RAMONA (KGTV) - — The owner of Ramona Fitness Center is trying to rally business owners to stand up for their rights and consider defying San Diego County public health orders that require many businesses to close.“They’re forcing us out of business," Peter San Nicolas told ABC 10News in an interview Tuesday. "They’ll force people to not be able to pay for food and pay for home, for somewhere to live. We’re talking about basic necessities and they’re pushing us to the limit.”Gyms are among the sectors ordered to cease all indoor operations after the county moved into the state's purple, or worst, tier. This comes as the county recorded 1,546 new COVID-19 cases Tuesday, a single-day record.San Nicolas makes the case that gyms can open safely and that forcing them to close will not stop the spread. “We haven’t had any issue with it here in the gym. We’ve had over 25,000 check-ins just since June and we’ve had no cases of covid here at the gym.”According to the latest outbreak numbers on the county website, only 0.4% of all cases recorded between June 5 and November 14 have been tied to gyms. However, many public health experts say there is no question gyms should be closed during this most recent surge. "Gyms are one of the riskiest possible businesses," said Dr. Rebecca Fielding-Miller, an epidemiologist who teaches at UC San Diego, in an email to ABC 10News. "By definition, people are breathing heavily in an indoor space, which is a recipe for spread. And while I haven’t been inside a gym since March, I would hazard a guess that gyms that are threatening to defy county orders are also not gyms that are enforcing masking policies. They should absolutely be closed."During the last COVID-19 surge in August, Ramona Fitness Centers became one of the first and only businesses cited and then charged by the District Attorney for remaining open in violation of public health orders. San Nicolas says he expects the County to come after him again. He is represented by a legal team attempting to sue for businesses to stay open. 2059

Protests in response to the death of Stephon Clark, a 22-year-old who was shot and killed by Sacramento Police on Sunday after officers confused his cellphone for a gun, caused major disruptions in Sacramento on Thursday. Most fans were unable to enter the Sacramento Kings' NBA match against the Atlanta Hawks despite a delay in the game. Protesters locked arms around the arena's gates, prohibiting fans from reaching the doors. As the game tipped off Thursday evening, only the first few rows of seats were full in the arena that seats nearly 20,000 fans. "Tonight's game began with a delay," the Kings said in a statement. "Due to law enforcement being unable to ensure ticketed fans could safely enter the arena, the arena remains closed and we ask fans outside to travel home. We will issue further information soon regarding a refund."Some fans left the area outside the arena disappointed. "I"m very disappointed," Fermin Rodriguez told the Sacramento Bee, as he was planning on seeing the game with his wife and four children. "I mean I feel their pain, but why do we have to suffer as well? We paid a lot of money for these tickets. I hope they give us a refund."Protesters also disrupted rush hour traffic earlier in the evening by standing in the middle of Interstate 5 before police cleared the hundreds of protesters off the freeway. Captain Norm Leong of the Sacramento Police Department confirmed on Twitter late Thursday that no one has been arrested in connection to Thursday's demonstration. The protests were sparked hours after Sacramento Police released helicopter and bodycam video of Sunday's incident. It showed Clark running through several yards before being confronted behind his grandmother's door. In the video, police could be heard telling him to put his hands up. Within seconds, officers fired 20 rounds at Clark, killing him. "Prior to the shooting, the involved officers saw the suspect facing them, advance forward with his arms extended, and holding an object in his hands," Sacramento Police said in a statement. "At the time of the shooting, the officers believed the suspect was pointing a firearm at them. After an exhaustive search, scene investigators did not locate any firearms. The only item found near the suspect was a cell phone."Police were originally called to the scene over someone breaking into cars. 2434
President-elect Joe Biden says the day he is sworn in as president, he will ask all Americans to wear a mask for 100 days. "Just 100 days to mask, not forever. 100 days. And I think we'll see a significant reduction." Biden said during an interview with Jake Tapper on CNN.Biden said he wants to balance curbing the spread of the coronavirus without shutting down the economy. He said he talked with Dr. Anthony Fauci Thursday about his plans and asked the doctor to stay on in the new administration.Biden often wears a mask in public, and he and Vice President-elect Kamala Harris held "drive-in" campaign events to encourage social distancing. A scientific model released in October predicted 500,000 American deaths from coronavirus by March if there is no change to mask wearing and social distancing. The study found that if even 85 percent of Americans wore a mask routinely, almost 100,000 lives could be saved between now and March. However, those estimates may be out of date, as the coronavirus has spiked in the month of November, reaching to almost 14 million total positive cases and more than 275,000 deaths as of December 3, and shows no signs of slowing down in December, especially as health experts warn we have not seen a spike from Thanksgiving travel yet in coronavirus case numbers. The FDA is expected to grant emergency use authorization to Pfizer and Moderna's coronavirus vaccine in the next few weeks. However, masking and social distancing will still be needed since the vaccine will not be available to everyone right away. Biden told CNN he would be "happy to" get a coronavirus vaccine once Dr. Fauci and the FDA say it is safe. His comments come one day after three former presidents, Bill Clinton, George W. Bush and Barack Obama, said they would publicly get the coronavirus vaccine to demonstrate its safety to others. 1863
