BEIJING, Dec. 20 (Xinhua) -- The Standing Committee of the National People's Congress (NPC), China's top legislature, opened its bimonthly session Monday to read a series of draft laws.During the six-day session, lawmakers are reading, for the second time, a draft amendment to the Criminal Law, a draft revision to the Law on Water and Soil Conservation, and a draft law on intangible cultural heritage.In the draft amendment to the Criminal Law, harsher punishment are to be handed down for principal offenders of organized crimes.Organized crime chiefs will face longer jail terms of up to 15 years and "core members" of organized crime gangs could be jailed for up to seven years, under the proposed amendment to the Criminal Law.Wu Bangguo, chairman of the Standing Committee of the National People's Congress (NPC), presides over the first plenary meeting of the 18th session of the Standing Committee of the 11th NPC in Beijing, capital of China, Dec. 20, 2010. The law currently stipulates that organizers, leaders and core members of crime gangs are all subject to jail terms ranging from three to 10 years.Drivers involved in car racing, which have caused "serious consequences" and drunk drivers would be detained and fined, the draft amendment says.Under a proposed change to the Criminal Law, the death penalty will not be given to people aged 75 years or more at the time of trial except if they used exceptional cruelty when murdering another.The amendment, which is the eighth to the country's 1997 version of the Criminal Law, is meant to further implement the policy of tempering justice with mercy.If the amendment becomes law, it will be a major move to limit the use of the death penalty, after the Supreme People's Court in 2007 began to review and approve all death penalty decisions.According to the draft revision of the Water and Soil Conservation Law, local authorities must seek public and expert opinions before drawing up soil and water conservation plans.The draft also stipulates that penalties for the loss of soil and water must be included in land-use contracts reached with local governments.Also, the amendment stipulates that public servants responsible for supervising and managing food safety will face up to ten years in jail for dereliction of duty or abuse of power in the case of a severe food safety incident.The draft further broadens the conditions for food safety crimes. It says those who produce and sell a harmful food product will be punished, even if poisonings fail to occur.On a different matter, according to the draft Law on Intangible Cultural Heritage, foreign organizations and individuals will have to obtain government approval before conducting surveys of intangible cultural heritage in China.Also, they will have to conduct surveys in cooperation with Chinese ICH research institutions.The top legislature conducted the first reading of the draft laws in August.The legislature will also examine three reports from the State Council on boosting economic and social development in ethnic minority areas, deepening reform of health care systems and stepping up the development of the service sector.Additionally, lawmakers will discuss a report from the NPC inspection team on the enforcement of the country's Energy Conservation Law.They will also consider a bill on a draft resolution to convene the fourth annual session of the 11th NPC.The session was presided over by Wu Bangguo, Chairman of the NPC Standing Committee.

BEIJING, Dec.23 (Xinhua) -- China is tightening regulation on foreign investment in the real estate sector to crack down on speculation, according to a statement from the Ministry of Commerce(MOC) on Thursday.The ministry urges local authorities to increase checks and supervision on property investment that involved foreign investors and strengthen risk controls on the sector, said the statement posted on the MOC web site.According to the statement, foreign-funded developers are not allowed to make profits through buying and reselling real estate projects, which will be strictly monitored by the MOC along with the Ministry of Land and Resources and the State Administration of Foreign Exchange.The ministry also required local authorities to tighten scrutiny over foreign-funded investment companies and not to allow those companies to enter the real estate businesses, while closely examining the exact amount of foreign funds used in new real estate projects.Foreign direct investment(FDI) into China's property sector jumped 48 percent to 20.1 billion U.S. dollars in the first eleven months of this year, compared to a 17.73 percent growth in the total FDI in the same period, according to earlier MOC data.China introduced a group of measures to crack down on property market speculation and rein in skyrocketing home prices since the beginning of this year, including prohibiting the issuance of mortgage loans for third home purchases and raising down-payments.The government is also guarding against possible "hot money" inflows that might complicate China's policy to fight inflation.Property prices in 70 major Chinese cities rose 0.3 percent in November, month on month, and 7.7 percent year on year, according to the National Bureau of Statistics.

