TALLAHASSEE, Fla. — A Florida judge sided with a state teacher's union Monday in ruling that the Florida Department of Education could not require all brick and mortar schools to open by the end of the month or lose funding.Leon County Circuit Judge Charles Dodson ruled in favor of the Florida Education Association (FEA), in a lawsuit meant to stop the Education Department's order that would require all schools in the state to reopen for in-person classes by Aug. 31 or face loss of funding. The union filed their lawsuit shortly after the mandate was issued on July 6, claiming the order was in violation of the constitution's safe and secure public education guarantee.The FEA said Monday's ruling is a victory for schools all around the state of Florida."It is a pushback on reckless disregard on human life," said Randi Weingarten, the president of the American Federation of Teachers. "It is a pushback on politics overtaking safety and the science and the well being of communities."Fred Piccolo, a spokesperson for the governor's office, said the state intended to appeal the ruling."We intend to appeal this ruling and are confident in our position and in the authority of the Commissioner and the Governor to do what is best for our students," Piccolo said.The legal team for the FEA says the state can appeal, which would mean an automatic stay in the ruling given Monday. The birthday party for a 5-year-old Davenport, Iowa boy turned into one he’ll never forget when several officers from the Davenport Police Department accepted his invitation to attend.Jackie Martin took to Facebook to share the story of her son, Brayden, and his love for police officers. According to Martin, he loves everything about them, so it shouldn’t come as much of a surprise when Brayden decided he wanted to have a police officer-themed birthday party this year.Brayden personally delivered invitations to the police station in hopes of getting to see a squad car.But what he got in return was so much more.Over the course of the day, seven different officers made their way to Brayden’s party. Detective Donnie Pridemore even brought a pin-on badge with him and Brayden was pinned an official junior officer of the Davenport Police Department.“They went above and beyond to make my son feel like part of the team and really made today so special and allowed us the opportunity to continue to show Brayden the importance of respecting the law and those who uphold it,” said Martin, “they may not wear capes but today, they were definitely the heroes.”Check out the full post from Jackie: 1206

The only mention of smoking in the amendment’s language and in an intent document during the 2016 campaign was that the Legislature and local governments could restrict it in public places.The Legislature last year passed enacting laws that banned the sale of smoking products, saying that it poses a health risk.Orlando lawyer and medical-marijuana advocate John Morgan filed a lawsuit that brought the case in front of a Tallahassee judge who ruled that Florida's current smokable weed prohibition is unconstitutional. On Friday, Circuit Judge Karen Gievers ruled Florida's medical cannabis patients have the right to smoke weed in private places. 835
