Garcia's lawyer argued she was exhausted from finishing her finals at Palomar College that day and had been on the prescription medications to treat depression for three years.Garcia received the maximum sentence which was 1-year behind bars. More than 60 of Burke's family members and friends were in the courtroom. Burke's wife Laura gave a victim impact statement saying she does not believe that Garcia is remorseful and that the sentencing was a slap on the wrist.Burke owned and operated a custom surf shop for more than 40 years. He also worked at Costco. Burke's daughter and son both spoke at the sentencing hearing. 938

Officers encountered 31-year-old Trayford Pellerin of Lafayette in the parking lot of the convenience store on NE Evangeline Thruway. As officers tried to apprehend Pellerin, troopers say he fled the scene and a foot pursuit ensued. Officers deployed Tasers as they pursued Pellerin, but they were ineffective.Pellerin, who was still armed with a knife, attempted to enter an occupied convenience store along the NW Evangeline Thruway. Officers discharged their weapons and Pellerin was struck by gunfire.Pellerin was transported to a local hospital where he was later pronounced dead. No officers were injured.The officers have been placed on administrative leave, according to the spokesperson for the Lafayette Police Department.The investigation is active and ongoing. VISTA (CNS) - A male recently reported missing from Oceanside was hospitalized this morning after he was struck by an SUV in Vista.The collision was reported just before 3 a.m. at 2405 N. Santa Fe Ave., said San Diego County sheriff's Sgt. Kevin Johnston.The pedestrian was struck by a red Dodge Dakota that was southbound on Santa Fe Avenue. ``The driver of the Dodge Dakota looked down briefly and when he looked back up a pedestrian was standing in the middle of the roadway in front of him,'' Johnston said. ``The driver of the Dodge Dakota attempted to swerve but collided with the pedestrian.''Oceanside firefighters provided first aid to the pedestrian who suffered an apparent broken leg and was unconscious with what appeared to be severe head trauma, the sergeant said.He was taken to Palomar Medical Center for treatment, Johnston said. VISTA, Calif. -- Firefighters are investigating what caused a large building to catch fire in Vista Monday morning.The fire broke out around 11:20 a.m. near Emerald Drive in Vista. When firefighters arrived, the building, believed to be a large shed, was completely engulfed in flames.Authorities say it took 24 firefighters from Vista, Oceanside and Carlsbad less than 30 minutes to extinguish the flames.Due to the smoke, nearby Grapevine Elementary School kept students inside classrooms so they wouldn’t be exposed to the smoke.Firefighters say they have yet to determine what caused the fire but added that no one was injured.Video captured by Ricardo Gutierrez shows intense flames tearing through the building. 725