BEIJING, Nov. 27 (Xinhua) -- China's apparent consumption of crude steel is likely to reach 596 million tonnes this year, a year-on-year increase of 5.6 percent, according to a steel association official.Apparent consumption represents the sum of net imports and output, and can be used to estimate real consumption excluding inventory.Luo Bingsheng, deputy head of the China Iron and Steel Association, expected the country's crude steel output to climb 8.2 percent this year from one year earlier, to reach 624 million tonnes.Luo further noted that a rising investment in 2011 would result in an increase in China's steel demand.If the year-on-year growth of the country's social fixed assets investment maintained itself at around 20 percent next year, China's crude steel apparent consumption would see an annual increase of 40 million to 50 million tonnes next year, said Luo.

CANCUN, Mexico, Dec. 4 (Xinhua) -- China will not compromise on issues of principle at the ongoing UN climate change conference in Cancun, Mexico, the country's chief negotiator said on Saturday.Su Wei, the chief Chinese negotiator and head of the climate change department of China's National Development and Reform Commission, made the remarks in response to some parties' call for "compromise to make achievements.""All the parties want to reach substantial achievements at the Cancun conference, which can lay a solid foundation for the completion of 'Bali Roadmap' negotiations," Su told Xinhua in an exclusive interview."I think we can cooperate with other parties and even make compromises on some non-principle issues, but we will not compromise on the issues of principle, such as the continuation of the Kyoto Protocol, which is the basis for a package of agreements to be made in Cancun," Su said.The negotiator stressed that the developing countries have reached consensus on the principle issues. "We are keeping solidarity and trying to play a constructive role," he added.Su said some country's opposition to the Kyoto Protocol is no good news to the developing countries, and has exerted negative influence on the conference.Negotiators at the Cancun conference are trying to establish a replacement for the Kyoto Protocol, which obliges rich nations except the United States to cut greenhouse gas emissions by an average of 5.2 percent below 1990 levels by 2008-2012."At the end of the first week of the Cancun conference, there are some progresses in adaptation, finance, technology and mitigation for the developing countries, but it is hard to say if the progresses are final ones," Su observed.As for the rumors about a secret Mexican text, Su said that the president of COP16 has told the delegations from every country including China that Mexico will not put forward a secret text."As I know, Mexico, the host country of COP16, is always pursuing the principles of 'open, transparent and widening participation' for the climate negotiations this year. I believe Mexico will continue to keep the principles to try to get the results of balance at the Cancun Conference," he said.Su noted that the ministers will arrive in Cancun in the second week of the conference. He hopes the ministers can play an active role in promoting the progress of the conference.A 70-strong-member delegation of the Chinese government, headed by Xie Zhenhua, deputy director of the National Development and Reform Commission, is cooperating with other parties to seek a solution to global warming in Cancun.The Cancun talks, from Nov. 29 to Dec. 10, are aimed at finding solutions to global climate change. BEIJING, Dec. 24 (Xinhua) -- China's State Food and Drug Administration (SFDA) on Friday moved to overhaul the supervision over country's dairy products in a bid to ensure food safety before the major Chinese festivals.Local food and drug administrations have been ordered to increase supervision over the trade and consumption of diary products and ensure that dairy products are not mixed with non-edible substances or food additives,read a notice posted on the SFDA's website.The SFDA asked restaurants to keep dairy product suppliers' contact information as well as valid documents which could help authorities identify the quality, specifications and expiration date of dairy products.Year-end is always a peak season for the Chinese to dine out, either with families or colleagues. The Spring Festival, or the Chinese lunar new year and the most important festival for the Chinese, falls on February 3.China's dairy industry was marred by a scandal in 2008, in which at least six infants died and almost 300,000 became ill across the country after consuming dairy products tainted with the industrial chemical melamine.To restore consumer confidence, the Chinese government launched a nationwide safety overhaul of dairy products in November 2008.
