SAN DIEGO (KGTV) -- The Trump administration is targeting California for its sanctuary laws protecting undocumented immigrants.Immigrants in San Diego say they already live in fear of being split from their families. Those who came here for a better life say they are contributing to the economy and their communities. They say it's unfair to paint all undocumented immigrants as criminals.Jesus Mendez Carbajal, a DACA recipient and Human Rights Organizer for Alliance San Diego, believes the lawsuit is unfair and infringes on state's rights.However, some U.S. citizens say it's about time an administration took serious action against states.Brenda Sparks recently moved out of California because of its sanctuary laws. She doesn't believe the state is doing enough to protect its legal citizens.Now she lives in Mesa, Arizona.Almost seven years ago, Spark's son Eric was killed when an undocumented immigrant without a drivers license hit him. Sparks believes if the United States was tougher on illegal immigration her son would still be alive today. 1063

SAN DIEGO (KGTV) - The Trump administration’s latest effort to keep asylum seekers out of America is being met with opposition. Attorney General William Bar directed immigration judges to deny bond hearings for asylum seekers arriving at the border. The ruling does not go into effect for another 3 months and Barr himself noted it will have a "significant impact" on the already overcrowded detention centers. “A person can be detained indefinitely," said immigration attorney Edward Orendain. "This is just another attempt by this administration to make things more difficult for those seeking asylum.” The Department of Homeland Security acknowledged overcrowding many of their detention centers along the border earlier this month and requested the 90-day delay after Barr’s ruling on Tuesday. “It’s only a call to build more detention centers,” said Benjamin Prado with American Friends Service Committee. “Those contracts go to a private prison corporations that make huge amount of profits on the detention of people, off the ‘warehousing’ of individuals.”Barr’s ruling is expected to be challenged in court. 10News has reached to Immigration and Customs Enforcement on how this would affect their centers in San Diego. 1234

SAN DIEGO (KGTV) — The wife of ex-NFL tight end Kellen Winslow II has filed for divorce, months after the former footballer was convicted of rape.Janelle Winslow filed documents for divorce on Aug. 30 in San Diego, according to records. The couple has been married for 13 years and have two children together.In June, Winslow was found guilty on three counts including rape, lewd conduct, and indecent exposure, stemming from accusations he raped three woman and exposed himself to two others.RELATED: Kellen Winslow Jr. tells 10News he's 'innocent' in rape caseThe jury, however, was deadlocked on eight other charges, including rape and kidnapping in connection with two other women. SAN DIEGO (KGTV) -- The retrial began Thursday for Constantino Banda Acosta, the man prosecutors say was drunk and angry from a fight when he caused a hit-and-run crash that severely injured a 6-year-old returning from a family trip to Disneyland. The jury was deadlocked Thursday on whether or not Banda was even at the wheel. Throughout the trial, Banda sat quietly in the courtroom and could be seen smiling at the jury as attorneys laid out their case.The central question in the retrial is whether Banda or an employee of his construction company, Jorge Adame Ariza, was the one driving.RELATED: Verdict reached in trial for driver accused in hit-and-run crash that injured boyAriza was captured in security footage driving the truck from a restaurant where the two men were drinking.Ariza claims he turned the wheel over to Banda before the accident happened, which severely injured 6-year-old Lennox Lake of San Ysidro. Authorities say Banda had also been deported at least 17 times before the crash.Prosecution in the case say the two men were heatedly searching for a man who beat up Banda. Lake’s father says the young boy is expected to testify in the trial later Thursday.Lake is still receiving extensive treatments for his injuries.RELATED: Jury deadlocked in case against driver accused in San Ysidro hit-and-run?Banda was speeding west on Camino de La Plaza around 11:30 p.m. on May 6 when he reportedly ran a stop sign at Dairy Mart Road and crashed his pickup into a Honda Accord carrying the Lake family. In September of 2017, a jury found Banda guilty of misdemeanor charges of driving without a license, battery and vandalism. The jury was hung, however, on felony charges of hit and run causing death or permanent injury, DUI causing injury and driving with immeasurable blood alcohol causing injury.  1866

SAN DIEGO (KGTV) - The Tierrasanta woman whose toddler died after being discovered in a car was arrested Thursday, San Diego Police said. Police said they waited this long to make the arrest to build evidence for a trial.Twenty-month-old Scarlett was found unresponsive outside the home at 10304 Leary St. on Aug. 5. Paramedics tried to resuscitate the child but were unsuccessful. Police said the girl’s mother, Pricilla Marquez Harris, called them at 12:45 p.m. that day to say she could not find her daughter. Harris later called back to say the girl was in her Nissan Altima and not breathing. RELATED: San Diego police: Child found inside parked vehicle in Tierrasanta dies Two days after the girl died, Harris’ cousin and the cousin’s boyfriend suffered possible drug overdoses at the Tierrasanta home. Harris was taken to a hospital for a psychiatric evaluation the same day, officials confirmed to 10News.Harris is charged with child endangerment, inflicting great bodily injury on a child under the age of five years, and personal infliction likely to produce great bodily injury or the death of a child.
