SAN DIEGO (KGTV) — A San Diego High School teacher said she warned her school administration about the behavior of a former teacher nearly a year before he was arrested.According to a recently filed lawsuit, Vanessa Montgomery alleged Juan Carlos Herrera engaged in a continuous course of sexually harassing conduct. The lawsuit states, "On a near-weekly basis, Herrera made comments about Ms. Montgomery's dress, looks, and body."Herrera, formerly a special needs curriculum instructor, was sentenced to 10 years in state prison earlier this month. In August, Herrera pleaded guilty to 11 felonies, including lewd acts on a child and assault. Montgomery said she first met Herrera in 2016. She was new on campus."I was basically just trying to survive and learn things along the way," Montgomery explained.Montgomery said she had her first uncomfortable encounter with Herrera just a few months on the job."I just want to let you know that the dress you're wearing and the outfit you have looks really good, and it hugs your body really well," Montgomery said Herrera told her.Last week Montgomery filed a lawsuit against Herrera and the San Diego Unified School District alleging sexual harassment and failure to prevent sexual harassment.Based on the lawsuit, "Herrera's sexually harassing comments included: Remarks that Ms. Montgomery's clothes made her 'curves look good;' remarks that Herrera would do anything for Ms. Montgomery as long as she wore 'those shorts;' and a comment and attendant gesture suggesting Ms. Montgomery needed to hold her chest when walking down stairs to stop her breast from bouncing."Montgomery shared with Team 10 Investigator Adam Racusin that she felt "very uncomfortable all the time," around Herrera.Montgomery said words eventually escalated to touching. In her lawsuit, she described an occasion where she spilled coffee on her shirt. She states Herrera took a toothpick out of his mouth and pushed on her breast where the stain was located with his toothpick."He took it out, put it back in his mouth and winked at me, smiled and walked away," she said.Montgomery said she took her concerns to her supervisor, the vice principal at the school. She said she had a face-to-face conversation and also sent an email in May 2018.According to the email obtained by 10News, Montgomery wrote, "I would like to inform you about some issues that have occurred in the last couple of years with Juan Herrera. I have decided to report sexual harassment against Herrera."The email described four incidents in three years.In the email she also detailed Herrera's interactions with female students, writing, "Herrera always has a group of young girls around him. He pulls them out of class to offer support which makes me wonder what has he said to them. He is normally in a classroom with the girls and without another teacher. I know he means well but the comments that I have shared above make it hard to trust him."That email was sent nearly a year before Herrera was arrested."He'd be working with groups of girls in classrooms alone with the door closed," Montgomery said. "I witnessed that multiple times."Prosecutors said Herrera assaulted an unnamed victim "on almost a daily basis" between February 2018 and March of this year, when the girl was 15 and 16 years old. He was arrested in May 2019. "The HR (human resources) office had no documents related to complaints that were made by Ms. Montgomery and they had no intention of investigating any of those complaints, and that was even after Mr. Herrera was arrested," Montgomery's attorney Andrew Hillier said.Hillier said when an organization becomes aware that an employee has reported sexually harassing behavior, the organization has a responsibility to investigate. He said they also have to take some sort of temporary remeasures to ensure it stops and if its warranted take permanent measures."The allegation is sexual harassment of course, but it's also a failure on the part of the district to step in once they became aware of the harassment," Hillier said.According to the lawsuit, the district did not interview Montgomery. "To Ms. Montgomery's knowledge, SDUSD did not interview anyone in relation to her complaint. SDUSD did not make Ms. Montgomery aware of any temporary or permanent remedial measures the district put in place to address Herrera's harassment," the lawsuit stated.Montgomery said the harassment continued until Herrera was arrested.A spokesperson for the school district didn't answer any of our questions about Montgomery's allegations. SAN DIEGO (KGTV) - A North Park barber salon is on the brink of shutting down due to the coronavirus.Melissa and Christopher Cage met in high school. Melissa grew up in Watts and Christopher grew up in West L.A."I love it, you know, it made me who I am. It made me strong," Melissa said.Christopher said it was a dangerous place to grow up, "shootings, drive-bys, everything. That's why I wanted to get my kids away from that."They got married and in 2013, Christopher was laid off. They had three kids with a fourth on the way and at that moment he said he would never work for someone else again.He went to barber school. Five and a