SAN DIEGO (KGTV) -- California’s new gig economy law was meant to help rideshare drivers and other freelance workers get better benefits, but some critics say it’s threatening the spirit of Christmas itself.Those critics are mall Santas, who have traditionally been hired as independent contractors through third-party bookers or employment agencies.Under Assembly Bill 5, authored by Assemblywoman Lorena Gonzalez (D-San Diego), those workers must be reclassified as employees with insurance and other benefits.“Lorena Gonzalez, she might kill all the Santas. She might kill the Easter Bunnies,” said Steve Schafer, the president of the San Diego chapter of the Fraternal Order of Real Bearded Santas.Some Santas warn that bookers may go to great lengths to avoid paying employee benefits. “I don't know how someone can justify this,” said Jerry Tamburino, a Santa who has worked for more than a decade at a large commercial store.Tamburino said his agent notified him Tuesday that she would replace him and other Santas at a chain of California retail stores with out-of-state St. Nicks.“That's what [the booker is] being forced to do to address -- or evade -- or stay in business with this stupid law,” he said.Bringing in out-of-state workers to skirt AB-5 would violate California law, since labor laws apply to anyone performing work in the state, said Gonzalez’ office. But Tamburino said it would be hard for regulators to enforce.Malls and stores could hire Santas directly as independent contractors, Gonzalez’ office noted, since that kind of relationship passes AB-5’s three-pronged test.To do so, Tamburino said he would have to form his own LLC and said he doesn’t have the experience to run his own business.Tamburino said he would begin reaching out to other Santa-booking agencies in hopes they will hire him as an employee, but there’s a lot at stake: he receives about half of his annual income from Santa jobs. 1938

SAN DIEGO (KGTV) - California state Assemblyman and San Deigo mayoral candidate Todd Gloria said he received serious threats of physical violence through social media Wednesday evening.Officials from Gloria's campaign said Thursday that the threats have been reported to the San Diego Police Department and are being investigated. ABC 10News reached out to SDPD Thursday regarding the threats, but the department did not immediately respond.Gloria's campaign said the threats come after former San Diego City Councilman Carl DeMaio flooded voters with texts attacking Gloria for his support of SB-145.The bill lets a judge decide whether to force someone to register as a sex offender in certain circumstances after having sex with a minor. The bill is meant to end discrimination against LGBTQ individuals.RELATED: Ad accuses Barbara Bry of sleeping on the jobGloria said DeMaio's texts to voters are an effort to support Gloria's opponent in the mayoral race, City Councilmember Barbara Bry. Demaio has said he has not endorsed Bry.Gloria issued the following statement on Thursday regarding the threats:"Since KUSI and Carl DeMaio started knowingly misinforming voters about SB-145 in an effort to support my opponent, I have received multiple messages threatening physical violence. After receiving one last night brandishing a gun, it is clear that my campaign team and I must take this seriously. As such, we have reported the threats to the San Diego Police Department, and they are currently investigating.While I refuse to let this paralyze our campaign, voters deserve to know that this is what Barbara Bry's campaign is inspiring. Her campaign is bringing out the worst of who we are. We are so much better than this, and San Diegans should hold her and her campaign accountable this November."In response, Bry's campaign issued the following statement:"Violence and threats of violence have no place in a civil society, and we must all condemn anyone who promotes such activity.However, it's outrageous that Todd Gloria is blaming me while his supporters are promoting political ads that have resulted in numerous personal threats against me and my campaign. Mr. Gloria remained silent as it relates to his own supporters. He appears to be blaming me for the actions of someone with whom he has had a personal feud for more than a decade.Carl DeMaio has no involvement in my campaign and has not endorsed me. SAN DIEGO (KGTV) -- Caltrans is warning commuters about an overnight closure on State Route 54 Thursday. According to the agency, crews will close the westbound SR-54 connector to northbound and southbound I-805 between 11 p.m. Thursday and 5 a.m. Friday. The connector will be closed so crews can complete maintenance on guardrails.Signs will be posted directing drivers to exit at Highland Avenue, turn left to eastbound SR-54 to northbound or southbound I-805. 472
