SAN DIEGO (CNS) - A judge took under submission today a motion by the federal government to dismiss a lawsuit filed by the cities of Imperial Beach and Chula Vista and the Port of San Diego, alleging that the International Boundary and Water Commission is violating the Clean Water Act by not doing more to prevent Tijuana sewage from flowing into San Diego area waters.The federal government maintains that the IBWC isn't legally responsible for the sewage flowing into U.S. waters from Mexico.But the plaintiffs claim that since the IBWC oversees a flood control channel that redirects the Tijuana River on its way to the Pacific Ocean, as well as water- capture basins in five canyons along the border, the agency is responsible for the sewage that gets through those systems.RELATED: Imperial Beach businesses hurt by sewage & runoff related closuresImperial Beach Mayor Serge Dedina, who has led the fight to against the IBWC since his city was hit with millions of gallons of raw sewage in February 2017, said it was heartening to hear U.S. District Judge Jeffrey Miller say he might go to the South Bay to see first-hand how the situation is being handled.Dedina said the plaintiffs got a fair hearing. "(It was) a very emotional morning for me," Dedina said outside court. "(I have) vivid memories of taking my kids to the emergency room. We have little kids here. Our kids are getting sick. Our lifeguards are getting sick. It's been a long road and a really tough fight, and it really meant a lot to me that members of our community were here to support that. And I'll tell you what, if our city council and our city ... have to crawl on broken glass through garbage to fight for this, we will do that. Crews will also place concrete panels along previously installed support columns and backfill the area on the upper bluffs north of Torrey Pines State Beach.Officials said the Del Mar Bluffs Stabilization 4 project to repair drainage infrastructure and stabilize portions of the 1.6 miles of coastal bluffs is scheduled to be complete this fall.In San Diego, ongoing construction activities are planned throughout the Mid-Coast Trolley corridor. Crews will perform improvements to the surface of the trolley tracks, including tamping the rail -- a process that secures the rail to avoid misalignment once in use.The Mid-Coast Trolley project will extend UC San Diego Blue Line Trolley service from the Santa Fe Depot in Downtown San Diego north to the University area and is anticipated to be complete by late 2021.During all construction, nearby residents and businesses can expect intermittent noise and lights. 1912

  

SAN DIEGO (CNS) - City officials broke ground Monday on the Bay Terraces Senior Center, a project that local residents have advocated for since the 1990s. Mayor Kevin Faulconer and Councilmembers Monica Montgomery and Chris Cate were on hand to mark the beginning of construction on the 3,400-square-foot facility. Once completed, the million senior center is set to include amenities such as a multipurpose room and a commercial kitchen. The facility will serve seniors in Paradise Hills, Bay Terraces and Skyline, according to the city. ``A decade ago, city leaders laid down a thin layer of gravel in preparation for a senior center in southeastern San Diego that was promised but never delivered,'' Faulconer said. ``Today we are making good on that promise and building a center that will be as great as the communities it will serve.'' Faulconer revived the project in 2016 and city officials expect it to be the city's first building to produce as much energy as it uses by leveraging solar panels on the facility's roof. According to the city, the project is partially funded by the U.S. Department of Housing and Urban Development's Community Development Block Grant program. ``This project illustrates the hard work and power of our community to organize and hold elected officials accountable,'' Montgomery said. ``We are pleased to see the Bay Terraces Senior Center start construction and we look forward to the grand opening and visiting the center for many years to come.'' City officials expect the facility to be completed in October 2020. 1567

  

SAN DIEGO (CNS) - A vehicle struck and killed a pedestrian Friday on Interstate 5 at the southern end of Balboa Park.The traffic fatality occurred shortly before 9 a.m. on the northbound side of the freeway, near state Route 163 in downtown San Diego, according to the California Highway Patrol.It was unclear why the pedestrian, who died at the scene, was on the interstate, CHP public-affairs Officer Salvador Castro said.The fatality left three northbound lanes blocked in the area and tangled traffic for miles through late morning. 544
