A man shot by a Cuyahoga County, Ohio Sheriff's deputy near Cleveland on I-90 on Thursday has died.The medical examiner identified the man as Brett Luengo, 33, of Westlake, Ohio. He was transported to MetroHealth Medical Center where he was treated, expired and pronounced dead last night. Luengo was a prominent businessman who was the CEO and Vice President of ConstructAbility Inc., a construction services firm in Westlake.The Hispanic Chamber of Commerce awarded ConstructAbility with an award in 2017.The shooting took place along Interstate 90 near West Boulevard Thursday evening.The scene led to a major police presence and traffic back-up in the eastbound lanes between West 44th Street and West Boulevard.The deputy involved was not injured.Witnesses say the incident started after a single-vehicle crash. The driver then got out of the SUV and was acting both erratically and violently to those trying to help him. Authorities say he was involved in an altercation when the deputy exited his own vehicle. When the deputy approached, the sheriff said Luengo "charged (the deputy) in an aggressive manner.""He kept screaming to shoot him. The cop kept asking him to roll over, put your hands behind your back. The man was not cooperating. He kept trying to get up and attack the police officer, he kept lunging at him," witness Jason Geiger said. "I think what happened at that point he ran out of taser cartridges because at that point he shot the guy."Authorities say the deputy fired one shot. A Boynton Beach, Florida woman accused of shooting her husband five times over HOA complaints will not be charged with attempted murder.State prosecutors declined to file charges against Lisa Barreca Thursday morning. Police arrested Barreca last month, saying she shot her husband and caused wounds to his head, both his arms, his right leg and back.Barreca planned to use the stand your ground defense.A spokesperson for the Palm Beach County State Attorney's Office said the agency did not complete their investigation within the 30-day mandatory filing period. The SAO is able to file charges in the future, if they choose to do so.The Boynton Beach Police Department completed their investigation into the case, according to Public Information Officer Stephanie Slater.Barreca was ordered to be released on her own recognizance following a Thursday morning court hearing and the case was closed in court records. Barreca, who lives on Aspen Leaf Drive, was talking about HOA complaints with her husband Eric Barreca in their kitchen when he told police that the situation started to escalate.  The police report said that Lisa Barreca then went into the garage, retrieved her gun and shot him. Lisa Barreca was hospitalized and then was taken to the Palm Beach County Jail. A family in Tennessee was able to escape their burning house thanks to their neighbor's rescue dog.The home in the Franklin, Tennessee neighborhood of Twin Oaks was seriously damaged in a fire caused by fireworks, officials say.Neighbor Jess LeCates said his 3-year-old Belgian malinois Roux was barking frantically at his front door around 10:20 p.m., about an hour after the homeowner threw fireworks near a trashcan outside, sparking the fire.Roux noticed the fire and led LeCates to the home where the roof and garage were already on fire.
