SAN DIEGO (KGTV) - The father accused of causing a condo fire in Rancho Bernardo that killed his two children appeared in court Tuesday afternoon for a preliminary hearing.Henry Lopez is accused of passing out drunk with a lit cigarette, setting his condo on fire last October.His children, 10-year-old Cristos and 7-year-old Isabella, were in the home at the time and suffered smoke inhalation. Both children died as a result of their injuries.Lopez was also burned in the fire and hospitalized for some time.One witness told the court Tuesday he heard a female screaming at the scene, but the screaming stopped.RELATED: Father charged after children killed in fireHenry Lopez' ex-wife Nikia Lopez testified the two were in the midst of a divorce. They shared joint custody of their children.  Lopez told the judge her former husband was an abusive alcoholic.She claims she had warned him previously not to smoke in the house around the children."He drank a lot. My goal was to keep it from the kids.  I would wake up in the middle of the night and throw away the bottles in the trash. I would pull him upstairs before the kids woke in the morning... sometimes I would have to clean up his throw up."  He’s not in custody because his defense attorney says he needs to be out to receive medical treatment for the burns he sustained during the fire.Prosecutors believe the fire started in his bed and ultimately spread to the rest of the home.  Investigators found discarded smoking materials and alcohol near the start of the fire.If there’s enough evidence against Lopez and the case goes to trial, he faces up to 14 years in prison for several felony counts including involuntary manslaughter and child endangerment.Lopez is not charged with intentionally starting the fire. 1809

SAN DIEGO (KGTV) - The Medical Board of California has filed an accusation and petition to revoke the probation of a Del Mar doctor who is accused of prowling in a former girlfriend’s backyard.10News first broke the story about Dr. Jeffrey Lovin in May after we were given home security video showing a man lurking behind a home. An ex-girlfriend said the man in the video was Dr. Lovin, a radiologist. Lovin was charged with prowling, peeking and violating a restraining order. He pleaded not guilty.At the time, Lovin was already on probation with the Medical Board for other criminal activity. This month, the Board issued an accusation and petition to revoke his probation. SAN DIEGO (KGTV) - Students in the San Diego Unified School District have a handful of programs designed to keep them active and help ward off childhood obesity.In 2016, the district began it's Healthy Initiative. So far, they've created wellness committees in every school. They also put their IMPACT Program into 20% of the campuses, with plans to expand in the next few years."IMPACT stands for Increased Movement in Physical Activity during Class Time," explains SDUSD's Kate McDevitt. It gets the students 30 extra minutes each week outside, learning easy-to-replicate activities that they can take home."They still have time with their PE teacher, but now classroom teachers can engage their students in station based physical activity," says McDevitt. She says it helps with their focus throughout the day."You can see them light up and really engage in the classroom activities and the earning they’re doing when they have time to move," she says.In addition to the IMPACT program, many schools have local gardens where kids learn about fresh fruits and vegetables. Cafeterias have replaced traditional, high calorie options with foods that are healthier. And some schools have changed the way they do celebrations."We have healthy celebrations," says Ocean Beach Elementary Principal Marco Drapeau. "We still celebrate birthdays and holidays. We still make a big deal out of them. But we don’t hand out the sugary treats."The need for a more health-based approach to school comes at a time when kids' risk of obesity is increasing. According to the CDC, one in five kids in the US is obese. And one in three kids born since 2000 will develop Type 2 Diabetes over the course of their lives.Drapeau says schools are on the front lines in the fight."We’re at a stage right now where we’re competing with this," Drapeau says, holding his hands as if he's holding a phone and watching tv. SAN DIEGO (KGTV) -- Surveillance video captured the moment after a thief stole a woman's wallet inside a Midway District grocery store.According to San Diego Crime Stoppers, the theft happened on Sept. 23 inside the Ralph’s grocery store located at 3345 Sports Arena Blvd.While the 73-year-old female victim was in the freezer section, the man waited for the victim to open a freezer door and then approached her shopping cart. The suspect quickly removed the victim's wallet from her purse, which was placed at the top of the shopping cart.The victim was right next to the cart but was looking inside a freezer when the theft occurred.The suspected thief walked away without the victim realizing what had happened. The total loss of the wallet and cash inside it is over ,500.Investigators reviewed store surveillance footage, which showed the man following the victim throughout the store and appearing to target her.The suspected thief is described as a white male, approximately 5’10“ tall, 175 lbs., with tanned skin.
