SAN DIEGO (CNS) - A man convicted of sex crimes against children in Northern California who was recommended for conditional release to a Pauma Valley home will no longer be considered for placement in San Diego County, prosecutors said Friday.Joshua Cooley, 40, is classified as a Sexually Violent Predator, a designation for those convicted of sexually violent offenses and diagnosed with a mental disorder that makes them likely to re-offend.According to the San Diego County District Attorney's Office, Cooley was convicted in Humboldt County of sex crimes against underage girls.The Department of State Hospitals recently recommended placing Cooley at 15077 Adams Drive after attempts to find a suitable Humboldt County location were unsuccessful, according to the DA's Office.The address is the same location where another Sexually Violent Predator, Joseph Bocklett, was recently recommended for release. San Diego County Superior Court Judge Howard Shore ultimately decided against the placement, ruling that it would bring the 76-year-old Bocklett too close to areas frequented by families.San Diego County District Attorney Summer Stephan lodged a strong objection to Cooley's proposed placement, citing Shore's ruling and the potential risks to the public."Ignoring and overlooking Judge Shore's thorough, thoughtful and well- reasoned conclusions and continuing to consider this location for placement of an SVP is reckless and irresponsible," Stephan wrote in a letter to Liberty Healthcare and the California Department of State Hospitals, which are tasked with locating suitable post-release housing for sexual predators.Stephan wrote that if the placement was considered inappropriate for Bocklett, a senior citizen, the much younger Cooley represented an even greater risk.According to the DA's Office, Liberty Healthcare has stated that the recommendation was made in error, and the Department of State Hospitals no longer feels the Pauma Valley address is a suitable location for Cooley. An Oct. 9 virtual court hearing was scheduled in Humboldt County Superior Court to discuss the proposed placement, but that hearing has since been vacated."This placement would have put children and families at risk, so we went to battle alongside our community, and we prevailed," Stephan said. "I want to acknowledge that the system worked in that the State Department of Hospitals gave serious consideration to our concerns and spared us from an extended legal battle in court. They showed that they care about our community. I also want to acknowledge the SAFE Task Force, led by the sheriff's department, for all their work giving notification and gathering input from the community. As always, the DA Sex Crimes and Human Trafficking Division demonstrated their commitment to keeping our children safe and the community stood firmly with us in stopping this placement." 2888

SAN DIEGO (CNS) - A man whose altercation with four off-duty San Diego police officers in the parking lot of a Grantville bar drew attention from local activists alleging excessive force was sentenced Thursday to a three year probation term in connection with cocaine and firearm possession, which includes 90 days in jail and nine months to be served in a work furlough program.Jonathan Felix, 29, pleaded guilty last month to possession of a loaded firearm and cocaine, in connection with the Nov. 7, 2018, altercation outside McGregor's Grill and Ale House just before 2 a.m.The case generated substantial public interest regarding the use of police force rather than for the felony case, in which Felix was accused but never charged with pointing the gun at the officers, prompting them to tackle him to the ground and strike him several times until they were able to seize the pistol, according to prosecutors.RELATED: San Diego man says off-duty SDPD officers assaulted himThe blows rendered Felix unconscious, and left him with a fractured pelvis, fractured hand and cuts and bruising to his head, while one of the officers testified that he broke his hand punching the defendant.In addition to possessing cocaine, Felix was prohibited from possessing a firearm due to theft and drug-related convictions out of Arizona, according to Deputy District Attorney Michael Runyon.Following his 90 days in custody, Felix will continue working during the day at Greystone Prime Steakhouse & Seafood in the Gaslamp Quarter, where he was employed at the time of his arrest. San Diego Superior Court Judge Polly H. Shamoon imposed a suspended four-year prison sentence, meaning Felix could head to prison if he violates the terms of his probation.At a preliminary hearing in February, Officer Anthony Duncan testified that after he and other officers departed McGregor's, they noticed Felix leaving the premises