The video streaming service Netflix has been indicted by a grand jury in Texas over the film “Cuties,” alleging the company used “lewd” images."Cuties" is a French film that follows the story of an 11-year-old Senegalese immigrant in France who rebels against her family's Muslim traditions and joins a free-spirited dance crew.The film, directed by Ma?mouna Doucouré and originally called “Mignonnes”, won a directing award at Sundance Film Festival earlier this year.A Tyler County, Texas grand jury moved to return an indictment against Netflix last month, according to multiple media reports.The complaint alleges Netflix knowingly promoted visual material which “depicts the lewd exhibition of the genitals or public area of a clothed or partially clothed child who was younger than 18 years of age at the time the visual material was created, which appeals to the prurient interest in sex, and has no serious, literary, artistic, political, or scientific value.”In response, Netflix stated “‘Cuties’ is a social commentary against the sexualization of young children,” according to a statement in Deadline. “This charge is without merit and we stand by the film.”Netflix was reportedly served a summons October 1.Earlier this summer Netflix was forced to apologize for what they called “inappropriate art work” used to promote the movie on their service.The main image Netflix originally used shows the four lead actresses, all girls, wearing black and turquoise dance outfits revealing their stomachs and most of their legs, while posed mid-dance.The images used in France for the film show the girls walking down the street holding shopping bags.The film is recommended for 16+, according to Netflix. The image and description for the film have been updated in Netflix.The poster sparked outrage online, and with some comparing the poster to pedophilia. In the days following the release of the artwork, thousands had signed a Change.org petition calling for the film to be removed from Netflix. The film is now available on the service.Doucouré said the film is based in part on her own childhood experiences, and those of girls growing up today.“This is most of all an uncompromising portrait of an 11-year-old girl plunged in a world that imposes a series of dictates on her.” She said in an interview with Cineuropa.She continued that it is important to not judge these girls, but to understand them, listen to them and give them a voice. 2458

The U.S. Supreme Court has declined to weigh in on the battle over pension reform in the city of San Diego. The decision leaves in place a California Supreme Court decision from last year that called pension reform into question and required a lower court to come up with a remedy. It could end up costing the city billions. In 2012, San Diego voters approved Proposition B with 65 percent in-favor. The measure ended pensions for nearly all new city hires, instead switching them to 401(k) type plans. Around the time, the city faced a billion pension liability, comprising 20 percent of the budget. "It is saving us, literally, hundreds of millions of dollars," Mayor Kevin Faulconer said Monday. "That's why it's important, so we can invest dollars back into neighborhoods."The city, however, is now on the legal defensive. Back in 2012, then-mayor Jerry Sanders campaigned on behalf of the measure. Labor unions argued Sanders' involvement required the city to meet and confer with unions before changing their terms of employment. The city argued that Sanders was exercising his First Amendment right to endorse the measure, which got to the ballot via a citizens initiative. The state Public Employee Retirement Board sided with the unions. So did the California Supreme Court, which last year ordered lower courts to decide a remedy. "There is not even a breath of a suggestion in this case that any public officials First Amendment rights have been violated," said Ann Smith, the attorney representing the labor unions. In a statement, Sanders, who now heads the San Diego Regional Chamber of Commerce, called the Supreme Court's decision disappointing but not unexpected. Smith said a lower court decision could make a decision within 30 days. It could impact as many as 4,000 city employees. 1813

The summer season begins in Del Mar in less than a month, bringing with it a wealth of exciting events, but also a large influx of crowds and traffic.As one of the smallest cities in San Diego County, Del Mar has just about 4,000 people. But on any given day in the summer, more than 100,000 people could come to town. Within four months, the city hosts the San Diego County Fair, the Del Mar Horse Racing season, the Kaaboo concert weekend and also some of the busiest beaches in the area."That's part of the city's story, we're used to it," says long-time Del Mar resident Bettina Experton. "The Council knows how to handle it."The Del Mar City Council will meet Monday, May 7th, to discuss their plans for the 2018 season.They'll add ,000 to the budget for Sheriff's Department overtime. That helps put extra deputies on patrol to watch for petty theft, car break-ins and other small crimes near the beach. The city also adds lifeguards on busy weekends.To help defray the costs, parking is strictly enforced throughout the summer, with another officer added to patrol the meters. People have to pay for parking seven days a week in some areas, with meters going until 10 pm on weekends."We provide services for close to 5 million people a year," says Vice Mayor Dave Druker. "Somehow we need to pay a little bit of those services through our parking enforcement. The Senate has passed a defense spending bill that President Donald Trump has said he plans to veto, according to the Associated Press.The National Defense Authorization Act passed the Senate with a 84 to 13 Friday. The annual bill affirms a 3% pay raise to U.S. troops and unlocks billions in military spending.The bill passed despite an attempt from Sen. Rand Paul, R-Kentucky, to filibuster the bill and delay its passage. Paul said Thursday he opposed the bill because it limited Trump's ability to withdraw troops from the Middle East before he leaves office.Trump has threatened to veto the bill unless lawmakers include a provision that would remove Section 230 from the 1996 Communications Decency Act. That section protects tech companies from being sued for content that other people post on their website.Conservative lawmakers have attacked the provision in recent years, saying that the protections have led social media conglomerates to develop a liberal bias on the social media sites. Proponents of the provision say it upholds free-market values in the marketplace of information.Congress is expected to override a potential veto from Trump. The House of Representatives easily passed the bill earlier this month with a vote of 335-78. 1260
