope left."We understand that these are not normal times. So, when Oak + Elixer raised the issue of the total cost of the fee due to the ,200 per stall payment into the parking fund, we started working on options. Whether or not that would include retroactivity for those who have already paid will be evaluated," said Graham."On Monday, August 10, we will bring a discussion of any fees associated with an outdoor business operation on public property like sidewalks and streetlights to the city's subcommittee on COVID-19 economic revitalization.""I'm in a big hole, and I've gotta dig myself out of that hole, and I'm not giving up," said Rammel. CARLSBAD (KGTV) — A woman visiting Legoland in Carlsbad was stunned when she spotted someone angling their phone into her changing stall at the water park. "I saw a phone at the corner, which is under the divider of the stalls. So I called out to that person, 'Excuse me, what's that phone doing there?'" Carisma Jucaban recalled.She thought it may have been a child or just an accident, but it was not."As soon as I heard the door open, I ran out to take a look, but he was already making a turn. And I was kind of standing there like, 'What just happened?' My husband is looking at me like, What's going on?' I was like, 'Did you see that guy?'" Jucaban explained.Jucaban immediately reported the man to Legoland security and within hours they found him. Carlsbad police arrested 26-year-old Anthony Galindo of Los Angeles. "They looked through his phone and found a bunch of disturbing — they didn't really specify what it was — I don't really want to know. And from there, the police arrested him," she said.Legoland released a statement that reads in part: "Park staff acted promptly as the safety and security of park guests is the number one priority. Park officials are assisting Carlsbad police with the investigation."The information about the suspect's phone was given to Jucaban by security. It has not been verified by Carlsbad police. 1356

  

CARLSBAD, Calif. (KGTV) - On a given evening, the streets of Carlsbad Village are filled with people walking, biking, and driving across the train tracks that bisect the city.The number of trains passing through has also been steadily increasing.“There are projections that say in the next 10 years train traffic is going to double through this region,” said Jason Haber, who works for the City of Carlsbad.Carlsbad Village is one of the last remaining stretches of train tracks along the San Diego Coast that has not been double-tracked to accommodate the growth in train volume. But there are plans to change that.The option being pushed by the city is to trench the tracks through the downtown area. That would also address the other pressing issue on the tracks: safety.In the last 5 years, the North County Transit District says 11 people have died from being struck by a train in the city.Last September, Jason Holsinger was killed where the tracks cross Grand Avenue when he rode his bike passed a lowered crossing arm.Near Tamarack Avenue, Josh Foster was killed last February while walking along the tracks. The Medical Examiner determined he had marijuana in his system but ruled it an accident.One of the most high profile deaths occurred in 2014 when 22-year-old Patrick Terrin was struck by a train while crossing at Grand Avenue after a night of drinking.The family sued the City of Carlsbad and BNSF railways claiming there were inadequate safety measures at the crossing for pedestrians. However, they lost the case when a judge determined the city and BNSF were not liable.If a plan to trench the tracks is given the green light, the vehicle and pedestrian crossings would go over the tracks.Two alternatives are currently being looked at, a shorter and longer version.The North County Transit District oversees the tracks in the area and would end up making the end decision. It’s unclear where the money would come from at this point. Depending on the alternative chosen, the project could cost between 300-400 million dollars. Construction could take several years. 2093
