PHOENIX (KNXV) - Imagine getting the greatest gift of your life and then suddenly having it ripped away. It's what the Gateway Academy in Phoenix is feeling right now. The K-12 school for high functioning students with autism just had an important gift taken away.It's an empty field right now but the plan was for Gateway Academy to remove all of the bushes and gravel to make room for a brand new adaptive playground. The cost of entire project would be picked up by a very generous donor."We thought we had found an angel who understood the population and who's ready to give generously," said Robin Sweet, the school's executive director. "Not so much."That donation, ,000. How much the school has seen of that money? Nothing."Before I signed the purchase order I called him again just to make sure," said Sweet.That donor backed out. Now the school is left with a massive bill, a playground that's sitting in storage on pallets and students who are disappointed."Guess what,  don't see anything out here," said Joseph, an eighth grader at Gateway.  "It's not just to have fun. It would really help us," said Joseph."It's instrumental in their well-being and mental and physical health and then to say, sorry - just kidding?" said Sweet.The school won't identify the donor but Sweet does have a message for the man. "Shame on you. It's not about me but it's about the kids. That's terrible."The school has its hands tied and can't take legal action against the donor. Pala Mesa, CA (KGTV) -- We are learning more about the bus company involved in Saturday's fatal crash along Interstate 15. An Executive Lines charter bus flipped over, killing three and sending nearly 20 people, including a 5-year-old boy, to the hospital. Federal records show Executive Lines has been cited for several maintenance issues in the last two years. 10News looked into Executive Lines, a company out of El Monte in Los Angeles County. They specialize in charters from Los Angeles to San Ysidro, with many of their passengers heading to Tijuana International Airport. Saturday's charter bus, carrying 21 passengers plus the driver, was headed toward San Ysidro before it crashed on I-15 near Pala Mesa. "The vehicle lost control, veered to the right, obviously traversed this shoulder, and eventually overturned," Officer Mark Latulippe of the Oceanside California Highway Patrol [CHP] said. Witnesses said several passengers were ejected from the bus. CHP confirmed that likely none of them were wearing their required seatbelts. Three of them were pronounced dead on the scene, and nearly 20 were transported to various hospitals. According to the Federal Motor Carrier Safety Administration [FMCSA], in the last two years, none of the Executive Lines buses were involved in crashes. But out of 19 vehicle inspections for their seven-vehicle fleet, 13 of the checks came back with a total of 26 vehicle maintenance violations. That puts them in the 48th percentile, meaning nearly half of all bus companies have better on-road performance than Executive Lines. 10News also looked into the inspection history of the exact Charter bus that crashed Saturday. We found that after a November 5, 2019 inspection, this very bus was cited with two Federal maintenance violations:93.78 393.78 No Windshield Wipers Inoperative/Defective 393.95B 393.95(b) No No Spare Fuses As RequiredIt is unclear if the company fixed the violations before Saturday's crash. But it is worth mentioning that roads were slick at the time of the accident because of the rain. Executive Lines did not respond to our request for comment. 2129

  

Police in Omaha, Nebraska are looking for a suspect vehicle in connection with a shooting at the Irvington Walmart just before 5 p.m. Wednesday that left a 21-year-old woman dead.Kayviaun T. Nelson died after a shooting in the parking lot of the Walmart near 99th Street and Military Avenue, just off Interstate 680, with a child reportedly in the vehicle. OPD are looking for a 2001 bronze Chevy Malibu with license plate VVT-545.Police closed down the Irvington Walmart for hours Wednesday evening while conducting their investigation around the store.Police said they believe some type of disturbance occurred at a different location and the suspect in the shooting followed her to Walmart.Officers later worked with store management to clear all customers from the Walmart location just off Interstate 680 North and prevent anyone else from entering the location. OPD said they expected the store to be closed for a few hours while they review surveillance video. An OPD forensics unit arrived at the scene just after 7:30 p.m. Wednesday.  1116

  

Pepe the frog, the once-innocent cartoon that was appropriated as a mascot of the alt-right, is at the center of a new legal battle.Matt Furie, the character's creator is suing InfoWars, the media company helmed by conspiracy theorist Alex Jones.In the lawsuit, filed Monday, Furie alleges copyright infringement stemming from a stylized poster sold on the Infowars website. The .95 poster features a depiction of Pepe alongside other MAGA "heroes" drawn by artist Jon Allen, including Donald Trump, Roger Stone, Milo Yiannopoulos, Ann Coulter and Jones himself."The establishment wants this taken down," the description of the poster reads. "Instead, celebrate the historic victory and frame this conversation starter in your home!''According to the civil complaint, "Furie did not authorize the use of the Pepe image or character in this poster, and does not approve of the association of Pepe with Alex Jones or any of the other figures shown in this poster, or the 'MAGA' slogan."In an audio statement published on the InfoWars YouTube channel, Jones calls the lawsuit "frivolous" and part of a larger attempt by media outlets to make Infowars "public enemy number one.""We did not create the posters, that are protected speech, that are transformative," Jones says, stating the use of the frog in an item for sale "is 100% protected by the courts, protected by the first amendment, protected by fair use."Furie has tried desperately to rescue his laid-back frog from the swamp of alt-right and neo-Nazi troll patois, even going as far as "killing" the character in a 2017 cartoon.
