SAN DIEGO (CNS) - The San Diego-based owners and operators of the conservative One America News Network filed a million defamation lawsuit Monday against MSNBC and political commentator Rachel Maddow for saying on air the network ``really literally is paid Russian propaganda.'' The lawsuit filed in San Diego federal court by Herring Networks Inc., owners of the One America News Network -- or OAN -- calls Maddow's on-air statements ``utterly and completely false'' because OAN ``is wholly financed by the Herrings, an American family'' and ``has never been paid or received a penny from Russia or the Russian government.'' Maddow and MSNBC could not immediately be reached for comment. Maddow made the statements during a July 22 segment of her show, in which she cited a Daily Beast article stating that an OAN on-air reporter was ``on the payroll for the Kremlin.'' Herring Networks' court papers say the reporter, Kristian Rouz, is originally from the Ukraine and started his journalism career by writing articles for Sputnik News, which is affiliated with the Russian government. According to Herring Networks, Rouz was merely a freelancer for Sputnik who selected his own article topics for submission, and his work there had no significance toward his work for OAN. OAN demanded a retraction of Maddow's statement, according to the suit, which says that an attorney for NBC Universal refuted that Maddow's use of the word ``literally'' was not simply a figure of speech. The Herrings' attorney, Skip Miller, said in a statement that ``One America is wholly owned by the Herring family in San Diego,'' who he called ``as American as apple pie.'' Regarding Maddow's statements, Miller said, ``This is a false and malicious libel, and they're going to answer for it in a court of law.'' SAN DIEGO (KGTV) - A gray whale spotted frolicking in shallow waters attracted dolphins and a crowd of swimmers and surfers in the ocean off Mission Beach Wednesday. Lifeguards got a call about the whale possible tangled in fishing line about noon, an official said. A lifeguard who swam toward the whale to investigate determined it was free.The gray whale was young, possibly a year and a half old, whale watcher and photographer Domenic Biagini told 10News. Gray whales are starting to migrate north from Mexico during the spring. There is a good chance San Diegans will see more mothers and juvenile whales closer to shore, Biagini says, because the shallow waters keep the whales safe from orcas. "It's some of the most exciting times for us as professional whale watchers to see these animals, but it's also when we see the most conflicts with these animals coming in with people," said Biagini.Sky10 was above the whale as a group of surfers and swimmers approached it near Mission Beach, coming close to the giant mammal.Biagini warns that can be extremely dangerous for humans and can also stress the animal."These gray whales, despite not being the largest of the great whales we see out here, they can still get 50 feet long and weigh up to 80,000 pounds, so you're talking very large animals. SAN DIEGO (KGTV) - A former Camp Pendleton Marine was sentenced Monday to more than 17 years in prison for owning and distributing child pornography.William Walsh IV, 55, was arrested in May 2017. Escondido Police officers searched his home and seized hundreds of files Walsh had downloaded through peer-to-peer file sharing software.A jury found Walsh guilty of all charges. U.S. District Judge Anthony J. Battaglia said Walsh’s conduct was “on the extreme end of the cases I have seen.”“Today a man who committed terrible crimes against children was sentenced to many years in prison,” said U.S. Attorney Adam Braverman. “These horrible experiences will echo in the hearts and minds of young victims for a lifetime, and I am deeply distressed and deeply committed to pursuing cases that will protect our vulnerable youth from people like Walsh.”“Today’s sentence confirms that this predator can no longer victimize innocent children because he is off the streets and he is offline,” said FBI Special Agent in Charge John Brown. “This investigation showcases the success of collaborative federal and local investigations working toward a common goal.”Walsh will serve his sentence in federal prison. 1208

SAN DIEGO (KGTV) -- A 16-year-old was hospitalized Saturday night after being shot at a gas station in Skyline. Police say the shooting happened at an Arco station near South Meadow Brooke and Paradise Valley Road. According to police, the victim and his friends were walking through the parking lot when one of them was shot. Witnesses told police an argument broke out between the victim and three other teens when one of the three boys, who are all under the age of 18, shot the 16-year-old in the stomach before running away. The 16-year-old was taken to the hospital where he is expected to survive. 613

SAN DIEGO (KGTV) — A group called "Pillars of the Community" is working to make sure people inside San Diego county jails are registered and able to vote. The non-profit based out of southeast San Diego hires inmates to work from the inside. Their efforts were impacted by the coronavirus pandemic this year but they're still hiring and trying to gather information to support their request to have polling places put inside the jails. 443
