BELLEVUE, Neb. -- Two Sonic employees were killed and multiple others were injured in a shooting at a restaurant near Omaha, Nebraska, on Saturday. The Bellevue Police Department (BPD) said during a Sunday press conference that there were five victims, all of whom were employees of the Sonic restaurant. Lt. Andy Jashinke identified the deceased as 22-year-old Nathan Pastrana and 28-year-old Ryan Helbert. They were declared dead at the scene. Two other victims, 18-year-old Zoey Reese Atalig Lujan and 25-year-old Kenneth Germe, were transported to the University of Nebraska Medical Center as a "Code 3," which Jashinske described as being in critical or near critical condition. A fifth victim had minor injuries. No officers were injured.The police have released body camera footage from their response, showing the shooting suspect, 23-year-old Roberto C. Silva Jr., being arrested at the scene.Jashinske offered condolences to the loved ones of the deceased, as well as prayers and thoughts for those who were injured. The investigation into the incident is in its infancy and BPD said it will release information as available as long as it does not impact the integrity of the probe.TimelineBPD officers first had contact with the suspect on Wednesday night, when an out-of-state caller reported that they believed their Sonic app was being used fraudulently at the Bellevue Sonic where the suspect allegedly spent . A restaurant employee contacted police about the call.An officer in the area saw the suspect's vehicle driving away and placed him under arrest. He was charged with identity theft, less than 0.The suspect possesses a Nebraska conceal and carry permit. Police officers located three guns inside the vehicle during the traffic stop on Nov. 18. He was taken to jail, the guns were impounded as evidence and remain with BPD.At 9:23 p.m. on Saturday, a call was received by police dispatch. The caller reported a U-Haul truck that was on fire. The caller described seeing suspicious items such as wires and tubes sticking out of the back of the truck.At 9:24 p.m. a call reported shots fired in the area.First police unit arrived at 9:26 p.m.By 9:27, the first description of the suspect came though as a male, approximately 6 feet 6 inches tall, with a large build and an unknown race.At 9:31, officers reported that they believed they'd located the suspect.At 9:39, the police officers on the scene confirmed they had the suspect in custody.Officers on the west side of Sonic apprehended the suspect. At team of officers on the east side observed victims inside the restaurant and performed first aid immediately on three victims. Ongoing investigationThe presence of the U-Haul truck is being investigated. Police believe it was brought there by the suspect and confirmed that it was in flames and was burned up.Officers located at total of four firearms on the scene.The suspect was not armed when he was arrested. He complied with officers' orders and did not resist arrest.Police said there were customers outside the restaurant and do not believe any were injured.Court records show Silva was arrested and charged with identity theft under 0 on Nov. 18 after he allegedly bought worth of food at the same Sonic using someone else's Sonic app.Members of the public are asked to report any information regarding the shooting and the alleged shooter to the Bellevue Police Department. 3430

Better known as “Hollywood,” William Difonzo, Jr. was accused of punching and killing a man at a bar in Lake Worth, Florida in February 2017.Prosecutors announced Friday they have dropped the manslaughter charge against Difonzo, 27, citing lack of evidence, in the wake of him claiming “Stand Your Ground.”Palm Beach County Sheriff’s Office deputies arrested Difonzo on June 26, claiming he fatally punched Sebastian Paz in the face at the suburban Lake Worth bar. Deputies say the altercation began when one of Paz’s friends tried saying hello to Difonzo in the parking lot of the bar, but Difonzo was upset and told the man to go away. A woman told the man to go inside because “Difonzo tends to be problematic,” the report states. The man went inside the bar, but shortly thereafter went back outside to smoke. Difonzo moved towards the man in the parking lot, clenching his fist. Paz jumped in between the two, looking to stop a potential fight.A second witness told investigators Paz “had his arms crossed invading Difonzo’s personal space” as an argument broke out between the men.Difonzo punched Paz hard in the face, according to the arrest report. Paz fell straight back onto the asphalt in the parking lock, hitting his head on a concrete parking stop. He immediately started bleeding from his mouth and nose.Difonzo left the scene right away, according to a detective’s notes.“Paz didn’t deserve to die,” a woman who witnessed the punch told investigators.Paz was declared deceased the next morning in the hospital. The Palm Beach County Medical Examiner’s office determined Paz’s cause of death was blunt force trauma and ruled the manner of death as a homicide. Four months later, Difonzo was booked into the Palm Beach County Jail.Difonzo’s attorney Steven Bell said those witness’ stories changed once people were called into deposition. “All eyewitnesses have testified that they either did not see how the fight began or that Mr. Paz was the initial aggressor and [Difonzo] acted in self-defense,” Bell said.That’s why Bell says in December he filed a motion to dismiss the manslaughter charge against Difonzo based on statutory immunity, better known as the “Stand Your Ground” defense.In the motion, Bell cited a change in Florida law in June 2017 that shifts the burden of proof from the defense to the state. “It is now the state’s burden to show by clear and convincing evidence that [Difonzo] did not act in self-defense,” Bell wrote.  