half years ago the family picked up and moved to San Diego with a dollar in Christopher's pocket."I think I gave my last dollar to a bum," he said, his wife nodding behind him. They were grateful to live in their aunt's living room as they saved up for a new place. They built up enough money to rent a run-down North Park house. They remodeled it and created Originality Barber Salon. Christopher has a row of barber chairs in the front half of the business and Melissa has a serene intimate salon in the back.Their challenges didn't end when the doors opened. Melissa said their biggest challenge was being accepted by the neighborhood.In 2018, someone spray-painted a racial slur in front of their shop. They cleaned it up and used it as motivation to succeed."I'm not going to fight hate with hate, I'm not going anywhere so you're just going to keep seeing me, so might as well," Melissa said.When the pandemic first hit, they kept their positive attitude, looking at it as a vacation."It was a vacation but then it started to get a longer vacation and I'm like okay, we're starting to dip into our savings now. I'm like we need to start figuring something out," she said.They were able to reopen for a few weeks, due to the county orders, and then, forced to close again.Multiple loan applications were denied. They said they were trudging through the permitting process to work outside. When Monday came and barbers could once again work indoors, Chris said it could be too late.They have a child with health issues, putting her at greater risk for catching the coronavirus, so they're trying to balance safety with finances.The couple said their goal of the business is to leave something for their children. SAN DIEGO (KGTV) -- A new report found that nearly half of U.S. renters are spending 30 percent or more of their income on rent.The report also found that nearly one quarter of renters spend half of their income or more on rent.The share of cost-burdened renters has doubled since 1960, when just 24 percent of renters were burdened in the U.S., according to Apartment List.RELATED: Rent increases in San Diego due to higher demand, lack of supplyIn San Diego, those numbers rose significantly. In 2016, more than 57 percent of San Diego renters were cost-burdened, meaning they spent 30 percent of their income or more on rent. San Diego ranked 94 for affordability out of the nation’s top 100 largest metros. SAN DIEGO (KGTV) - A local college student is trying to stay afloat since the "snowball effect" of the coronavirus turned his life upside down.In November, Andres' Cortes mother and brother went on their dream vacation: a trip to China and the Great Wall. They were due back in December. Months later, they remain in a hotel in Shanghai."They're healthy, but I'm worried. It spreads very quickly," said Cortes.With no available flights home, their return date remains unknown."You're missing out on your family, the pillar of life that that gets you stable. Not having my mom is affecting to me," said Cortes.Another thing affecting him is a loss of work. His part-time job with MTS special events has been scuttled with the ongoing coronavirus precautions."My job is my only source of income," said Cortes.Cortes is worried about having enough money for food and his next rent payment."Just don't really what to expect of the future. It seems to be snowballing into a bigger and bigger effect," said Cortes.For Cortes, the impact may also be felt in his schooling. He's a business major at City College. His classes are now online, a format he doesn't perform well with."It's not the same to study online than to actually to go to class, to be able to talk to the teacher and answer your questions," said Cortes.Cortes fears he won't pass his final classes and won't graduate in May. He calls the unknowns of his life 'overwhelming.' "We just all have to take it seriously. All of us want this to stop. We want to go back to school and our jobs. SAN DIEGO (KGTV) – A new COVID-19 testing site opened Wednesday morning at the San Ysidro Port of Entry, with tests for the virus available at no cost.The free test site is located at the PedEast crossing of the Port of Entry. It will be open 6:30 a.m.-10:30 a.m., Monday through Friday.About 200 tests will be administered daily, and no appointments will be necessary. San Diego County health officials said those getting tested “will not be asked about their immigration status or who lives with them.”Health officials said the site is focused on “testing essential workers and American citizens who live in Tijuana, as well as residents in the area.”Jennifer Bransford-Koons, the county’s testing director, said it’s possible the hours at the new site could eventually change.“We’re starting out first thing in the morning as people cross the border … to be able to see if that’s a good time to have people to be able to test. If that doesn’t work, then we’ll move to the afternoon or other days of the week. The purpose is to provide accessible testing to members of the public,” she said.County Public Health Officer Dr. Wilma Wooten said, “We know that communities in South Bay have been hit the hardest by COVID-19.
