A Brooklyn woman whose racist, profanity-laced tirade on the New York subway was captured on video this week has been charged with felony assault after she struck a fellow passenger, authorities said.The dispute between Anna Lushchinskaya, a 40-year-old white woman, and the 24-year-old passenger, a woman of Asian descent, began after Lushchinskaya bumped into the woman early Tuesday, the New York Police Department told CNN.Lushchinskaya yelled profanities at the victim on the northbound D train, hitting her with an umbrella and keys, the NYPD said. On video captured by witnesses, Lushchinskaya can be heard calling the woman a racial slur.Lushchinskaya was apprehended at the 36th Street Station and arrested, the NYPD said.CNN could not reach Lushchinskaya or her attorneys for comment Friday.Lushchinskaya was arraigned in Kings County Criminal Court following the incident, according to Brooklyn District Attorney spokesperson Oren Yaniv. She pleaded not guilty and posted ,000 cash bond, according to court records.She is due back in court January 22.The victim suffered cuts to her face, the NYPD said. One person threatened to call the police.The video shows Lushchinskaya striking the woman several times with her umbrella and her keys and again kicking her."She's not even fighting you back," one person is heard saying.At least two subway riders tried to wrestle the umbrella away.Lushchinskaya is seen spitting in the direction of the victim before yelling more profanity and a racial slur.Juan Ayala, who was filming the incident, said he decided to intervene, but Lushchinskaya lashed out at him. A video posted by another user shows Ayala talking to Lushchinskaya."Do not spit at me," Ayala says in the video, to which Lushchinskaya replies, "What are you, her attorney? F***ing Mohammed."The subway car erupts in a gasp and Ayala gives his reply: "What? B****, I'm Dominican!"Fellow subway riders protested. A Black man who was stopped by sheriff’s deputies while jogging in his neighborhood, then later allowed to leave, is partnering with the department to use his experience for training.In late August, Joseph Griffin was jogging when deputies from Volusia County detained him, telling him he “matched the description” of a suspect they were chasing.“Hey buddy, you’re not in trouble or anything,” the deputy starts on the video, telling Griffin he matches the description of a burglary suspect being sought nearby. “Literally they said white tank top and black shorts, and had a beard. I’m not saying it’s you,” the deputy said, telling Griffin he wanted to check in with other deputies at the scene.In the video, you can hear the deputies radio fellow investigators and double check the description. The deputy later tells Griffin he is being told to detain him. The deputy offers to hold Griffin’s phone to continue recording the incident while he is handcuffed.Griffin remains handcuffed for several minutes while deputies wait for confirmation if he is the suspect or not. Griffin stays calm and talks to the deputies during this time.“Seven cop cars, with everything going on, it’s just a little bit scary,” Griffin says. The deputies agree, but say “see it through our eyes,” since he matches the description. “Do you think we want to be out here killing people?”Eventually, Griffin is let go and it is determined he was not the suspect deputies were looking for. A Florida man was allegedly attacked while trying to do the right thing during Hurricane Irma.The alleged victim was letting Tarvice Lamar Payne stay at his home in Port St. Lucie during the storm when his guest attacked him, according to Port St. Lucie police.Payne, 33, of Royal Palm Beach, accused the alleged victim of stealing his drugs, so he punched him and then threatened him with an ax, a police report states. The alleged victim managed to escape and call the police, but not before Payne took the ax and struck a car in the driveway, police said.Arriving officers managed to track Payne down as he was leaving the area.They charged him with aggravated assault, battery, and criminal mischief. 742
