(CNS) - A verdict has been reached in the trial of a woman and her gun instructor who are accused of carrying out a plan to kill the woman's estranged husband.A jury has found Diana Lovejoy, 44, guilty of conspiracy to commit murder and attempted murder. Welcon McDavid Jr. was also found guilty of conspiracy to commit murder, but the reading of the verdict had to be postponed because Lovejoy passed out. Lovejoy and McDavid Jr. were charged with conspiracy to commit murder and attempted murder in the Sept. 1, 2016, attack on 45-year-old Greg Mulvihill, who was wounded in the 11 p.m. shooting in Carlsbad.Police allege Lovejoy and McDavid planned the crime and that the latter - - who worked at a gun range where Lovejoy was taking marksmanship lessons -- called the victim, arranged to meet him in the alley and opened fire on him with a rifle while hiding in a patch of bushes.Court records indicated Lovejoy and Mulvihill were in the midst of a contentious divorce, and that she had obtained a restraining order against him on accusations of emotional and sexual abuse.Mulvihill took the stand during the trial and described the moments leading up to him being shot, saying he didn't realize he'd been shot right away and, at first, he thought he felt something in his back even though he could see the shooter in front of him.Mulvihill testified about a bitter custody battle with his estranged wife.Mulvihill said he went up a remote trail in Carlsbad out of desperation, fearing Lovejoy would reopen their custody battle. He took a friend, a flashlight and a small aluminum baseball bat, but he thought he was picking up documents from a private investigator.Instead, as he approached the spot off Rancho Santa Fe Road and Avenida Soledad, he shined his flashlight around and spotted someone dressed in camouflage pointing a long gun right at him.Before he knew what was happening, Mulvihill said he was hit once in the side, the bullet exiting out his back. He said Tuesday that he will enact mask mandates where he can, like on federal property or on airplanes and other inter-state travel. But he said he's asking the rest of the country to join him in wearing masks even where they are not mandated.Biden also said Tuesday that he hopes to administer 100 million doses of COVID-19 vaccines in his first 100 days. In order to aid his administration in his goal, he says he hopes Congress can pass additional funding that would assist in distribution. (KGTV) - A local couple is defending themselves after having their claims questioned following the release of new surveillance video showing a man allegedly trying to snatch a toddler from their car in a Vista Costco parking lot last weekend.The surveillance video released Thursday night shows 37-year-old Adam Glavinic walking up to the driver's side of the parent’s white SUV. The SUV begins slowly backing out of the stall, and that is when Glavinic reaches for the rear passenger door handle. Glavinic is shown opening the door then quickly shutting it and stepping away as a woman gets out the driver’s seat to confront him. Glavinic doesn't appear to reach inside to grab the boy who was in the backseat, according to his parents.“There's way more to this story that people don't know,” said mother Jennifer Lawson on Friday. She said that she and her fiancé are taking heat from the public after describing the encounter differently from what the video reveals. “We didn't lie. We were told that from everybody who was seeing the incident that he did touch our kid. He did reach his hand in the car. So, that's what we went off of. I didn't see [it] because I jumped out of the car as soon as I saw that guy open up the door,” she told ABC10 News.Earlier this week before the video came out, the couple said the man tried to pull their boy out of his car seat.Glavinic was arrested for attempted kidnapping and being under the influence.In response to community outrage over Glavinic posting bail and getting out of jail the next day, the San Diego County Sheriff's Department published the video in hopes of alleviating concern.The sheriff's office said that, based on the video and other evidence, "the Vista Sheriff's Station believes there is no ongoing threat or danger to our community's children related to this incident."When asked if Glavinic should still be charged, Lawson replied, “I'm not sure. I don't know his intentions. I didn’t know if he was going to kidnap my kid or hurt him. All I know is that it was terrifying and I was scared for my kid's life, safety [and] everything.”The case has been referred to the DA's Office, which is reviewing it.
