SAN DIEGO (KGTV) - The suspect in the shooting death of a man near the 24 Hour Fitness in the Midway area is an undocumented immigrant with a prior immigration violation, according to law enforcement sources.San Diego Police arrived at the rear parking lot of the gym at 3675 Midway Drive February 25 to find Alexander Mazin, 27, suffering from a gunshot wound to the torso. He died at the scene.After the shooting, officers surrounded an apartment at 30th St and Upas in North Park. He left, but eventually made it back into the U.S.Mazin’s family said Castellanos had previously been in a relationship with Mazin’s girlfriend of three months.Two weeks before the shooting, Castellanos had attacked the woman while she was working out with Mazin at a gym, Mazin’s parents said.RELATED: Police release pictures of Midway District homicide suspectTheir son’s death has galvanized their support for President Donald Trump’s plan to build a wall across the southern border.“I want President Trump to know about this,” Jeffrey Mazin told 10News. “I want him to be aware there was a true patriot, a wonderful human being that was an exemplary citizen that was lost because of this problem with our border.”But framing their son’s death as an immigration problem worries Dulce Garcia, an immigration attorney and an undocumented immigrant herself.She has protection from deportation through Deferred Action for Childhood Arrivals (DACA). To her, immigration status should be irrelevant in this case.“Someone is going to commit a crime whether they are undocumented here or not,” she argues.Garcia said her reason is that people like herself, who are otherwise law-abiding members of society, are put at higher risk for deportation when they get grouped in with criminal fugitives.“That’s the truly terrifying part for me because I don’t think that’s American. I don’t think we as a nation agree to paint any group based on what one person’s actions did,” said Garcia.Castellanos remains at large. SAN DIEGO (KGTV) - The purple most restrictive tier for coronavirus guidelines goes into effect Saturday forcing many museums around San Diego County to close their doors once again."It really wasn't a surprise and when this all first started happening I think we realized that there wasn't going to be a magic date that everything was going to be better," James Haddan, Senior Director of Development and External Communications at the Museum of Us, said they've been anticipating the county's fall back into the purple tier."We made some hard choices initially, right away," Haddan said they made difficult cuts to staff at the beginning of the pandemic, hoping to sustain for the next two years."It has been extremely difficult for arts and cultural organizations throughout the city and Balboa Park would be no different," Executive Director of the Balboa Park Cultural Partnership Peter Comiskey said.Comiskey said while many of the museums must close, there are still things to do at the park. The Japanese Friendship Garden, Spanish Village, and restaurants are open.In La Jolla, the Birch Aquarium is shifting too. They reopened in July and are creating as many exhibits as they can outside. SAN DIEGO (KGTV) -- Three of the four American tourists killed in a helicopter crash in Kenya on Sunday night were from San Diego.Coronado Mayor Richard Bailey told 10News David Baker, a Coronado resident, was killed in the crash. The US Embassy identified Brandon Stapper and Asher Burke, who also lived in San Diego, as victims earlier in the day Monday. They were riding in a helicopter that crashed in the Central Island National Park in Lake Turkana on country's northern border at 8:35 p.m. Sunday (2:35 a.m. ET), Kenya's Civil Aviation Authority said in a statement posted on its website."A rescue team was dispatched immediately and they arrived at the Central Island at around 11:20 p.m. and located the wreckage at 3:20 a.m. with no survivors," Kenya's aviation chief Gilbert Kibe said.READ: Pilot, 4 Americans killed in helicopter crash in KenyaStaff at Stapper's graphics company near Mission Hills told 10News that they learned Sunday evening the self-made entrepreneur was killed in the accident.
