A federal judge ruled Monday Pennsylvania’s Governor Tom Wolf’s COVID-19 pandemic restrictions are unconstitutional.Four counties in the state filed a lawsuit claiming the governor’s orders closing non-life-sustaining businesses and limiting outdoor gatherings, and stay-at-home orders were unconstitutional. They stated the orders were "arbitrary, capricious and interfered with the concept of 'ordered liberty' as protected by the Fourteenth Amendment."Plaintiffs included hair salons, a drive-in theater, other businesses, as well as state representatives and congressman Mike Kelly.In his ruling, the judge says the governor’s actions likely had good intentions, “to protect Pennsylvanians from the virus," but that "even in an emergency, the authority of government is not unfettered."U.S. District Judge William Stickman IV ruling reads, “"(1) that the congregate gathering limits imposed by defendants' mitigation orders violate the right of assembly enshrined in the First Amendment; (2) that the stay-at-home and business closure components of defendants' orders violate the due process clause of the Fourteenth Amendment; and (3) that the business closure components of Defendants' orders violate the Equal Protection Clause of the Fourteenth Amendment."In his written opinion, Judge Stickman continued his explanation of his ruling."There is no question that this country has faced, and will face, emergencies of every sort. But the solution to a national crisis can never be permitted to supersede the commitment to individual liberty that stands as the foundation of the American experiment. The constitution cannot accept the concept of a 'new normal' where the basic liberties of the people can be subordinated to open-ended emergency mitigation measures,” Stickman wrote."Rather, the Constitution sets certain lines that may not be crossed, even in an emergency. Actions taken by defendants crossed those lines. It is the duty of the court to declare those actions unconstitutional." 2007

A Detroit police officer who was recorded punching a naked woman at a Detroit hospital has been suspended with pay pending an investigation.According to Detroit Police Chief James Craig, the Wayne County Prosecutor's Office has also started a criminal investigation into the officer's use of force.The incident started with a call around 6:45 p.m. local time on Wednesday. When officers arrived, they saw a naked woman on the street. Officers put her in a police car and took her to Detroit Receiving Hospital. According to Craig, the woman was not agitated during the entire ride to the hospital, and officers were able to cover her up. Craig said the officers did not handcuff her.Once at the hospital, the woman threatened hospital staff and security staff, spit on several employees, bit a security officer twice and tried to bite another police officer.Craig says an officer struck the woman several times, ignoring the Detroit Police Department's de-escalation tactics."The suspect had her back turned but the officer continued to punch," Craig said. "We have grave concerns for the officer's action."The department is investigating the incident, on top of the prosecutor's office, and they are in the process of downloading body camera videos. According to Craig, the officer is an 18-year veteran of the force, is a corporal, and has a good record. He hasn't had a complaint since 2015 and not does not have a "category one use of force incident"— when a use of force incident results in injury.The woman was treated for minor injuries at the hospital and had some minor contusions but is in stable condition.Officers have interviewed several hospital staff, but are in the process of trying to locate the person who took the video showing the use of force.According to Craig, the officer did undergo their mental health and emotional survival training twice in 2016 and once in 2015. A Flint woman was accused of placing her infant children inside a suitcase and leaving them at the curb.On Wednesday, Flint Police responded to a residence in the 500 block of West Pierson Road to assist Child Protective Services.When officers were on scene, a 26-year-old woman placed items to the curb "as if it were trash" and fled from the residence at West Pierson Road on foot, according to a release from Flint police.Police say she was detained after a brief foot chase. Officers returned to the residence and found the woman's two sons, but two children were missing. After searching the area, officers located two 11-month-old twin girls inside a suitcase at the curbside. They were transported to the hospital where they were listed in good condition.The woman remains in custody. 804

  

A Fort Hood soldier has been identified as the victim of a drowning in a Texas lake over the weekend.Officials say the body of Spc. Francisco Gilberto Hernandezvargas was recovered after a boating incident on Stillhouse Hollow Lake. The lake is a U.S. Army Corps of Engineers reservoir on the Lampasas River, southwest of Belton. The 24-year-old, whose home of record is listed as Woodside, New York, entered the army in May 2017 as an automatic rifleman and has been assigned to 1st Battalion, 5th Cavalry Regiment, 2nd Armored Brigade Combat Team, 1st Cavalry Division since December 2017.The Bell County Sheriff's Office was alerted that a male, while riding an inner tube behind a boat, went under water and did not surface on Saturday. This took place in the area of Dana Peak Park on Stillhouse Hollow Lake, according to officials.His body was recovered on Sunday.Hernandezvargas’ awards and decorations include the National Defense Service Medal, Korean Defense Service Medal, Army Good Conduct Medal, Overseas Service Ribbon and the Army Service Ribbon.“The Black Knight family is heartbroken by the loss of Spc. Francisco Hernandezvargas. Our hearts go out to his family and friends during this difficult time,” said Lt. Col. Neil Armstrong, commander of 1st Bn. 5th Cav. Regt. “Spc. Hernandezvargas served his country honorably both stateside while at Fort Hood and abroad in Korea and Romania and this tragic loss is felt by every member within our formation.”The unit is cooperating with local authorities as this incident is currently under investigation.The drowning marks the fourth death of a Fort Hood soldier in the past few months. Specialist Vanessa Guillen, Private Gregory Wedel-Morales, and Private Mejhor Morta passed away in separate incidents before Hernandezvargas.
