DEL MAR, Calif. (KGTV) - San Diego’s North County Transit District detailed Friday the structural reinforcements made to the Del Mar bluffs following a “washout on the tracks.” Two areas were washed out on the bluffs south of Seagrove Park following the Thanksgiving storm, the NCTD reported. Jacobs Engineering and Leighton Consulting reviewed the cause of the track washouts. A preliminary report found the following contributing factors: Excessive stormwater run-on from the City of Del Mar’s residential streets and adjacent properties. Existing drainage facilities (earthen swale drainage ditches) to include culvert clean outs, stormwater overflow not channeled correctly built up and overflowed the main track just south of 13th Street causing erosion on the west side of the Cast-In-Drilled-Hole (CIDH) piles. Debris was observed on the ends of the ties and evidence of the drainage overflowing the track adjacent to the CIDH piles. Drainage channels were completely silted in at this location as well. Excessive silt was a result of overwhelmed inlets from heavy rain and excessive City of Del Mar run-on stormwater that mobilized right-of-way sediment and sediment migrated further, blocking inlets and filling in earthen trackside ditches. The northern washout location will require engineers to analyze it, according to the NCTD. The repairs will be made no later than Jan. 11-12, a date previously scheduled to complete other rail work. Until the repairs are finished, the NCTD said it will have an inspector stationed at the bluffs around the clock to ensure safety for passengers and train crews. It is critical that we advance projects to stabilize the Bluffs for the next 20 to 30 years so that the region can determine and implement a permanent solution. Over the last few years, we have all seen the impacts of sea level rise and we should expect that we will continue to see more weather-related events like this most recent rainstorm moving forward,” said NCTD Executive Director Matthew Tucker. DENVER, Colo. — On Wednesday, a Boulder man released videos of his July 29 arrest, and said he's ready to take action against the Denver Police Department for "savagely" beating him. He also claims an officer sexually assaulted him with a baton.Michael Jacobs, a self-described student activist, was arrested on July 29 during a "Stop the Sweep" homeless protest at Lincoln Park, across from the Colorado State Capitol.He says he was rattling a fence at Lincoln Park to get an officer's attention and says he was taken down by officers."I was grabbed from behind, it felt like it was from my neck, no warning, no 'you're under arrest,'" Jacobs said.It's important to stress that little is known about what led up to the takedown. Video shows people shaking a fence at the park and then the takedown.In the video, you see an officer run towards Jacobs and then several officers holding him down. You can briefly see an officer use his baton against Jacobs in the recording."One of the officers took his baton, lifted it in the air and forcefully shoved it into my a**," Jacobs said.A probable cause statement released by the Denver Police Department claims Jacobs was part of a group trying to push down a gate at Lincoln Park and adds that they managed to bring it down and get inside.But in the video, Jacobs is outside of the fence.The police report states Jacobs violently resisted arrest and even grabbed an officer's pepper ball gun. It's a claim Jacobs and his attorney, Dr. Matt Greife, dispute."That could not be further from the truth," Jacobs said."To say that he attempted to disarm a police officer of their pepper gun or pepper ball gun, that's nonsense, he was on the ground way too fast," Dr. Greife said.According to Dr. Greife, it's been challenging to obtain vital evidence they should be granted to prepare for a lawsuit and a civil claim they plan to file."We should know what the police reports say. We should know what the body cams tell us," Dr. Greife said.Denver police say they launched an internal investigation and added that it would be inappropriate to comment further.Medical records provided by Jacobs' attorney to KMGH show a doctor couldn't conclusively identify sexual abuse from the incident.Jacobs is facing a felony charge of attempting to disarm a police officer. DEL MAR (CNS) - Border Patrol officials Friday announced that 21 arrests were made earlier this week stemming from a foiled human smuggling operation off the coast of Del Mar.Border Patrol agents spotted a "suspicious vessel" near Dog Beach at about 3 a.m. Tuesday, which was later identified as a panga boat dropping off 16 Mexican nationals.In anticipation of a landing at Camino Del Mar, agents arrived to find a group of people clad in life jackets running toward three vehicles, according to the U.S. Border Patrol.One vehicle was stopped near the scene, while the other two sped off, the Border Patrol said.A 68-year-old U.S. citizen behind the wheel of a 2003 Mazda minivan was arrested along with eight passengers who were Mexican nationals. Two other vehicles were pursued to a hotel in Carlsbad, where the drivers -- both U.S. citizens -- were arrested with eight Mexican nationals who were passengers.According to the Border Patrol, U.S. Coast Guard officials intercepted the panga boat as it was attempting to depart the area, and two Mexican national men aboard were arrested.Border Patrol officials said five people will face human smuggling charges in connection with the incident, while one boat passenger will face charges for re-entry after prior removal. (KGTV) — A Descanso man has finished carving a Buddha statue into a granite boulder in his backyard. “Buddha is in every tree just looking at you like every rock,” said artist Duncan McFetridge. “It’s connected to our saving our environment — all life is sacred.” Duncan McFetridge says it took six months to carve the 6-foot tall Buddha into the granite. “It occurred to me that this was a perfect time and place to carve a representation of Buddha,” added McFetridge, who was heavily involved in the preservation of the Cleveland National Forest. He estimates he chipped away more than 750 pounds using a combination of hand tools and power tools on the stone carving while working in 4-hour increments every day. “These are incredibly difficult,” said McFetridge pointing to cinnamon roll-sized circles adorning the carving's head, “each one takes about a day.” The 78-year-old says someone recently visited and figured out the Buddha carving faces due east, sticking with an ancient tradition of Buddha statues facing east to represent the moment of the enlightenment. “I didn’t know, I was totally unconscious of this,” said McFetridge, who adds he just picked the rock face because of its accessibility.McFetridge says hundreds have already inquired about visiting the statue to which he says he encourages it. “The Buddha wants to be known,” said McFetridge. 1390
