SAN DIEGO (KGTV) - A San Diego County woman has filed a lawsuit against a local physician who she says used his own sperm to artificially inseminate her.The discovery occurred decades later after Beverly Willhelm and her husband sought out a fertility specialist in the late 80s.Instead of receiving anonymous sperm, she says the doctor used his own. Willhelm says her son, 23-year-old James Mallus, learned after taking a 23andMe DNA test that his biological dad was the same man that his mother consulted to become pregnant.Willhelm says she's now suing the doctor for fertility fraud in a civil lawsuit.Though Willhelm's attorney said the lawsuit was filed Wednesday, ABC 10News is not naming the doctor because we have not been able to confirm that with the San Diego County Courthouse.According to the lawsuit, the doctor still practices in San Diego County. The lawsuit claims that "the Defendant, without Plaintiff's knowledge or consent, used his own sperm to impregnate her."The suit goes on to say that "based on allegations regarding his mistreatment of numerous patients in 1992-93, Defendant surrendered his California medical license in 1999."The doctor's license was reinstated in 2004. Those allegations are not related to the current lawsuit or other instances of fertility fraud.ABC 10News has reached out to the doctor in the lawsuit, but have not heard back. SAN DIEGO (KGTV) - A man who was injured in a fire above a business near Belmont Park in Mission Beach has died.The San Diego County Medical Examiner's office announced the death of 36-year-old Aaron Porter, Wednesday evening.For the last 20 years, Richard Ghozul has worked at Kojack's Greek and American Food, and has lived in the upstairs apartment. Tuesday morning at around 6 AM, the 70-year-old was fast asleep until flames began crackling above his ceiling. “My apartment [is] gone, everything," Ghozul said. With the help of a lifeguard who ran into the apartments, Ghozul barely made it out alive. But Aaron Porter, the man who just moved in next door, did not. According to the County Medical Examiner, Aaron Porter died at UCSD Medical Center after suffering major thermal injuries.“He is always busy. He works on the fishing boat," Ghozul remembered of Porter. “I’m very sad for him.  Too much smoke happened to him.”Early mornings and late nights, Porter worked at Aztec Sportfishing. SAN DIEGO (KGTV) -- A local hardware store is hoping to find the family of a mysterious model the store used for an ad when it first opened its doors in the late 1800s.The woman, known as the “Hardware Lady,” modeled hardware items on her dress for one of San Diego Hardware’s first advertisements 125 years ago.The company is hoping to identify the mystery model in time for their December 8 anniversary party. The store also hopes to honor the model and her family.The model’s dress was styled with keys, locks and chains and a small wood burning stove. The woman’s crown was made of spoons, clothespins and other hardware from the store.The store was founded in 1892 and now operates in Kearny Mesa and online. 721

SAN DIEGO (KGTV) - A missing former Navy SEAL reported missing earlier this month has been found, according to police.San Diego Police said Johnathan Steven Surmont, 45, was located in Los Angeles during the time he was reported missing.RELATED: San Diego Police searching for missing Navy SEAL veteran"A citizen" called SDPD to tell them Surmont was in Los Angeles, at which point the department's Missing Persons Unit confirmed the information."Although Surmont’s current whereabouts are not known to SDPD, he is no longer considered at-risk or a missing person," the department said in a release.Surmont was reported missing after he was last seen in August, telling his wife he was in a "rough place" in Los Angeles, according to a missing person bulletin from the SDPD. His vehicle was found four days later, on Sept. 3, in La Jolla. 866

SAN DIEGO (KGTV) -- A San Diego County leader is asking the state to look into what she calls the disproportionate placement of sexually violent predators in rural East County. In a letter, Board of Supervisors Chairwoman Dianne Jacob asked Attorney General Xavier Becerra to investigate the placements. Jacob says nine out of the 12 predators, dubbed the "dirty dozen" by Jacob, released in the San Diego region have been housed in the communities of Campo, Boulevard and Jacumba Hot Springs. RELATED: Placement hearing to be held for 'bolder than most' rapist“Rural East County should not be treated as a convenient dumping ground for SVPs,” said Jacob. “In their attempt to quietly house these monsters in our county, state officials are exploiting small, rural communities that often lack the resources and clout to challenge these placements.”The letter comes as a judge gets ready to consider a state proposal to put Alan Earl James, another sexually violent predator, in Jacumba Hot Springs.