A hearing on the stand your ground defense was scheduled for March 26.Just days before, prosecutors announced they would no longer prosecute Difonzo on the manslaughter charge on Friday. Prosecutors said in court documents that “although there was probable cause to make an arrest, the evidence cannot prove all legally required elements of the crime alleged and is insufficient to support a criminal prosecution.”“It was dismissed because he stood his ground, he defended himself,” Bell told WPTV. “He was essentially cornered outside of a bar”But, he remains behind bars at the Palm Beach County Jail. Court records show Difonzo pleaded guilty to driving with a suspended license in a crash that killed one of his passengers in Jan. 2013. He was sentenced to three years in prison and two years probation, which was scheduled to end on May 3. His license was suspended in 2011 for driving under the influence, records state. In addition to the manslaughter charge, Difonzo was charged with violating his probation for getting arrested. He was also charged with testing positive for drugs and not reporting to his probation officer from Jan. 2017 until the time of his arrest in June.Several court documents report Difonzo as a known gang member. On Monday, Difonzo pleaded guilty to violating his probation by testing positive for drugs and absconding from justice. The violation charge for his manslaughter arrest was dropped.He was sentenced to five years in prison, with credit for three and a half years he has already spent behind bars. Bell had asked the judge to sentence him to time served.“I respect the judge’s decision, but it’s not what he wanted,” Bell said.Bell said he was relieved for Difonzo and Difonzo’s family when he learned the state had dropped the manslaughter charge.“He was innocent so he was properly nolle prossed and dismissed.” Bell said Difonzo would have claimed “Stand Your Ground” even under the original rules of the law.Difonzo could have faced 15 years in prison if convicted of manslaughter, according to Bell.Former Palm Beach Gardens police officer Nouman Raja has also filed a "Stand Your Ground" motion to dismiss the manslaughter and attempted murder charges against him in the death of Corey Jones. (KGTV) - A Bonita family has been making gift bags for children in need for eight years and the pandemic this holiday season didn't stop them from spreading joy.Usually the assemblyline forms in Diane Zoura's garage the weekend after Thanksgiving. There's lots of friends, family and food to go around. This year the pandemic pushed them outside, under a tent a week later than planned."We are more spaced out this year, we set up outside, we’re taking temperatures, we’re all wearing masks so we’re just being more safe," Zoura said.They had to delay the event because a family member was sickened with the coronavirus weeks earlier. She said everyone is okay and they wanted to make sure everyone was safe when they did come together.Sunday, they were focused not on the pandemic, but on giving the gift of love and joy, a thousand times over."We’re going to give 400 of them to Build a Miracle and they’re going to hand them out to homeless children in Mexico and then we’re going to be giving the rest to the Polinsky Children’s Center for the foster kids in San Diego." Zoura said they wanted to send more gifts than last year.In 2019, they sent 750 gifts, in 2020 they'll distribute 1,000 and their ambitious goal for 2021 is 2,000 gifts. BROWARD COUNTY, Florida — The brother of the accused Parkland shooter told deputies he went to Marjory Stoneman Douglas High School three times since his brother allegedly committed a deadly shooting there in February, according to the Broward Sheriff’s Office.“I just went there to take it all in,” Zachary Cruz can be heard saying to deputies on recently released Broward Sheriff’s Office body worn camera footage. Cruz was arrested for trespassing on school grounds on March 19 despite being warned to keep away from the school, according to a BSO report.Over the radio, a deputy relayed that the brother of the deadly school shooting suspect was spotted riding through the Parkland school campus on his skateboard.The Broward Sheriff's Office released body-worn camera footage and radio transmission from their investigation into Cruz for trespassing.  In the video, Cruz is seen talking to deputies on the side of 10100 Holmberg Road in Parkland. Deputies say multiple people told law enforcement they saw Cruz riding on his skateboard at Stoneman Douglas High.“You can't go on the school property," a deputy told Cruz in the video. Deputies search his backpack, which he said was filled with clothes.Cruz said he was “taking a break” from school and left when he was in the eleventh grade. He told deputies a friend dropped him off there.Deputies have Cruz sit on the ground, with his skateboard nearby, place him in handcuffs and then put him in the back of a patrol car. He was later booked into the Broward County Jail.A Broward judge set Cruz’s bond for 0,000 for trespassing. Trespassing is a misdemeanor that usually carries only a bond. If released, he’s ordered to wear an ankle monitor, stay away from any school, and the suburban Lantana home where he’s living will be searched for guns and ammunition.The Broward Sheriff’s Office is asking a judge for a “risk protection order” to ban Cruz from purchasing or possessing any guns or ammunition for a year. The order has temporarily been granted and a judge is expected to make a final decision in April. 2109
