Walmart is suing the U.S. government in a pre-emptive strike in the battle over its responsibility in the opioid abuse crisis.The government is expected to take civil action against the world’s largest retailer, seeking big financial penalties, for the role its pharmacies may have played in the crisis by filling opioid prescriptions.But on Thursday, Walmart filed a lawsuit saying that the Justice Department and the Drug Enforcement Administration are blaming the company for the government’s own lack of regulatory and enforcement policies to stem the crisis.Walmart says it is seeking a declaration from a federal judge that the government has no lawful basis for seeking civil damages from the company. It is also seeking to clarify its legal rights and duties under the Controlled Substance Act.Walmart operates more than 5,000 pharmacies in its stores around the country.“Walmart and its pharmacists find themselves in an untenable position,” the company based in Bentonville, Arkansas, says in the lawsuit filed in the U.S. District Court in the Eastern District of Texas. “Under defendants’ sweeping view, Walmart and its pharmacists may be held liable — perhaps even criminally — for failing to second-guess DEA-registered doctors and refuse their prescriptions. But if pharmacists do so, they may face the wrath of state medical boards, the medical community at large, individual doctors, and patients.”Walmart says in the suit that the Justice Department identified hundreds of doctors who have written problematic prescriptions that Walmart’s pharmacists allegedly should not have filled. But nearly 70% continue to have active registrations with the DEA, the lawsuit says.“In other words, defendants want to blame Walmart for continuing to fill purportedly bad prescriptions written by doctors that DEA and state regulators enabled to write those prescriptions in the first place and continue to stand by today,” the suit says.The lawsuit names the Justice Department and Attorney General William Barr as defendants. It also names the DEA and its acting administrator, Timothy Shea.In the suit, Walmart describes a government probe of the company that began in December 2016 and calls it a “misguided criminal investigation” conducted by the U.S. Attorney’s office for the Eastern District of Texas. Walmart says it fully cooperated with the probe.In the spring of 2018, the office advised that it intended to indict the company. In August 2018, Walmart said that officials at the Department of Justice recognized that there was no plausible basis for a criminal indictment, and the department formally declined to prosecute Walmart. But the civil investigation continued.The initial investigation was a subject of a story in ProPublica published in March. ProPublica reported that Joe Brown, then U.S. attorney for the Eastern District of Texas office, spent years pursuing a criminal case against Walmart for its opioid prescription practices, only to have it stymied after the retail giant’s lawyers appealed to senior officials in the Justice Department.Two months later, Brown resigned. (KGTV) - A dog owner has a warning for other pet owners after her 5-year-old English Bulldog died during a dental cleaning at a Vista pet hospital."I just thought it was a routine visit," said Kristine Ortiz.Ortiz's nightmare began two Tuesdays ago at Banfield Pet Hospital in Vista, after she brought Chesty in for a dental cleaning. Chesty is her emotional support dog. Ortiz, a medically retired Marine, lives with a rare and debilitating bone disease. Ortiz got the call just before 3 in the afternoon."Just in shock. Kept thinking this is not my dog. Has to be a different dog," said a tearful Ortiz. RELATED: Dog dies after suffering burns during surgeryIt wasn't. She was told Chesty was dead."I was upset. I remember screaming ... I've had surgery six times since I got my dog, and she's been with me the whole time, so it was very emotional," said Ortiz. Ortiz demanded an explanation."They told us he had an adverse reaction to the medicine and everything they were administering," said Ortiz.That didn't make sense to Ortiz. Chesty, a healthy dog, had been put under during two previous cleanings and never had any issues. It’s been celebrated by African Americans in the country for years.“I actually didn’t learn about that until I was an adult, just in general conversation speaking with other people,” said Erica Parham.Parham is a product of the Hampton school division in Virginia Beach area.“I wasn’t taught that in school at all,” she adds.She wants to see change. Her boys, Jaxon and Sebastian, go to Kempsville Elementary School in Virginia Beach.“They knew about Fourth of July in day care,” but they were never taught about the day in 1865 when African American slaves found out they were free."I do believe that large parts of the Virginia Department of Education curriculum are inadequate to really tell the story of slavery and racism in Virginia,” said Brian Teucke.Teucke is an 8th grade civics teacher at Page Middle School and also the president of the Gloucester Education Association."There are huge gaps in our curriculum that need to be addressed, and [they] can be by enhancing the curriculum,” he adds.The Department of Education says new history textbooks and curriculum must correspond with the standards of learning, and revising the SOLs takes about two years, meaning it will take some time before Juneteenth makes it inside textbooks.The department encourages teachers to use online resources in the classroom. WASHINGTON — The Supreme Court sounded skeptical Monday that President Donald Trump could categorically exclude people living in the country illegally from the population count used to allot seats among the states in the House of Representatives.But it also appeared possible that the justices could avoid a final ruling on the issue until they know how broadly the Trump administration acts in its final days in office and whether the division of House seats is affected.No president has tried to do what Trump outlined in a memo in July — remove millions of noncitizens from the once-a-decade head count of the U.S. population that determines how many seats each state gets in the House of Representatives, as well as the allocation of some federal funding.Justice Amy Coney Barrett was among several members of the court who said the administration’s argument for broad discretion in deciding whom to exclude is troublesome because “a lot of the historical evidence and long-standing practice really cuts against your position.”The court decided to hear the case on a fast track, based on the administration’s plea for a decision by early January, when Trump is required by law to transmit census numbers to Congress. The Census Bureau is supposed to send the data to Trump by Dec. 31. However, the bureau said last month they are checking anomalies and the data will be delayed. They did not give a new date, only saying they hope some data will be available in January.