and returning to the parking lot on several separate occasions, both in his Dodge Durango and on a bicycle. He said the officers were concerned that Felix was "casing" vehicles, possibly to break into or steal cars.Felix was exhibiting "odd behavior" and "something didn't feel right (about him)," Duncan said.Officer Jose Rodriguez, who was at the bar with the other men but left before the altercation with Felix, testified that he also felt Felix was looking into vehicles parked in the lot.Despite their concerns, none of the officers called for assistance from on-duty law enforcement until after they restrained Felix, according to Duncan.Duncan said that he approached Felix, at which point the defendant produced a semi-automatic handgun from his waistband and pointed it at him, prompting all four officers to draw firearms on Felix.Surveillance footage from the parking lot of the business captured the physical altercation between the men, but not the purported standoff, which was blocked from view by a parked car. The defendant, who was sitting on his bicycle at the time, backpedaled away from the men, who followed and tackled him to the ground, according to surveillance footage.Felix told investigators after being arrested that he believed the group of men, who he said never identified themselves as law enforcement officers that night, may have been casing his Durango or looking to start trouble.Defense attorney Alicia Freeze argued that her client drew his gun out of concern for his safety, but denied that he ever pointed the weapon at the group. Speaking with reporters outside court following the sentencing hearing, she said she felt the officers used "unlawful force" in subduing Felix.Runyon reiterated outside court that Felix pointed a gun at the officers, "ignored several commands" to drop his gun, and "did not give up the gun immediately" even after being taken to the ground.Along with Duncan, the altercation included fellow San Diego officers Nicholas Dabbaghian, Frank Bigler and Ross Bainbridge. 3956

Both were scheduled for arraignment April 6.Takeuchi, who declined to specify the child's gender, described the suspects as "a couple" but said he did not know if they are husband and wife. SAN DIEGO (CNS) - Firefighters extinguished several rubbish fires today in alleys in the Logan Heights neighborhood, police said.The fires were discovered at 12:32 a.m. in the 1900 block of Kearney Avenue and in the 2000 block of Julian Avenue. They were put out by units from the San Diego Fire-Rescue Department, said Officer Tony Martinez of the San Diego Police Department.Earlier reports of a fire on the side of Calvary Baptist Church were incorrect, Martinez said.San Diego's Metro Arson Strike Team was dispatched to the fire scenes, according to Sgt. SAN DIEGO (CNS) - An Arizona man who carried out a series of knifepoint rapes in the city of San Diego 24 years ago, as well as two rapes in Riverside County in 2002 and 2004, was sentenced Thursday to 50 years to life in prison.Christopher Vanbuskirk, 47, of Goodyear, pleaded guilty last year to six rape counts for attacking the women on four occasions between August and November of 1995 in San Diego, as well as two women in the Coachella Valley area of Riverside County in March 2002 and November 2004.Prosecutors said the four San Diego cases occurred twice in the Tierrasanta neighborhood, once in Pacific Beach and once near San Diego Mesa College. Vanbuskirk was identified as a suspect through public-access genealogical databases, which prosecutors described as similar to the technology used to identify and capture Joseph James DeAngelo, otherwise known as the Golden State Killer.RELATED: Suspect in San Diego, Riverside County rape series pleads guiltyPolice said DNA evidence previously linked the San Diego and Riverside county cases, but the identity of the perpetrator was not established until last year.Vanbuskirk was arrested in his home state in May.Two of his victims from the San Diego area spoke at his sentencing hearing, as well as the mother of his first victim.Jane Doe 1's mother said her daughter was attacked at age 18 while jogging on Clairemont Mesa Boulevard, while Jane Doe 2 and Jane Doe 3 said they were attacked in their homes.All the victims described being attacked by a masked Vanbuskirk who threatened to kill them if they screamed, leaving them with emotional trauma that rendered them constantly in fear.Jane Doe 2 said, "The rapist lived free for 24 years, while the victims were imprisoned in our own minds."Vanbuskirk spoke on his own behalf, saying "I do apologize sincerely" to the victims and that he hoped "that they can find it in their hearts to one day forgive me." He also apologized to his family "for the shame I've brought them." 1998
