SAN FRANCISCO (AP) — A California state appeals court has thrown out the sole conviction against an immigrant who fatally shot a woman on the San Francisco waterfront in 2015.The 1st District Court of Appeal on Friday overturned a gun conviction against Jose Inez Garcia-Zarate because the judge failed to instruct the jury on one of his defenses.Garcia-Zarate was acquitted of murder in the killing of Kate Steinle, who was on a pier with her father when she was shot in the back in July 2015.The case of Garcia-Zarate, who was in the country illegally and had been deported five times, touched off a fierce immigration debate.He said he unwittingly picked up the gun wrapped in a T-shirt and it fired accidentally.Garcia-Zarate is in custody and facing federal gun charges. 783

San Diego (KGTV)- Just weeks ago the Veterans Village of San Diego wasn’t sure they’d have the money to fund their annual Stand Down event. But thanks to generous sponsors, the organization is helping hundreds of homeless veterans this weekend. The three-day event is being held at San Diego High School. More than 700 veterans are expected to participate in the event throughout the weekend. A variety of services is being offered. Some veterans say they are in desperate need of housing, while others tell 10News they are just fighting to keep the roofs they already have over their heads. “I’m minding my own business, next thing I hear knocks on the door ‘hey you can’t park here,’” says Vietnam Veteran Robert Ewing who was given 15 parking tickets for his motor home in the last three months. “That’s why I’m here trying to get rid of these.”Ewing says it has been a struggle trying to find a safe place to park his motor home. Among a variety of services, Homeless Court is being provided at the annual Stand Down event. “The City Council needs to sleep on the streets for a couple of nights and see what the homeless go through. It’s no joke,” says Ewing. For more than three decades, the Veterans Village of San Diego has been putting together this event. It brings in more than 100 organizations to help the homeless. Even though donations were low a few weeks ago, organizers say they were never going to cancel the event. They are just grateful for their donors, so they did not have to scale the event down. 1529

San Diego Unified School Board president and math teacher Kevin Beiser will introduce a resolution at Tuesday night's meeting demanding action from state and federal lawmakers pass stricter gun control laws."It's an opportunity for us parents students and teachers to speak in unison and call on our elected officials to do what we know is right and implement reasonable gun reform now, said Beiser ahead of the meeting. The board did something similar after the Sandy Hook school shooting back in 2012 but Beiser thinks it's worth stating again. And although it's not included in the resolution, Beiser expects the issue of arming teachers to come up at the meeting.Last week President Trump said he favored arming teachers to protect students. 763

SAN DIEGO, Calif. (KGTV) - Christmas morning, more than 700 families drove through a toy and food distribution at the Jacobs Center on Euclid Avenue in San Diego. Families were given boxes of food from the San Diego Food Bank, plus every child was able to get out of their car to receive at least three wrapped gifts. There were also free gift cards available.“My little one smiled. He was so happy,” said Elsa Sarabia, a mom of five who drove through.Sarabia said she works as a chef, and both she and her husband have lost hours at work this year. This event meant more gifts for her children that she might not have otherwise been able to afford.“We don’t have a lot of money to buy stuff for the kids and we appreciate everything you do for us,” she said, thanking the organizers.This is the fourth time this event was held. It’s hosted by Shane Harris and the People’s Alliance for Justice, with support from Supervisor Kristin Gaspar and the San Diego Lifeguards.The event had to adapt this year to be safe due to coronavirus, but Harris said they knew they had to make those changes to continue to fill this need. The breakfast would usually take place in a big hall, but organizers designed a drive-through format for 2020.“Really just trying to make sure the needs of the community are met particularly at a time where COVID-19 has made it really difficult for a lot of families economically,” said Harris.One volunteer was dancing through the whole morning as she distributed food, saying she was glad to give up her Christmas morning if it meant helping those in her community who needed it this year."A lot of these people do appear to be in great need. SAN DIEGO (KGTV)- The DMV is apologizing for long wait times as they work through a new queuing system and problems with the REAL ID.Wait times (without an appointment) used to be under two hours, now they're closer to 4-5 hours. The DMV issued this statement to 10News:The issue is employees have to manually enter the ID number given to each customer, since a new system went online two weeks ago. The ID number consists of your initials and the last four digits of your phone number.The process prior was completely automatic.The other issue relates to the REAL ID. Employees are taking more time to explain to customers what they need to have in order to get the ID.
